AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP
ADOPTED BY ORDINANCE NO. 293 BY AMENDING
ORDINANCE NO. 379 BY COMBINING PLANNING SECTOR
"A" AND "D-1" INTO A REVISED PLANNING SECTOR
IDENTIFIED AS "A-2" FOR ASSESSOR' S PARCELS NOS.
666-261-1 THROUGH 666-261-14 (ORTEGA PROPERTIES)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1 . The City' s Environmental Review Board has reviewed
the subject zone change application, has
determined that the project will have a
significant effect on the environment, has
determined that the previously certified EIR
prepared for the overall project area adequately
addresses the impact of the application, and has
otherwise carried out all requirements of the
California Environmental Quality Act. The City
Council has reviewed and has concurred with that
determination.
2. The proposed zoning is consistent with the land
use, circulation and other designations shown for
the property in the General Plan. The proposed
amendment is otherwise consistent with the goals
and policies of the General Plan.
3. The development of the property under the proposed
amendment will conform to the development
standards and other applicable provisions of
Ordinance No. 293 and Ordinance No. 379 as
amended.
4 . A duly noticed public hearing has been held to
receive and consider public testimony regarding
the proposed amendment to Ordinance No. 379.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1 ,
preceding, the City Council ordains that Ordinance No. 379,
heretofore adopted for Assessor' s Parcels Nos. 666-261-1 through
666-261-14, on January 3 , 1979 , by Ordinance No. 379 be amended.
Said amendment is designated herein as Rezone 83-1 and is more
specifically depicted on Exhibits "A, " "B, " and "C, " attached
hereto.

2 0 SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 4 . City Clerk' s Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted at the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this lst day of
March 1983 , by the following vote, to wit:
AYES: Councilmen Friess, Hausdorfer, Bland,
Schwartze, and Mayor Buchheim
NOES: None
ABSTAIN: Councilmen Friess

PLANNING SECTOR A-2
1. Purpose and Intent
To create a high-quality planned unit development that
provides for the integration of a broad range of retail/
services commercial and public/semipublic institutional
uses in accordance with the General Plan.
2. Principal Uses Permitted (Subsection 1)
(a) General retail uses, including the retail sale
of furniture, home appliances, paint, floor and
wall coverings, auto parts and supplies, bicycles,
sporting goods, hobby supplies, apparel, fabrics,
jewelry, cosmetics and pharmaceuticals, stationery,
flowers, candy, baked goods, liquor, newspapers,
magazines, and similar items.
(b) Commercial services, including home appliance
repair, bicycle repair, cleaning and dyeing
agencies, laundromats, barber and beauty shops,
tailor shops, art and photography studios, printing,
blueprinting and reproduction services (excluding
newspaper or other publishing) , travel agencies,
and similar service uses.
(c) Restaurants (excepting drive-in or drive-thru) ,
bakery, ice cream parlors, delicatessens , cocktail
lounges, taverns; and, small-scale grocery, meat
or liquor (not to exceed 10, 000 square feet for
the planning sector) .
3. Principal Uses Permitted (Subsection 2)
(a) General office uses, such as business, professional,
real estate, travel agencies, and similar uses.
(b) Financial services uses, such as banks, savings and
loan associations, and credit unions.
(c) Medical and dental offices, excluding medical
center and complexes.
(d) Public and semipublic buildings, services and
facilities.
(e) Business, vocational, and professional schools not
requiring outdoor facilities, including secretarial,
art, dance, drama, music, barber, and beauty, but
excluding swimming schools and public and private
primary and secondary schools .

(f) Religion related uses, including churches , temples ,
synagogues and other places of religious worship.
(g) Offices of nonprofit and civic organizations .
(h) Restaurant uses (excepting drive-in and drive-thrul
on pad location "K" only.
4. Principal Uses Permitted (Subsection 31
(a) All principal uses permitted in Subsection 2 , above.
(b) Specialized service uses not requiring extensive
customer access, including linen and diaper supply,
office supplies , catering services , appliance
repair, printing, blueprinting and reproduction
services, upholstery shops, automobile parts and
supply, computer and data processing centers, and
industrial products showrooms.
(c) Wholesaling establishments engaged in the sale of
products to retailers or other businesses but not
the general public.
5. Principal Uses Permitted (Subsection 4)
(a) All principal uses permitted in Subsections 2 and 3,
above.
(b) Vehicle rental and leasing.
(c) Sale of products such as electrical supplies ,
plumbing supplies, hospital or sickroom supplies,
plate glass and mirrors , and carpets .
6 . Conditional Uses Permitted (Subsections 1 and 2)
(a) Vehicle rental or leasing.
(b) Medical centers or complexes.
(c) Video arcades and game machine centers.
(d) Live entertainment.
7. Conditional Uses Permitted (Subsection 3)
(a) All uses listed as requiring a conditional use
permit for Subsections 1 and 2, above.
(b) Veterinary offices and clinics.

(c) Secondhand stores.
(d) Bakery and other food products for wholesale and
retail sales.
8. Conditional Uses Permitted (Subsection 4)
(a) All uses listed as requiring a conditional use
permit for Subsections 1, 2, and 3, above.
(b) Research, developmental and testing laboratories
and facilities. Such uses may include the
development of models and/or prototypes, but
shall not include actual manufacturing or
production of the finished product beyond the
research and development phase.
(c) Pharmaceutical laboratories.
9. Uses Not Listed
Any other use not listed but which is determined by
the Planning Commission to be consistent with the
General Plan and meeting the intent and purpose of the
district shall be reviewed under the Municipal Code
provisions as a Conditional Use Permit.
