REZONE 86-3 (LACOUAGUE/RIVENDELL)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP
ADOPTED BY ORDINANCE NO. 293 BY APPROVING THE
ZONING OF ASSESSOR'S PARCEL NOS. 124-223-38 AND
124-223-39 FROM GM (GROWTH MANAGEMENT) TO PC
(PLANNED COMMUNITY) (LACOUAGUE/RIVENDELL)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has reviewed
the subject zone change application, has
determined that the project will have a
significant effect on the environment, has
required the preparation of an Environmental
Impact Report, which has been certified as
adequate, and has otherwise carried out all
requirements of the California Environmental
Quality Act in accordance with the findings in
Resolution No. 86-6-17-2.
2. The proposed zoning is consistent with the land
use, circulation, and other designations shown for
the property in the General Plan. The proposed
zoning is consistent with all other goals and
policies of the General Plan, as conditioned.
3. The development of the property under the proposed
zoning will conform to the development standards
and other applicable provisions of the Municipal
Code and Comprehensive Development Plan as
attached hereto.
4. A duly noticed public hearing has been held to
receive and consider public testimony regarding
the proposed zone change.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1,
preceding, the City Council ordains that the official zoning
heretofore adopted for Assessor's Parcels Nos. 124-223-38 and
124-223-39 on September 17, 1975, by Ordinance Nos. 293, be
changed from GM (Growth Management) to PC (Planned Community), as
shown on Exhibit A, attached hereto, and Exhibit B, attached
hereto by reference, subject to the following revisions to
Exhibit B:

333 (1) Page 43, Section 5.3.5.2(2), as follows: . . .
"Parcel 1 of Tentative Tract 12663 shall allow
tennis facilities as the principal permitted use";
(2) Page 43, Section 5.3.5.4 of Parcel 1 of Tentative
Tract 12663, . "Recreation and sports
facilities, public or private, which focus on
active recreational uses such as athletic fields,
parks, equestrian facilities and swimming pools
shall be treated as alternate allowable uses,
however, must first be proposed to and approved by
the City Council. A proposed alternate
recreational use for the tennis center site must
first be submitted to the Planning Commission for
recommendation. After public hearing by the
Planning Commission, the matter shall then be
automatically forwarded to City Council for public
hearing and final decision. The Council shall
conduct a discretionary decision making review of
the matter. There shall be no additional fees
required of the developer in proposing an
alternate use."
(3) Amend Section 5.3.3.5 Development Standards as
follows: * 'Minimum lot size on west side of "B"
Street 20,000 square feet.'
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 4. City Clerk's Certification
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be posted at the duly designated
posting places within the City and published once within fifteen
(15) days after passage and adoption as required by law; or, in
the alternative, the City Clerk may cause to be published a
summary of this Ordinance and a certified copy of the text of
this Ordinance shall be posted in the Office of the City Clerk
five (5) days prior to the date of adoption of this Ordinance;
and, within fifteen (15) days after adoption, the City Clerk
shall cause to be published, the aforementioned summary and shall
post a certified copy of this Ordinance, together with the vote
for and against the same, in the Office of the City Clerk.
