APPLICATIONS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING MUNICIPAL CODE SECTION
5-11.05 OF CHAPTER 11 "PARADES" RELATING TO THE
ISSUANCE OF PARADE PERMIT APPLICATIONS
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
HEREBY ORDAINS AS FOLLOWS:
SECTION 1.
Municipal Code Section 5-11.05 entitled "Permits:
Applications: Hearings: Issuance or denial" of Chapter 11
"Parades," of Title 5 "Public Welfare," is hereby amended to read
as follows:
"Section 5-11.05. Permits: Issuance or denial.
"(a) City Manager Review and Approval.
"The City Manager may approve parade permit
applications for parades which:
"1. Will not create any significant demand
on public resources, such as police or
fire protection; or
"2. Will not otherwise threaten the public
welfare, health and safety of the
community.
"The City Manager may impose reasonable
conditions on the application which relate to
public health, welfare and safety
considerations. The parade permit fee shall
be paid by the applicant as set forth by City
Council resolution.
"(b) City Council Review.
"Parade permit applications not meeting the
above stated criteria shall be scheduled by
the City Manager for hearing before the City
Council. The Council, in its discretion, may
grant such application following the hearing
if, from the consideration of the application
and such other information the Council may
otherwise obtain, the Council finds that:
"1. The conduct of such parade will not
substantially interrupt the safe and
orderly movement of other traffic
contiguous to the route of" -the parade;

112. The conduct of such parade will not
require the diversion of an extensive
number of police officers so as to
prevent normal police protection to the
rest of the City;
"3. The concentration of persons, animals,
and vehicles at the assembly areas of the
parade will not unduly interfere with
the proper fire and police protection
of, or ambulance service to, areas
contiguous to such assembly areas;
4. The conduct of such parade will not
interfere with the movement of emergency
vehicles;
5. The conduct of such parade is not
reasonably likely to cause injury to
persons or property or to provoke a
riot;
6. Such parade will move from its point of
origin to its point of termination
expeditiously and without stopping
enroute; and,
7. The conduct of such parade will not
obstruct any construction or maintenance
work scheduled to take place upon any
public roads.
"If the findings set forth in this Section are made
by the Council, the City Manager shall issue the permit for
the parade; otherwise the application for the permit shall
be denied."
SECTION 2. Effective Da
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 3. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published once as required by
law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its
passage.
