Ordinance Number 569ORDI-NANCE NO. 569 294 REZONE 85-3 (ROSAN RANCH/KAISER DEVELOPMENT COMPANY) AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED BY ORDINANCE NO. 293 BY CHANGING THE ZONING OF ASSESSOR'S PARCELS NOS. 121-240-19, 121-240-24, AND 121-240-25 FROM CM (COMMERCIAL MANUFACTURING) TO PD (PLANNED DEVELOPMENT DISTRICT) (ROSAN RANCH/KAISER DEVELOPMENT COMPANY) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: 1. The City's Environmental Review Board has reviewed the subject zone change application, has determined that the project will have a significant effect on the environment, has required the preparation of a Focused Environmental Impact Report, which has been certified as adequate, and has otherwise carried out all requirements of the California Environmental Quality Act. 2. The proposed zoning is consistent with the land use, circulation and other designations shown for the property in the General Plan. The proposed zoning is otherwise consistent with the goals and policies of the General Plan, as conditioned. 3. The development of the property under the proposed zoning will conform to the development standards and other applicable provisions of the Municipal Code, as conditioned. 4. A duly noticed public hearing has been held to receive and consider public testimony regarding the proposed zone change. SECTION 2. Zone Change. Based on the findings set forth in Section 1, preceding, the City Council ordains that the official zoning heretofore adopted for Assessor's Parcels Nos. 121-240-19, 121-240-24, and 121-240-25, on September 17, 1975, by ordinance No. 293, be changed from CM (Commercial Manufacturing) to PD (Planned Development), subject to the following modifications to the Comprehensive Development Plan. -1- 2 95 1. The Development Regulation section shall be modified to include the following standards: a) The developer shall dedicate right-of-way for the Stonehill extension offramp of the Interstate 5 Freeway, as required by the City Engineer. b) The developer shall contribute a prorata share for permanent improvements to Camino Capistrano, as determined by the City Engineer. c) The developer shall provide interim road improvements to Camino Capistrano until the Stonehill extension offramp has been completed as determined by the City Engineer. 2. Page 25, 3(i) shall read as follows: Stucco finishes, when used, should be relatively smooth, but somewhat irregular, in keeping with older adobe textures. Avoid highly textured patterned finishes. 3. Revise all exhibits and figures to reflect adopted Comprehensive Development Plan. 4. Page 30, B-4 - Paragraph shall be deleted. 5. Page 31, C-3 - Paragraph shall be deleted. 6. Page 32 (d) - Paragraph shall be deleted. 7. Page 34, (f)(1) - Thirty (30) foot landscape buffer areas shall be provided adjacent to the front, rear, and north side property lines, with a twent (20) foot landscape buffer adjacent to the I south side property line. These buffer areas shall include side yard setbacks for Areas 1 and 5 and all frontage adjacent to Camino Capistrano, as illustrated in Figure 10, Conceptual Site Plan. Parking areas shall not encroach into the landscape buffer areas. Where building and landscape design can be shown to provide compensating amenities, as approved by the City Council, the north buffer area may be reduced to twenty (20) feet. Page 34, (f)(3) - Building setbacks shall be as follows: A minimum of seventy-five (75) feet front yard for Area 1 and one hundred twenty-five (125) feet for Areas 2, 3, 4, and 5. -2- 9. Hotel shall be designed such that access doors and corridors do not face the street or sensitive view areas of the site; said design shall be approved by the City Council. 10. Uses allowed on Parcel 5 shall include a hotel/motel or office use only, with a maximum of two (2) hotels for the entire project site. 11. Figure 10 (Conceptual Site Plan) and subsequent text shall be modified to include a statement that square footage of building allowed for Area 2 may be increased to 29,000 square feet only to allow the office building alternative or the 26,000 square foot hotel alternative without a corresponding reduction in square footage of buildings on other lots, provided a specific development plan for said lot is approved by the City Council which does not adversely affect visual impacts and tree preservation and avoids massive grading. Under this alternative, total square footage of building area shall not exceed 176,425. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. Citv Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
