Ordinance Number 551ORDINANCE NO. 551 187 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADDING MUNICIPAL CODE SECTION 9-3.624(d) RELATING TO THE CONCURRENT SALE OF ALCOHOLIC BEVERAGES AT AUTOMOBILE SERVICE STATIONS THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings and Intent. The City Council hereby finds that: A. The concurrent sale of alcoholic beverages at automobile gasoline stations has presented a threat to the health, welfare and safety of the community in that concurrent sales of alcohol and gasoline increases the likelihood of driving under the influence of alcohol which in turn seriously threatens the safety of pedestrians and vehicular passengers upon the streets of the City. B. Substantial evidence exists that alcohol consumption by teenagers has increased substantially in recent years; that alcohol related crashes are the leading cause of death for Americans between 16 and 24 years of age; that drivers between 16 and 24 years of age cause 45% of all nighttime fatal, alcohol related crashes, yet account for only 22% of the driving population; that one of two teens drink in cars; and that 8,000 teens and young adults are killed in drinking/driving accidents every year and 40,000 are injured each year. C. There is substantial correlation between traffic accidents in the Southern Orange County region and the consumption of alcohol. The Council finds that a restriction against the concurrent sale of alcohol and gasoline at automobile service stations will diminish the probability of traffic accidents from, or connected with, driving under the influence of alcohol. SECTION 2. Amendment Text. A. Based upon the findings set forth in Section 1 preceding, the following amendment is hereby added to the Municipal Code. -1- B. Amendment. Section 9-3.624(d) entitled "Prohibition Against Concurrent Sale of Alcoholic Beverages and Gasoline" is hereby added to Municipal Code Section 9-3.624, Title 9, "Land Use," Chapter 3, "Zoning," Article 6 "Supplementary District Regulations." "Section 9-3.624(d). Prohibition Against Concurrent Sale of Alcoholic Beverages and Gasoline. "No automobile service station in any zoning district of the City shall be permitted to sell alcoholic beverages as a part of its normal retail business." SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
