ORDINANCE NO. 549 AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE - EQUESTRIAN USES IN RESIDENTIAL DISTRICTS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING CHAPTER 3, TITLE 9 OF THE MUNICIPAL CODE REGARDING EQUESTRIAN USES IN THE GENERAL AGRICULTURAL (AG), SMALL FARM (RA), LARGE ESTATE (EL) AND SMALL ESTATE (ES) DISTRICTS THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: A. The City's Environmental Review Board has reviewed the amendment as set forth herein, has determined that the amendment is a minor change in land use limitations and is therefore categorically exempt. The Environmental Review Board has otherwise carried out all requirements of the California Environmental Quality Act as amended. The City Council hereby finds and certifies said actions as appropriate and correct. B. The Code Amendment will clarify the restrictions for equestrian uses in residential districts. C. A duly noticed public hearing has been held to receive and consider public testimony regarding the proposed amendment. SECTION 2. Amendment Text. A. Introduction. Based upon the findings set forth in Section 1, preceding, the following amendments to the Municipal Code are hereby enacted: B. Amendments. 1. Section 9-3.401(b)(2) is hereby amended to read as follows: "(b) Principal uses and structures permitted. The following principal uses and structures shall be permitted in the General Agricultural (AG) District: "(2) Animal grazing, breeding, boarding, raising, and training, including cattle, sheep, goats, and horses, but excluding hog production, -1- 178 commercial livestock feeding ranches, commercial dairies, commercial horse stables and equestrian centers, commercial kennels, and the commercial slaughtering, dressing, or sale of livestock, fowl or other animals;" 2. Section 9-3.401(d)(6) is hereby amended to read as follows: "(d) Conditional uses and structures permitted. The following uses and structures may be permitted in the General Agricultural (AG) District subject to the approval of a conditional use permit: "(6) Horse stables and equestrian centers, commercial, as set forth in Section 9-3.620 of Article 6 of this Chapter; and," 3. Section 9-3.404(c)(2) is hereby amended to read as follows: "(c) Accessory uses and structures permitted. The following accessory uses and structures shall be permitted in the Small Estate (ES) District: "(2) The keeping of horses, noncommercial, as set forth in Section 9-3.620 of Article 6 of this Chapter;" SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
