AMENDMENT
TO
TITLE 4 OF THE MUNICIPAL CODE -
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING ARTICLE 3, TITLE 4, OF THE
SAN JUAN CAPISTRANO MUNICIPAL CODE - PARKING
REGULATIONS
WHEREAS, California Vehicle Code Section 22651(k)
provides that a local entity may by ordinance authorize removal
of any vehicle parked or left standing upon a highway for
seventy-two (72) or more consecutive hours; and,
WHEREAS, California Vehicle Code Section 22507.5
provides that a local entity may by ordinance prohibit or
restrict the parking or standing, on any street, or portion
thereof, in a residential district, of commercial vehicles having
a manufacturer's gross vehicle weight rating of 10,000 pounds or
more.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Text of Amendments to Article 3,
Title 4 of the Municipal Code.
A. Section 4-6.309. Amendment.
Section 4-6.309, Article 3, Title 4 of the San
Juan Capistrano Municipal Code is hereby amended
to read as follows:
"Section 4-6.309.
Towaway Zones.
"Whenever the Council, by resolution, shall have
established any area as a no parking area as set forth in
this Article, the Council at the same time or thereafter, by
resolution, may determine that any one or more of the
circumstances described in Section 22651 of the Vehicle Code
exist as to such area and may designate such area as a
towaway zone. Whenever the Council shall have designated
any area as a towaway zone, it shall be the duty of the
Traffic Engineer to cause signs to be posted giving notice
that any vehicle parked in such towaway zone may be
removed."
B. Section 4-6.310. Amendment.
Section 4-6.310, Article 3, Title 4 of the San
Juan Capistrano Municipal Code is hereby amended
to read as follows:

"Section 4-6.310. Parking For More Than
Seventy -Two Hours.
"It shall be unlawful for any person who owns or
has the possession, custody, or control of any vehicle to
park or leave standing such vehicle upon any street for more
than a consecutive period of seventy-two (72) hours.
"Whenever any vehicle is parked or left standing
upon any street for more than a consecutive period of
seventy-two (72) hours it may be removed by persons so
authorized pursuant to Vehicle Code Section 22651."
C. Section 4-6.317. Amendment.
Section 4-6.317, Article 3, Title 4 of the San
Juan Capistrano Municipal Code is hereby amended
to read as follows:
"Section 4-6.317. Commercial Vehicles:
Restrictions.
"(a) It shall be unlawful for any person to stop,
stand, or park any commercial vehicle, as
defined in Section 260 of the Vehicle Code,
for more than one hour on any street in the
City.
"(b) It shall be unlawful for any person to stop,
stand, or park any commercial vehicle, as
defined in Section 260 of the Vehicle Code
and having a manufacturer's gross vehicle
rating of 10,000 pounds or more, on any
street, or portion thereof, in a residential
area of the City."
D. Section 4-6.318. Amendment.
Section 4-6.318, Article 3, Title 4 of the San
Juan Capistrano Municipal Code is hereby amended
to read as follows:
"Section 4-6.318. Commercial Vehicles:
Restrictions: Exceptions.
"The provisions of Section 4-6.317 (a) and (b) of
this Article shall not apply to the following:
"Any commercial vehicle making pickups or
deliveries of goods, wares, or merchandise from, or to, any
building or structure on the restricted streets or when
delivering materials to be used in the actual and bona fide
repair, alteration, remodeling, or construction of any
building or structure.

"The provisions of Section 4-6.317(a) of thij 33
Article shall not apply to the following:
"Passenger buses under the jurisdiction of the
Public Utilities Commission of the State."
SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty
(3 0) days after its passage.
SECTION 3. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published once as required by
law and posted at the duly designated posting places within the
City of San Juan Capistrano within fifteen (15) days after its
passage.
