AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED
BY ORDINANCE NO. 293 CHANGING THE ZONING OF PARCELS 1
AND 2 OF TENTATIVE PARCEL MAP 87-153 FROM GM (GROWTH
MANAGEMENT) TO PD SDP 88-1 (PLANNED DEVELOPMENT)
(CAPISTRANO VALLEY TENNIS CLUB/BUNNELL)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The proposed zoning is consistent with all Elements of the General Plan
(Capistrano Valley Tennis Club/Bunnell).
2. The development of the property under the proposed zoning will conform
to the development standards and other applicable provisions of
Ordinance No. 293, Specific Development Plan 88-1 and TPM 87-153.
3. A public hearing notice denoting the purpose of the request, time, date,
and location of the hearing was published in the Capistrano Valley
News. Property owners within 300 feet of the project boundary were
sent notice of the project pursuant to state law requirements.
4. The City Council certified Final Focused Environmental Impact Report
87-1 as complete for the proposed development, and has otherwise
carried out all the requirements of the California Environmental Quality
Act.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1, preceding, the City Council
ordains that the official zoning, heretofore adopted for Parcel 1 and 2 of Tentative
Parcel Map 87-153 on September 17, 1975, by Ordinance No. 293, be changed from GM
(Growth Management) to PD SDP 88-1 (Planned Development). Said zone change is
designated herein as Rezone 86-5 and is more specifically depicted as Exhibit "A"
attached hereto.

SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.

SPECIFIC DEVELOPMENT PLAN 88-1
THE CAPISTRANO VALLEY TENNIS CLUB AND ACADEMY
A. PURPOSE AND INTENT
To provide a vehicle for the precise regulations of land use for RZ 86-5
designed to facilitate implementation of the General Plan and the development
of the Capistrano Valley Tennis Club and Academy. The intent is to further
regulate site development through the approval of an Architectural Control
permit that is consistent with this SDP 88-1.
B. PRINCIPAL USES AND STRUCTURES PERMITTED
1. Parcel No. 1 - Up to 53 single-family dwelling units ("Z" lot
configuration
2. Parcel No. 2
a. Tennis Club;
b. Tennis Academy; and
C. 22 lighted tennis courts provided that the following operational
standards are satisfied:
i. Night lighting shall only be used on those courts that
are specifically being used;
ii. Night lighting shall not be used after 9 p.m. (October
through March) and after 10 p.m. (April through
September);
iii. All such lights shall be shielded so as to confine all
direct rays to the subject property and minimize spill-
over outside of the tennis court area.
C. ACCESSORY USES AND STRUCTURES PERMITTED
1. Parcel No. 1
a. Pool, spa and cabana;
b. Eight -space recreational vehicle parking lot.
2. Parcel No. 2
a. Pro -shop;
b. Day-care services for children of members and their guests while
using the facilities only;

C. Full service restaurant and lounge that is available to members and
their guests only;
d. Health club facilities that are available to members and their
guests only;
e. Personal services such as a beauty salon provided that the total
amount personal services on the site do not occupy more than 3,600
square feet of gross floor area; and
f. Tournaments subject to the provisions of Section G, Special
Activities, below.
D. SITE DEVELOPMENT PLAN PROCEDURES
Development of the area encompassed by RZ 86-5 shall be per TPM 87-153, as
well as a subsequently -approved Architectural Control, which will further
regulate site design and architecture. Said plans include grading, site design,
landscaping, signs, and building elevations. Prior to approval of the residential
portion (Parcel No. 1), applicant shall prepare, and the Planning Commission
shall approve, an Architectural Control and Tentative Tract Map, which shall
delineate specific site development design, street layout, lot configuration,
building footprints and building designs. In preparing the site plan, applicant
shall incorporate the following design criteria:
1. Variety of architectural and structural features to discourage
large, sterile wall massing.
2. Curvilinear street patterns and/or use of parking bays to add the
effect of meandering streets and parkways.
3. Use of both one- and two-story structures and intermixture of
same. One-story units shall be located adjacent to project entry.
4. Incorporate a variety of unit setbacks, lot configurations and unit
staggering in order to foster a non -repetitive appearance.
5. Building design which incorporates the design features and
architectural styles of the adjacent tennis club.
E. AMENDMENT TO SPECIFIC DEVELOPMENT PLANS
1. The Director of Community Planning and Development may approve
minor modifications to this approved SDP pursuant to the provisions of
Section 9-2.314, Administrative Approvals, of the Municipal Code.
2. The Planning Commission may approve modifications to this approved
SDP if the Commission determines that the modifications are consistent
with the overall purpose and general design of the originally adopted SDP
and that the integrity of the original project concept and plan is
maintained. The amended SDP shall then become the SDP associated
with the PD (Planned Development) District designation on the Official
Zoning Map.

3. If the Planning Commission determines that the proposed modifications
are not consistent with the overall purpose and general design of the
originally approved SDP, a new rezone application will be required. Such
rezone will be reviewed in the same manner as the initial application.
F. SUPPLEMENTAL DISTRICT REGULATIONS
The Supplemental District Regulations of Article 9-3.6 of the San Juan
Capistrano Municipal Code shall apply to this PD (Planned Development)
District. However, specific supplemental district regulations adopted as part
of this SDP shall supersede such Article 9-3.6 of the Municipal Code.
G. SPECIAL ACTIVITIES
1. All tournaments shall require the issuance of a Special Activities Permit
by the Development Services Division subject to the provisions of Section
9-3.623, Special Activities Permit Program, of the San Juan Capistrano
Municipal Code. A Special Activities Permit shall not be issued until a
comprehensive parking and circulation plan is prepared and is acceptable
to the City Engineer and the Land Use Manager.
2. The Capistrano Valley Tennis Club shall be required to host an annual
tournament, subject to the provisions of subsection 1 above, that is open
to the citizens of San Juan Capistrano, whether club members or not.
Said event may be co -hosted with various community organizations.
H. ISSUES NOT ADDRESSED
In cases where a standard, regulation, or other issue is not addressed in this
SDP, the appropriate provision of Title 9 of the San Juan Capistrano Municipal
Code shall regulate.
