ORDINANCE NO. 641
AN URGENCY ORDINANCE OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, EXTENDING URGENCY ORDINANCE
NO. 639 REGARDING THE PROCESSING AND APPROVAL OF
APPLICATIONS FOR DEVELOPMENT APPROVAL SUBJECT TO
MEASURE X (GOVERNMENT CODE SECTION 65858) (URGENCY)
WHEREAS, the City Council adopted Interim Urgency Ordinance No. 639 on
December 6, 1988, for the purpose of implementing Measure X; and,
WHEREAS, Ordinance No. 639 establishes, among other things, a moratorium
period during which time pending and future land use applications shall not be processed;
and,
WHEREAS, the City will need additional time to conduct a planning study to
determine the methodology by which Measure X shall be implemented in relation to
existing City planning and zoning regulations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Extension of Urgency Ordinance No. 639.
Pursuant to Government Code Section 65858, Urgency Ordinance No. 639 is
hereby extended to July 11, 1989.
SECTION 2. Findings.
This extension of Urgency Ordinance No. 639 is enacted to Government Code
Section 65858 and is based upon the finding that this extension is necessary to protect
the public health, safety and welfare in that the voters of the City of San Juan
Capistrano have enacted Measure X which establishes complex planning regulations
affecting proposed private developments within the City. Because of the complexity of
this measure, a planning study will be necessary to determine implementation measures,
including how this measure will be interfaced with existing planning and zoning
regulations of the City. The initial 45 -day period moratorium period established by
Ordinance No. 639 is an inadequate period within which to conduct this study.
Based on the facts contained herein, Council finds that there is a current and
immediate threat to the public health, safety, and welfare, and that the approval of land
use entitlements for use which are required under City's land use regulations would result
in a threat to the public health, safety, and welfare.
SECTION 3. Effective Date.
This ordinance providing for an extension of Ordinance No. 639 shall take
effect and be in force immediately.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
