APPROVING REZONE 88-7 (VERMEULEN/CHRISTIANS FARMER'S MARKET)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED
BY ORDINANCE NO. 293 BY AMENDING SECTION 9-3.423.3 OF
THE MUNICIPAL CODE AND CHANGING THE ZONING OF A
PORTION OF ASSESSOR'S PARCEL NO. 121-182-16 FROM AG
(GENERAL AGRICULTURAL) TO FM (FARM MARKET)
(CHRISTIAN'S FARMER'S MARKET/VERMEULEN)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has reviewed the subject zone
change application, has determined that the project will not have a
significant effect on the environment, and has otherwise carried out all
requirements of the California Environmental Quality Act. The Negative
Declaration prepared for the project has been certified as adequate.
2. The proposed zoning and code amendment is consistent with the land use,
circulation and other designations shown for the property in the General
Plan.
3. The development of the property under the proposed zoning will conform
to the development standards and other applicable provisions of
Ordinance No. 293.
A duly noticed public hearing has been held to receive and consider
public testimony regarding the proposed zone change.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1, preceding, the City Council
ordains that the official zoning heretofore adopted for a portion of
Assessor's Parcel No. 121-182-16 on September 17, 1975, by Ordinance
No. 293, be changed from AG (General Agriculture) to FM (Farm
Market). Said zone change is designated herein as Rezone 88-7, and is
more specifically depicted on Exhibit "A," attached hereto.
2. Based upon the findings set forth in Section 1, preceding, Section
9-3.423.3(eX2), Farm Market (FM) District is hereby amended to read as
follows:
"(2) The maximum development size shall be seven (7) acres. In
approving the increase in area for the Farm Market District from 4
acres to 7 acres, calculations for restricted retail uses as
determined by the Director of Community Planning and
Development, shall be calculated only on that amount of square
footage contained within the ori VI district boundaries, in
accordance with Section 9-3.423.3(cX4) "

SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
