Ordinance Number 621165 ORDINANCE NO. 621 TO TITLE 4 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PRIMA FACIE SPEED LIMITS ON LA NOVIA AVENUE AND HIGHLAND DRIVE BY AMENDING SECTION 4-6.501, ARTICLE 5, TITLE 4 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE WHEREAS, California Vehicle Code Sections 22357, 22358 and 22358.3 provide that local entities may declare prima facie speed limits of 15 miles per hour and greater on City streets on the basis of an engineering and traffic survey; and, WHEREAS, California Vehicle Code Section 627 defines an engineering and traffic survey to include a consideration of all of the following: 1) Prevailing speeds as determined by traffic engineering measurements; 2) Accident records; 3) Highway, traffic, and roadside conditions not readily apparent to the driver; and, WHEREAS, the City of San Juan Capistrano has completed an engineering and traffic survey pursuant to California Vehicle Code Sections 22357, 22358 and 22358.3. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, does hereby ordain as follows: SECTION 1. City of San Juan Capistrano 1 The City Council of the City of San Juan Capistrano finds and declares that the 1987 Engineering and Traffic Survey for La Novia Avenue and Highland Drive has been completed in full compliance with the requirements of the California Vehicle Code. The Survey consists of the Report dated October, 1987, entitled "City of San Juan Capistrano Speed Limit Analysis for La Novia Avenue and Highland Drive" prepared for the Department of Public Works, City of San Juan Capistrano, which is on file in the City Clerk's Department. SECTION 2. Establishment of Prima Facie Speed Limits. Based on the City of San Juan Capistrano 1987 Engineering and Traffic Survey for La Novia Avenue and Highland Drive, Article 5, entitled "Speed Limits," Section 4- 6.501 of the San Juan Capistrano Municipal Code is hereby amended to read as follows: -I- 166 "Article 5. Speed Limits "Section 4-6.501. Established. "Pursuant to the provisions of Sections 22357, 22358, and 22358.3 of the California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are hereby determined and declared as follows: "(a) Fifteen miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifteen (15) miles per hour: "(1) Los Rios Street from Verdugo Street to Mission Street. "(b) Twenty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty (20) miles per hour: "(1) Los Rios Street from Del Obispo Street to Verdugo Street. "(c) Twenty -Five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty-five (25) miles per hour: "(1) Calle Arroyo from La Novia Avenue to Avenida Siega; 11(2) Camino Capistrano from Del Obispo Street to Ortega Highway; 11(3) Via de Agua from Camino Las Ramblas to Calle Delgado; "(4) Avenida de la Vista from southerly end to Oso Road; 11(5) El Camino Real from Forster Street to La Zanja Street; and, 11(6) Ortega Highway from I-5 to Camino Capistrano. "(d) Thirty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty (30) miles per hour: "(1) Avenida Aeropuerto from Camino Capistrano to San Juan Creek; 11(2) Calle Aspero from Del Obispo Street to Peppertree Bend; and, 11(3) Village Road from Rancho Viejo Road to Trabuco Creek Road. "(e) Thirty -Five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty-five (35) miles per hour: "(l) Calle Arroyo from Rancho Viejo Road to La Novia Avenue; 11(2) Camino Capistrano from San Juan Creek Road to Del Obispo Street; 11(3) Camino Capistrano from Ortega Highway to La Zanja Street; -2- .16'7 11(4) Del Obispo Street from Calle Aspero to Ortega Highway; 11(5) Highland Drive from Rancho Viejo Road to Hillside Terrace; 11(6) La Novia Avenue from Ortega Highway to 1000 feet southeast of Paseo Azalea; I'M Camino La Ronda from La Novia Avenue to Paseo Establo; "(8) Rancho Viejo Road from Calle Arroyo to Ortega Highway; "(9) San Juan Creek Road from La Novia Avenue to Avenida La Mancha; and "(10) Trabuco Creek Road from Rancho Viejo Road to Village Road. "(f) Forty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty (40) miles per hour: "(1) Alipaz Street from Camino del Avion to Del Obispo Street; 11(2) Camino Capistrano from La Zanja Street to Junipero Serra Road; 11(3) Camino del Avion from Del Obispo Street to Alipaz Street; 11(4) Del Obispo Street from Camino Del Avion to Calle Aspero; "(5) Camino Las Ramblas from the southerly City Limits (I-5) to Kinkerry Lane; and, "(6) Rancho Viejo Road from Junipero Serra Road to the northerly City limits. "(g) Forty -Five Miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty-five (45) miles per hour: "(1) Camino Capistrano from the southerly City limits to San Juan Creek Road; "(2) Camino Capistrano from Junipero Serra Road to the northerly City limits; "(3) Del Obispo Street from the southerly City limits to Camino del Avion; "(4) Rancho Viejo Road from Ortega Highway to Junipero Serra Road; and, "(5) San Juan Creek Road from Camino Capistrano to La Novia Avenue." -3- 168 SECTION 3. Legislative Findings in Support of Prima Facie Speed Limits. The City Council hereby makes the following findings pursuant to California Vehicle Code Section 627(b)(3) in support of the prima facie speed limits set forth below: HIGHLAND DRIVE (35 MILES PER HOUR) Rancho Viejo Road to Hillside Terrace --- There are several sharp horizontal, reversing curves at various locations along the roadway; --- There is an extremely steep grade over a substantial stretch of the roadway which promotes higher vehicular speeds; --- There is a designated Master Plan Equestrian Crossing of the street at an uncontrolled location; --- Concrete curb, gutter and sidewalks do not exist along a majority of the roadway; --- Bicyclists ride on the street; --- Numerous houses are located in the vicinity of the roadway; and --- Visibility at street intersections could be somewhat limited due to the presence of horizontal curves. (See Table 3 of the 1987 Engineering and Traffic Survey for La Novia Avenue and Highland Drive) THE LEGISLATIVE FINDINGS IN SUPPORT OF PRIMA FACIE SPEED LIMITS previously set forth by the City Council in Ordinance No. 520, adopted on October 16, 1984, and in Ordinance No. 588, adopted on December 16, 1987, shall continue to remain in effect. passage. SECTION 4. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 5. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published, the aforementioned -4- 169 summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
