AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ESTABLISHING PRIMA FACIE SPEED LIMIT ON LA
NOVIA AVENUE FROM VALLE ROAD TO 1,000 FEET SOUTHWEST
OF PASEO AZALEA; SAN JUAN CREEK ROAD FROM AVENIDA LA
MANCHA TO THE EASTERLY CITY LIMITS AND STONEHILL
DRIVE FROM THE WESTERLY CITY LIMITS TO CAMINO
CAPISTRANO, BY AMENDING SECTION 4-6.501 OF THE
MUNICIPAL CODE
WHEREAS, California Vehicle Code Section 22357 allows local entitles to
increase prima facie speeds of 25 mph (as defined by the California Vehicle Code as
residential or business districts) to between 30 mph and 50 mph, Section 22358 allows
local authorities to decrease prima facie speeds of 55 mph (for all roads not defined by
the California Vehicle Code as residential or business districts) to between 50 mph and 30
mph; and section 22358.3 allows local entitles to decrease prima facie speeds of 25 mph
(as defined by the California Vehicle Code as residential or business districts) because of
its narrowness to 20 mph or 15 mph; and,
WHEREAS, California Vehicle Code Section 627 defines an engineering and
traffic survey to include a consideration of all of the following:
(l) Prevailing speeds as determined by traffic engineering measurements;
(2) Accident records;
(3) Highway, traffic, and roadside conditions not readily apparent to the
driver; and,
WHEREAS, the City of San Juan Capistrano has completed an engineering and
traffic survey pursuant to California Vehicle Code Sections 22357, 22358 and 22358.3.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Establishment of Prima Facie Speed Limits.
The San Juan Capistrano Municipal Code is hereby amended to read as follows:
"Article 5 Speed Limits
"Section 4-6.501. Established.
"Pursuant to the provisions of Sections 22357, 22358, and 22358.3 of the
California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are
hereby determined and declared as follows-

"(a) Fifteen miles per hour. The prima facie speed limits on the following
streets, or portions of streets, shall be fifteen (15) miles per hour:
11(1) Los Rios Street from Verdugo Street to Mission Street.
"(b) Twenty miles per hour. The prima facie speed limits on the following
streets, or portions of streets, shall be twenty (20) miles per hour:
11(1) Los Rios Street from Del Obispo Street to Verdugo Street.
"(c) Twenty -Five miles per hour. The prima facie speed limits on the
following streets, or portions of streets, shall be twenty-five (25) miles
per hour:
"(1) Calle Arroyo from La Novia Avenue to Avenida Siega;
"(2) Camino Capistrano from Del Obispo Street to Ortega Highway;
"(3) Via de Agua from Camino Las Ramblas to Calle Delgado;
"(4) Avenida de la Vista from southerly end to Oso Road;
"(5) El Camino Real from Forster Street to La Zanja Street; and,
"(6) Ortega Highway from 1-5 to Camino Capistrano. Note: Ortega
Highway (from 1-5 to the easterly City limits) speed limit surveys
are provided, as needed, to the State for their consideration in
determining the speed limits they set on this State highway.
"(d) Thirty miles per hour. The prima facie speed limits on the following
streets or portions of streets, shall be thirty (30) miles per hour:
11(1) Avenida Aeropuerto from Camino Capistrano to its westerly end;
"(2) Calle Aspero from Del Obispo Street to Peppertree Bend; and,
11(3) Village Road from Rancho Viejo Road to Trabuco Creek Road.
"(e) Thirty -Five miles per hour. The prima facie speed limits on the
following streets, or portions of streets, shall be thirty-five (35) miles
per hour:
11(1) Calle Arroyo from Rancho Viejo Road to La Novia Avenue;
"(2) Camino Capistrano from San Juan Creek Road to Del Obispo
Street;
"(3) Camino Capistrano from Ortega Highway to La Zanja Street;
"(4) Del Obispo Street from Calle Aspero to Ortega Highway;
"(5) Highland Drive from Rancho Viejo Road to Hillside Terrace;

"(6) La Novia Avenue from Ortega Highway to Valle Road;
"(7) Camino La Ronda from La Novia Avenue to Paseo Establo;
"(8) Rancho Viejo Road from Calle Arroyo to Ortega Highway;
11(9) San Juan Creek Road from La Novia Avenue to its easterly
terminus; and,
"(10) Trabuco Creek Road from Rancho Viejo Road to Village Road.
Forty miles per hour. The prima facie speed limits on the following
streets, or portions of streets, shall be forty (40) miles per hour:
"(1) Alipaz Street from Camino del Avion to Del Obispo Street;
"(2) Camino Capistrano from La Zanja Street to Junipero Serra Road;
"(3) Camino del Avion from the westerly City limits to Alipaz Street;
11(4) Del Obispo Street from Camino del Avion to Calle Aspero;
11(5) Camino Las Ramblas from the southerly City Limits (1-5) to
Kinkerry Lane;
"(6) Junipero Serra from Camino Capistrano to Rancho Viejo Road;
and,
"(7) Rancho Viejo Road from Junipero Serra Road to the northerly
City limits.
Forty -Five miles per hour. The prima facie speed limits on the
following streets, or portions of streets, shall be forty-five (45) miles
per hour:
"(i) Camino Capistrano from the southerly City limits to San Juan
Creek Road; and, Camino Capistrano from Junipero Serra Road
to the northerly City limits;
"(2) Del Obispo Street from the southerly City limits to Camino del
Avion;
"(3) Rancho Viejo Road from Ortega Highway to Junipero Serra Road;
and,
10(4) San Juan Creek Road from Camino Capistrano to La Novia
Avenue."
"(5) Stonehill Drive from the westerly City limits to Camino
Capistrano."

SECTION 2. Legislative Findings in Support of
Prima Facie Speed Limits.
The Legislative findings in support of prima facie speed limits previously set
forth by the City Council in Ordinance No. 520, adopted on October 16, 1984, in
Ordinance No. 588, adopted on December 16, 1987, Ordinance No. 621, adopted on
January 19, 1988, Ordinance No. 659, adopted on February 20, 1990, and Ordinance No.
661, adopted on April 3, 1990, and Ordinance No. 680 adopted on December 11, 1990,
shall continue to remain in effect.

SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption as required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
