ORDINANCE NO. 711
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE FORSTER CANYON
COMPREHENSIVE DEVELOPMENT PLAN - REZONE 91-1 (SAN
JUAN MEADOWS/SAN JUAN CREEK ASSOCIATES)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has reviewed the subject
amendment application, has determined that the project will have a significant effect on
the environment, has required the preparation of an Environmental Impact Report, and
has otherwise carried out all requirements of the the California Environmental Quality
Act.
2. The proposed amendment is consistent with the land use, circulation and
other designations shown for the property in the General Plan. The proposed amendment
to the Forster Canyon Planned Community is otherwise consistent with the goals and
policies of the General Plan.
3. The development of the property under the proposed amendment will
conform to the development standards and other applicable provisions of Ordinance No.
418.
4. A duly -noticed public hearing has been held to receive and consider
public testimony regarding the proposed amendment.
5. The Draft Environmental Impact Report, which incorporates responses to
comments, adequately discloses the environmental impact of the project and identified
appropriate mitigation measures.
b. The Final Environmental Impact Report has been prepared in
conformance with the California Environmental Quality Act and the City Council
certified the Final Environmental Impact Report on July 21, 1992.
7. All impacts will be mitigated to a level of insignificance in the form of
plan changes or conditions of approval.
8. The Environmental Impact Report includes all correspondence, public
testimony and staff reports.

SECTION 2. Amendment.
Based on the findings set forth in Section 1, preceding, the City Council
ordains that Ordinance No. 418, heretofore adopted for the Forster Canyon Planned
Community on March 3, 1981, and subsequently amended by Ordinance No. 446, 458, and
696, be amended, including the following standards and requirements, which shall be
made a part of the Comprehensive Development Plan:
a. The Mesa Residential Development Standards shall be modified as
follows:
1. Require front setbacks to be 30 feet measured from the curb.
2. Those lots which have a lot size between 5,000 - 6,000 square feet
shall be located adjacent to the golf course.
b. The Senior Housing District Development Standards shall be modified as
follows:
1. The maximum density for the senior housing units shall be 25 units
per acre, but not to exceed 180 units, however the 180 units should not be
considered a target or guarantee of the number of units to be allowed. The
actual number will be determined upon a finding of compliance with all
development standards by the Planning Commission.
2. The building height standard shall preclude a three-story design and
shall include ..."the character of the project by using combination one- and
two-story elements shall be to create a residential appearance".
C. Modify standards for public and private streets to conform to City
standards as follows:
1. The applicant shall design and construct all other streets with
pavement being a minimum of 36 feet (curb -to -curb) and having a 10 -foot
parkway and 5 -foot sidewalk, located 5 feet from the curb on each side of the
street; have a 25 -mph minimum design speed with sight distance for 35 mph at
all intersections. (Parkways, which shall be a minimum of 10 feet in width,
shall include all public or private landscaped areas and walkways adjacent to
the roadway which serve as an adjunct to the street right-of-way for utilities,
street landscaping and pedestrian circulation.) Roadways within the townhouse
development (units 5 and 6) which connect the local streets with the dwelling
units may be designed as 26 -foot -wide access drives provided that (1)the units
are clustered into access courts, (2) visitor parking is provided as required by
code at a ratio of .5 spaces per unit and evenly distributed throughout the
development, and (3) the principal access to the units is oriented to a greenbelt
rather than to the access drives.
d. The Comprehensive Development Plan text relating to grading plan
processing and approvals shall be modified to require grading concepts to be reviewed
and approved by the Planning Commission prior to the approval of a final map.

e. Offsite infrastructure and traffic improvements in the Comprehensive
Development Plan shall be amended to include the following:
1. Prior to issuance of the one-hundredth occupancy permit for the
most easterly portion of units 2 and 3 of Vesting Tract Map 14343, the
applicant shall construct "C" Street (to allow for dual access to the project)
and the improvements on Valle Road from "C" Street to the 1-5 ramps.
f. The Comprehensive Development Plan shall incorporate design standards
for the Village Residential (VRM) District as follows:
1. Dwelling unit floor plans shall be oriented such that the front door
faces the opposite side of the units from the garage entry.
2. The buildings shall be organized into clusters with vehicular access
courts and garage entries on one side and the front door and greenbelt on the
other. Such clusters are shown on J, K and L Streets except for the front door
and greenbelt orientation.
3. The entry street shall be 36 -feet -wide in order to provide a 10 -
foot -wide landscape easement that serves as a parkway.
4. Visitor parking areas shall be distributed throughout the project,
and situated to encourage their use.
5. Spacious greenbelts with walkways shall be provided throughout the
project, averaging 25 feet in width, and a minimum of 15 feet in width.
6. Long dead-end access drives shall be discouraged, and shall be
configured as a clustered vehicular access court (or designed to serve as
through circulation residential streets).
g. In conjunction with Planning Commission review and approval of the
grading plan (mass grading), the proposed grading and development of the Senior Housing
site and lots 23 through 37 of Unit 2 shall be subject to a View Analysis. Said view
analysis shall consider mitigation of view impacts from the Historic Downtown Area and
shall include a photo simulation using digitized photo technology or comparable
techniques approved by the Planning Director. Said view analysis shall be used to
determine grading concepts as well as the height, location, and building mass of the
structures.
h. Senior day care facilities shall be allowed as a use in either the Senior
Housing area, or the Public Institutional site as a conditional use.
i. Single family detached and townhouse development shall be required to
comply with the provisions of the Housing Opportunities Program of the Comprehensive
Development Plan.
j. The MR District development standards shall include a requirement to
satisfy the provisions of Municipal Code Section 9-3.424(bx7) (Open Space Subdivision).

k. Section VI(6)(aXI) shall be modified to read ..."Construction equipment
and traffic shall use the Valle Road/La Novia Avenue intersection to ingress/egress the
project site.
Said amendment is specifically identified as "Exhibit All entitled "Proposed
Amendment to the Forster Canyon Comprehensive Development Plan," on file in the
office of the City Clerk, and is designated as Comprehensive Development Plan 81-1
(Rezone 91-1) on the Official Zoning Map as shown on Exhibit 1 attached hereto.

SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
