APPROVING REZONE 90-6 (ADVANCED HEALTH
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, APPROVING REZONE 90-6 TO ESTABLISH SPORTS
MEDICAL CLINICS AS A CONDITIONAL USE IN THE ORTEGA
PLANNED COMMUNITY, COMPREHENSIVE DEVELOPMENT PLAN
78-1, PLANNING SECTOR B-1 (ADVANCED HEALTH SPORT MED
CENTER/SCHRECENGOST)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The proposed rezone adding a sport medical clinic as a conditionally
permitted use in Sector B-1 is consistent with all elements of the General Plan, including
the 4.0 Industrial Park land use designation, in that said use will be operated in
conjunction with a health club facility, which uses have the potential to serve employees
of the adjacent business park, and are compatible with the range of other uses allows.
2. The conditional use will conform to the applicable development standards
of the Municipal Code and Ortega Planned Community Comprehensive Development Plan
78-1, in that said use will occupy an existing structure which has previously been
reviewed and approved by the City and no exterior modifications to said structure are
proposed.
3. A public hearing describing the purpose of the zone change and the time,
date and location of the hearing was published in the Capistrano Valley News. Property
owners within 300 feet of the project boundary were sent notice of the project pursuant
to requirements of law.
4. Prior to action on this zone change, the City Council approved a negative
declaration for the project, confirming the Environmental Review Board's determination
that the project will not have a significant impact on the environment and that therefore
an environmental impact report is not required. All requirements of the California
Environmental Quality Act have been met.
SECTION 2. Zone Change.
Based on the finding set forth in Section 1, preceding, the City Council ordains
that the official zoning heretofore adopted be changed to add sports medical clinics as a
conditional use to the Ortega Planned Community, Comprehensive Development Plan 78-
1, Planning Sector B-1. The recommended zone change is designated herein as Rezone
90-6, and is more specifically depicted as "Exhibit A," attached hereto.

SECTION 3.
Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.

d. Firms engaged in sales or services, such as office supplies, office equipment and
furnishings serving commercial and industrial clients.
e. Insurance firms where the primary focus is on the processing of applications and claims

3. Accessory Uses
a. Small-scale commercial services appropriate to the support of permitted office uses
identified above. Such use shall be integrated into a multi -use building and is not
permitted in a separate free-standing buildings.
4. Conditional Uses Permitted - The following additional uses may be permitted subject to the
approval of a conditional use permit:
a. Small-scale restaurants designed to serve the needs of employees within Planning Sectors
B and B-1 of the Ortega Planned Community.
b. Small-scale commercial bank and savings institutions which do not occupy more than 10
percent of the total floor area for the building in which it is located.

d. Sports medical clinics when operated In conjunction with an adjacent health club

e. Any other use not listed, but which is determined by the Planning Commission to be
consistent with the General Plan and meeting the intent and purpose of the district shall
be reviewed as a conditional use permit.
5. Development Standards - All uses shall conform to the development standards specified for
Planning Area A (Section VI.B.4) except that no lot shall be created less than one (1) acre in net
area and Section VI.B.4a. and Section VI.B.4.g. - Architectural Design Concepts. In preparing
development plans, the following design theme shall' be adhered to:
