AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING CHAPTERS 1 AND 2 OF TITLE 8,
"BUILDING REGULATIONS," OF THE MUNICIPAL CODE
RELATING TO THE ADOPTION OF THE UNIFORM
ADMINISTRATIVE CODE, ADOPTION AND/OR AMENDMENT OF
FEES, AND THE ADOPTION OF THE UNIFORM BUILDING CODE
WHEREAS, THERE ARE A NUMBER OF SERVICES PROVIDED BY THE CITY
IN PROCESSING APPLICATIONS FOR BUILDING AND SAFETY DIVISION PERMITS
THAT ARE OF PRIMARY BENEFIT TO THE APPLICANT; AND
WHEREAS, THE COST OF THESE SERVICES SHOULD BE BORNE
PRIMARILY BY THE APPLICANT RECEIVING BENEFIT FROM SUCH SERVICES AND
SO AS TO INSURE TIMELY AND EFFECTIVE PROCESSING OF APPLICATIONS.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Adoptions/Amendments.
Title 8 "Building Regulations," Chapter 1 and 2, of the Municipal Code is
hereby amended to read as follows:
TITLE 8.
"BUILDING REGULATIONS"
CHAPTER 1.
BUILDING ADMINISTRATION CODE
Section 8-1.01. Adoption of Uniform Administrative Code.
"For the purpose of providing minimum standards to safeguard life or limb,
health, property and public welfare by regulating and controlling the use and occupancy,
location and maintenance of all buildings and structures within this jurisdiction, that
code known as the Uniform Administrative Code, 1988 Edition, published by the
International Conference of Building Officials, three (3) copies of which are on file in the
City Clerk's Department for public record and inspection is hereby adopted by reference
and made a part of this chapter as though set forth in this chapter in full, subject,
however, to the amendments set forth in this chapter, and said code shall be known as
the Building Administration Code of the City."
Section 8-1.02. Underground Utilities.
Subsection 104(h) entitled "Underground Utilities" is hereby added to Chapter 1
of the Uniform Administrative Code.
Sec. 104(h) Underground Utilities Required. The Building Official, as a
condition precedent to the issuance of a building permit, shall require all utility services
located within any lot or parcel or property to be installed underground if:
(a) The property is to be developed with a new or relocated main
building;
(b) The remodeling, alteration, or addition to an existing main building
is subject to the requirements of subsection (b) of Section 104 of this Code; or
(c) A residential building or use is converted to any nonresidential use
or purpose.
For the purposed of this section, "main building" shall mean a building in which
is conducted the principal use of the lot or building site on which such building is located.
The owner or developer of the property shall be responsible for complying with
the requirements of this section and shall provide all the necessary facilities on the
property to receive such services from the supplying utilities.
If the Building Official determines that practical difficulties or unreasonable
hardships inconsistent with the purposes of this chapter and unique to a particular parcel
of property would result from the literal interpretation of this section, the Building
Official may waive, modify, or delay the imposition of any undergrounding requirement
imposed pursuant to this section upon a written application by any affected property
owner. The Building Official shall notify the applicant of his decision in writing by
certified mail. If the Building Official determines to delay the installation of required
underground utilities, he may require a recorded agreement guaranteeing the future
performance of the work, together with adequate performance security enforceable by
the City in the form of a cash deposit, bond, letter of credit, or other instrument
satisfactory to the City Attorney.
For the purposes of this section, appurtenances and associated equipment, such
as, but not limited to, surface -mounted transformers, pedestal -mounted terminal boxes
and meter cabinets, and concealed ducts in an underground system, may be placed above
ground.
Any person dissatisfied with the decision of the Building Official may file an
appeal with the City Council within fifteen (15) calendar days after the decision of the
Building Official is deposited in the mail by filing a written statement with the City
Clerk setting forth the reasons for such appeal. The City Council may overrule, modify,
or affirm the decision of the Building Official.
Section 8-1.03. Hours of Operation.
Sec. 206 entitled "Hours of Operation" is hereby added to Chapter 2 of the
Uniform Administrative Code.
Section 206. - Hours of Operation. Construction activity which includes the
delivery and/or recovery of materials, supplies or construction equipment shall be
conducted in accordance with the prescribed hours of operation. If the activity or
building operation is situated within one-half mile of a structure designed for human
occupancy, the hours of operation are as follows:
"Monday through Friday 7:00 a.m. to 6:00 p.m."
"Saturday 8:30 a.m. to 4:30 p.m."

The Building Official is granted authorization to make the Hours of Operation
more or less restrictive. The Building Official shall determine whether the construction
activity and the events incidental to it are detrimental to the health, safety or welfare
of the inhabitants located within one-half mile of the building site.
Construction activity is prohibited on Sundays and on any federal holiday
unless waived by the Building Official
Section 8-1.04 Exempted Building Permit Requirements.
Subsection 301.(b), Permits, of the Uniform Administrative Code, is hereby
amended as follows:
Sec. 301.(b) Exempted Work. A permit shall not be required for the types of
work in each of the separate classes of permit as listed below. Exemption from the
permit requirements of this code shall not be deemed to grant authorization for any work
to be done in violation of the provisions of the technical codes or any other laws or
ordinances of this jurisdiction.
I . Building permits. A building permit shall not be required for the
following:
A. One-story detached accessory buildings of Group R, Division 3 and
Group M occupancies used as tool and storage sheds, playhouses and
similar uses, provided the projected roof area does not exceed 120
square feet.
B. Fences not over 3 feet high.
C. Oil derricks.
D. Movable cases, counters and partitions not over 5 feet 9 inches
high.
E. Retaining walls which are not over 4 feet in height measured from
the bottom of the footing to the top of the walls, unless supporting
a surcharge or impounding flammable liquids.
F. Water tanks supported directly upon grade if the capacity does not
exceed 5000 gallons and the ration of height to diameter or width
does not exceed two to one.
G. Painting, papering and similar finish work.
H. Temporary motion picture, television and theater stage sets and
scenery.
1. Window awnings supported by an exterior wall of Group R, Division
3, and Group M Occupancies when projecting not more than 54
inches.
I Prefabricated swimming pools accessory to a Group R, Division 3
Occupancy in which the pool walls are entirely above the adjacent
grade and if the capacity does not exceed 5000 gallons.
Unless otherwise exempted by this code, separate plumbing, electrical
and mechanical permits will be required for the above exempted items.
Section 8-1.05. Valuation Determination.
Subsection 304.(b), Fees, of the Uniform Administrative Code, is hereby
amended as follows:
Sec. 304.(b) Permit Fees. The fee for each permit shall be as set forth in
Tables Nos. 3-A through 3-H. Where a technical code has been adopted by the

jurisdiction for which no fee schedule is shown in this code, the fee required shall be in
accordance with the schedule established by the legislative body.
The determination of value or valuation under any of the provisions of these
codes shall be made by the Building Official. The value to be used in computing the
building permit and building plan review fees shall be the total value of all construction
work for which the permit is issued as well as all finish work, painting, roofing,
electrical, plumbing, heating, air-conditioning, elevators, fire -extinguishing systems and
any other permanent equipment.
Section 423 of the Uniform Building Code adopted by Chapter 2 of this title
defines the value or valuation to be placed on new construction as equivalent to the
estimated cost to replace the building in kind. In the performance of said Section 423,
the City adopts the Building Valuation Data, published by the International Conference of
Building Officials, for unit costs per square foot. Such values shall be used to establish
fees and/or costs based on the value of the work to be performed. The Building Official
shall designate the valuation data to be used and the effective date of any change
thereto.
Values for unit costs for construe:. not specifically set forth in the Building
Valuation Data Report shall be adjusted sem:-annually by the Building Official to reflect
the current prevailing cost in the local region. Fees not based upon valuation may be
adjusted periodically at a rate deemed appropriate by the Building Official to reflect the
cost associated with providing services.
Any amendments shall be reviewed by the Director of Engineering and Building
Services for formal recommendation to the City Manager's office. - itr amendment may
be executed administratively with the City Manager's approval.
Section 8-1.06. Permit Fees.
Table 3-A is hereby amended in its entirety to read as set forth in Exhibit A,
Table No. 3-A Building Permit Fee Schedule, attached hereto.
Table 3-B is hereby amended in its entirety to read as set forth in Exhibit B,
Table No. 3-B Electrical Permit Fee Schedule, attached hereto.
Table 3-C is hereby amended in its entirety to read as set forth in Exhibit C,
Table No. 3-C Mechanical Permit Fee Schedule, attached hereto.
Table 3-D is hereby amended in its entirely to read as set forth in Exhibit D,
Table No. 3-D Plumbing Permit Fee Schedule, attached hereto.
Table 3-E is hereby amended in its entirety to read as set forth in Exhibit E,
Table No. 3-E Swimming Pool, Spa and Hot Tub Permit Fee Schedule, attached hereto.
Table 3-F is hereby amended in its entirety to read as set forth in Exhibit F,
Table No. 3-F Mobilehome/Accessory, Structure Permit Fee Schedule, attached hereto.
Table 3-G is hereby amended in its entirety to read as set forth in Exhibit G,
Table No. 3-G, Grading Permit Fee Schedule, attached hereto.

Section 8-1.07. Plan Review Fees.
Subsection 304.(c), Fees of the Uniform Administrative Code, is hereby
amended as follows:
Sec. 304.(6 Plan Review Fees. When a plan or other data are required to be
submitted by Subsection (c) of Section 302, a plan review fee shall be paid at the time of
submitting plans and specifications for review. Said plan review fee for buildings or
structures shall be as set forth in Table 3-A.
The plan review fee for electrical work shall be as set forth in Table 3-B.
The plan review fee for mechanical work shall be as set forth in Table 3-C.
The plan review fee for plumbing work shall be as set forth in Table 3-D.
The plan review fee for construction/installation of swimming pools, spas or
hot tubs shall be as set forth in Table 3-E.
The plan review fee for construction/installation of mob ilehomes/accessory
structures shall be as set forth in Table 3-F.
The plan review fee for grading work shall be as set forth in Table 3-G.
The plan review fee for on-site improvement work shall be as set forth in
Table 3-H.
The plan review fees specified in this subsection are separate fees from the
permit fees specified in Section 304(a) and are in addition to the permit fees.
Where plans are incomplete or changed so as to require additional plan review,
an additional plan review fee shall be charged at the rate shown in Tables Nos. 3-A
through 3-H.
When plans are incomplete or changed so as to require additional plan review,
an additional Plan Review Fee shall be paid to the Administrative Authority based upon
the value of construction of the proposed change/redesign or the total hourly cost to the
jurisdiction, whichever is the greatest. This cost shall include supervision, overhead,
equipment, hourly wages, and fringe benefits of the individuals involved. In establishing
said fee, no allowance for a decreased fee shall be permitted due to the replacement,
omission or deletion of any member or portion of the building shown in the original
plans. (Said fee may be waived when, in the opinion of the Building Official, the
additional fee is not warranted.)
Each applicant shall be entitled to one plan check correction/clarification
list. If the applicant fails to address all comments and/or questions generated on the
first plan check list and subsequently, a second plan check correction list is generated
denoting the same comment item, the applicant may be subject to additional plan review
fees when in the opinion of the plans examiner of record, the resubmittal was
misrepresented as being completely revised and ready for recheck.
An Accelerated Plan Review is a service available to applicants upon request.
The individual(s) requesting this service shall agree to pay twice the normal plan review

fee. This service is available on a first come, first serve basis providing there is
staff/resources available to perform the work. Projects are taken out of normal plan
review rotation and must be worked on after normal operating hours (overtime).
An Extraordinary Plan Review is a service available to applicants upon
approval by the Building Official. This service is available to those individual(s) that
wish to formally submit their construction documents for plan review prior to
successfully completing the Development Review Process through the Land -Use
Division. The applicant requesting this service shall agree to sign a Land -Use Deferral
Agreement form and pay three times the normal plan review fee. This service is
available on a first come, first serve basis providing there is staff/resources available to
perform the work. Projects are taken out of normal plan review rotation and must be
worked on after normal operating hours (overtime).
Section 8-1.08. Investigation Fees.
Subsection 304.0, Fees, of the Uniform Administrative Code, is hereby
amended as follows:
Sec. 304.(e) Investigation Fees: Work Without a Permit.
1. Investigation. Whenever any work for which a permit is required by this
code has been commenced without first obtaining said permit, a special investigation
shall be made before a permit may be issued for such work.
2. Fee. An investigation Fee, in addition to the permit fee, shall be collected
whether or not a permit is then or subsequently issued. The investigation fee shall be
equal to two (2) times the amount of the permit fee as set forth in Tables Nos. 3-A
through 3-H. The payment of such investigation fee shall not exempt any person from
compliance with all other provisions of either this code or the technical codes nor from
any penalty prescribed by law.
Section 8-1.09. Administrative Fees
Subsection 304(8) entitled "Administrative Fees" is hereby added to Chapter 3
of the Uniform Administrative Code.
Sec. 304.(g) Administrative Fees. An administrative fee shall be collected for
tasks that are procedurally in addition to those assignments normally incidental to plan
review and permit issuance. The administrative fee shall be as set forth in Table 3-I.

CHAPTER 2.
BUILDING CODE
Section 8-2.01. Adoption of Uniform Building Code
For the purpose of prescribing regulations for the erection, construction,
enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy,
equipment, use, height, area, and maintenance of all buildings or structures in the City of
San Juan Capistrano, those documents, three copies of which are on file in the office of
the City Clerk, being marked and designated as:
Uniform Building Code, 1988 Edition, published by the ICBO, including
the generic fire -resistive assemblies listed in the Fire Resistance Design
GS
Manual, 1984 Edition, published by the Gypsum Association as referenced
in Tables Nos. 43-A, 43-B, and 43-C, of said Uniform Building Code,
11 (Agricultural Buildings), 32 (Re -roofing), 49 (Patio Covers),
57 (Regulations Governing Fallout Shelters), and,
2. Uniform Building Code Standards, 1988 Edition, published by ICBO,
including (i) Structural Welding Code - Reinforcing Steel, WAS D1.4-79
(U.B.C. Standard No. 26-8); (ii) Structural Welding Code - Steel,
ANSI/AWS D1.1-84 (U.B.C. Standard No. 27-6); (iii) Structural Welding
Code - Sheet Steel, ANSI/AWS D1.3-81 (U.B.C. Standard 27-16) published
by the American Welding Society, Inc.; and (iv) Standard for the
Installation of Sprinkler Systems, NFPA 13-1980, published by the
National Fire Protection Association (U.B.C. Standard 38-1), as modified
or amended in the Uniform Building Code Standards referenced herein,
are hereby adopted by reference and made a part of this chapter as though set forth in
this chapter in full, subject, however to the amendments set forth in this chapter, and
said code shall be known as the building code of the City.
Section 8-2.02. Administration.
Part I (Administrative) of the 1988 Edition of the Uniform Building Code is
hereby deleted in its entirety.
Section 8-2.03. Fire Resistive Substitution
Section 508 of the 1988 Edition of the Uniform Building Code is amended to
read as follows:
Sec. 508. Where one-hour fire -resistive construction throughout is required by
this code, an approved automatic sprinkler system, as specified in Chapter 38, may be
substituted, provided such system is not otherwise required throughout the building.
EXCEPTIONS:
1. An approved automatic sprinkler system required by Section
3802(b)(5) may be substituted.
2. Such substitution shall not waive nor reduce required fire resistive
construction for:
a. Occupancy separations (Section 503(c)).
b. Exterior wall protection due to proximity of property
lines (Section 54(b)).
C. Area separations (Section 504(e)).
d. Shaft enclosures (Section 1706).
e. Corridors (Section 3305(8) and (h)).
f. Stair enclosures (Section 3309).
g. Exit passageways (Section 3312(a)).
h. Type of construction separation (Section 1701).
i. Atriums constructed in accordance with Section 1715.
Section 8-2.04 Fire Extinguishing Systems
Item 5 is added to Section 3802(b), Automatic Fire Extinguishing Systems,
Uniform Building Code, to read as follows:

0,72 5. In all new buildings (or groups of buildings separated by yards of
less than 5 feet in the least dimension), over 2 stories in height or in which the
sum of the area of all floors is greater than 6,000 square feet.
Section 8-2.05
Roof Coverings
Paragraph 3 is hereby added to Section 3203 to read as follows:
Sec. 3203. The roof covering on any structure regulated by this code shall be
as specified in Table No. 32-A and as classified in Section 3204.
The roof -covering assembly includes the roofdeck, underlayment,
interlayment, insulation and covering which is assigned a roof -covering classification.
Roof coverings shall be Class B minimum, except that when re -roofing the following
criteria shall apply:
a. Minor repairs and/or re -roofing not exceeding ten (10%) percent of
the total roof area, with the prior approval of the Building Official, and
notwithstanding other provisions of this Code, may be made using like
materials on the remainder of the roof.
b. When re -roofing exceeds ten (10%) percent but is less than fifty
(50%) percent of the total roof area, the re -roofed portion shall comply with
the provisions of this Code.
When re -roofing exceeds fifty (50%) percent of the total roof area,
the entire roof shall be upgraded to comply with the provisions of this Code.
Section 8-2.06. Excavation and Grading.
Chapter 70 of the Appendix of the Uniform Building Code is hereby amended
to read as follows:
Permits Required.
Section 7003 shall read as follows:
Section 7003. No person, firm or corporation shall do any grading of any kind,
or excavation or drilling for soils testing purposes without first having obtained a grading
permit from the Building Official, except for the following:
1. An excavation below finished grade for basements and footings of a
building, retaining wall, or other structure authorized by a valid building
permit. This shall not exempt any fill made with the material from such
excavation nor exempt any excavation having an unsupported height
greater than five (51) feet after completion of such structure.
2. Cemetery graves.
3. Excavation for utilities.
4. An excavation which does not exceed 50 cubic yards on any one site and
(a) is less than two (21) feet in depth; or (b) which does not create a cut
slope which is greater than five (51) feet in height and steeper than two
(2) horizontal to one (1) vertical.

5. A fill less than one (11) foot in depth and placed on natural terrain with a
slope flatter than five (5) horizontal to one (1) vertical, or less than three
(3') feet in depth, not intended to support structures, which does not
exceed 50 cubic yards on any one lot and does not obstruct a drainage
course.
6. Clearing, brushing, and minor grading for agricultural purposes provided
such operations do not affect the lateral support or increase the stresses
in, or pressures on, any contiguous property, or alter the orientation of
natural water courses which may result in adverse changes on nearby or
adjoining property or result in dumping of organic or hazardous waste not
regulated by law. This grading includes contour grading to provide for
orchard planting, minor leveling not exceeding two (2') feet of either
excavation or fill for row crops, installation of irrigation systems, and
stockpiling of fertilizer."
SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.

Per the Uniform Administrative Code, Section 304, the determination of value or

Building Official. The value to be used in computing the building permit and plan

Note: Section 105 Definition of Valuations or Value, as applied to a building and its

The unit costs/values for general improvements defined in the 'Building Valuation
Data Schedule" (Table 3-A.0 are for projects employing conventional construction
with average to good quality.

The purpose and intent of the San Juan Capistrano Land Use Management Code is to:
a) "provide precise land use regulation as a means of implementing the General
Plan", and b) "Provide for the utilization of innovative land planning and building

residential, commercial, industrial and other development projects." The City
employs numerous committees, boards, and commissions to serve as a mechanism to
facilitate this endeavor. This renders unique, creative, sophisticated and complex
propositions.
Due to the nature, type, shape and size of the sites available in San Juan Capistrano
located in seismic zone 4, and the existence of moderate to highly expansive soils,
special architectural and/or structural features are often employed to mitigate
hazardous, unstable and unusual conditions. The Administrative Authority often
requires additional plans, specifications, details and engineered computations to
substantiate the validity and integrity of these proposals. The Building and Safety
Division defines this type of construction as complex construction with good to
excellent quality. A regional modifier of iL0% is used to adjust the unit cost to
reflect a reasonable and accurate assessment of local cost.
An additional 5 percent shall be imposed when special inspections as defined in
Section 306 of the Uniform Administrative Code are required. The surcharge is
designed to recover cost associated with screening special/deputy inspectors,
verification of credentials, reviewing field report and daily memos, communicating
with testing agencies and inspection monitoring.
U.B.C. Section 2312 Earthquake Regulations requires each structure to be
designated as being structurally regular or irregular. Regular structures have no
significant physical discontinuities in plan or vertical configuration or in their
lateral force -resisting systems such as irregular structures. Structures having one or
more of the features listed in Table No. 23-M of the Uniform Building Code shall be
designated as having a vertical irregularity. Structures having one or more of the
features listed in Table No. 23-N shall be designated as having a plan irregularity.
A structure designated as having a vertical irregularity and/or a plan irregularity
shall be defined as an irregular structure. An additional surcharge is imposed to
recover the cost associated with expending extra time/resources on complex,
intricate structures defined as irregular to verify conformance with approved plans
and to ensure adherence with the codes and regulations of the City of San Juan
Capistrano.

GRADING PERMIT FEE SCHEDULE

Footnotes For Table No. 3-G
Per the Uniform Administrative Code, Section 304, the determination of value or
valuation under any of the provisions stipulated in the codes shall be made by the
Building Official. The value to be used in computing the building permit and plan
review fees shall be the total value of all construction work for which the permit is
issued as well as all finish work, painting, roofing, electrical, plumbing, heating, air-
conditioning, elevators, fire extinguishing systems and any other permanent
equipment.
Note: Section 105 Definition of Valuation or Value, as applied to a building and its
building services equipment, shall be the estimated cost to replace the building and its
building service equipment in kind, based on current replacement costs.
The "Grading -Unit Cost Data Schedule" for excavation and grading work shall be used
to calculate the estimated cost of construction. The Grading -Unit Cost Data
Schedule shall be established and maintained by the Building Official and City
Engineer. The table shall be subject to semi-annual review. The current prevailing
cost in the local region shall dictate the unit cost prescribed in the Schedule. The
revised amended schedule shall be reviewed by the Director of Engineering and
Building Services for formal recommendation to the City Manager's office. The
amendment may be executed administratively with the City Manager's approval.
The deposit system is an account established to recover the cost incurred while
reviewing geotechnical reports. This includes time expended and materials/equipment
employed. Thus, additional fees maybe required for complicated studies.
Or the total cost to the jurisdiction, whichever is the greatest. This cost shall include
supervision, overhead, equipment, hourly wages and fringe benefits of the employee
involved.
