AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ADDING A NEW SECTION 3 TO ORDINANCE NO.
664 PROVIDING FOR EXCEPTIONS TO THE MORATORIUM ON
DEVELOPMENT APPLICATIONS FOR PROPERTY WITHIN THE
ALIPAZ EXTENSION STUDY AREA (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
A. The City's Planning Director has reviewed the amendment and
determined that it is a minor modification to land use limitation and,
therefore, categorically exempt from environmental review, and has
otherwise carried out all requirements of the California Environmental
Quality Act, as amended.
B. This amendment will provide for exceptions from development processing
restrictions of Ordinance 664 when the Planning Director determines
that a proposed project will not affect the Ordinance objective and the
City Council confirms such action of the Planning Director.

C. A duly/ public hearing has been held to receive and consider public
testimony regarding the proposed amendment.
SECTION 2. Amendment Text.
A. Introduction.
Based upon the findings set forth in Section 1, preceding, the following
amendments to Ordinance 664 set forth under Paragraph B, following, are
hereby enacted:
B. Amendments.
1. A new Section 3 is hereby added to read as follows:
"SECTION 3. Exceptions.
Exceptions to allow processing of development
projects within the General Plan Amendment Study
Area may be made upon a finding by the Director of
the Department of Planning that a proposed project
meets the following criteria:
1. The proposed project will not preclude
implementation of any identified Alipaz
extension alignments; and,
ee
2. The proposed project- will- not trigger a
need for road and flood control
improvements beyond that financed by the
project proponent; and,
3. The proposed project will not result in a
threat to the public health safety, and
welfare from unsafe access and/or
inadequate road capacity.
A Planning Director finding for exception under this
section shall be placed on the next available City
Council consent agenda for confirmation of an
exception from the development processing
restrictions of this ordinance. Such action of the
Planning Director shall become effective upon
confirmation by the City Council."
2. Section 3 and following sections shall be renumbered consecutively
in accordance with the new Section 3.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force upon passage.
SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be published once as required by law and posted at the duly designated posting
places within the City of San Juan Capistrano within fifteen (15) days after its passage.
