AMENDING DUTIES OF COMMISSIONS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, PROVIDING FOR CHANGES IN DUTIES WITH
RESPECT TO THE CULTURAL HERITAGE COMMISSION, PARKS
AND RECREATION COMMISSION, TRAFFIC AND
TRANSPORTATION COMMISSION, AND EQUESTRIAN AND
RECREATION TRAILS COMMISSION
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Code Amendment.
Article 3 of Title 2 of the Code is hereby amended in its entirety to read as
follows:
"Article 3 Cultural Heritage Commission.
Sec. 2-2.301. Created.
A Cultural Heritage Commission for the City is hereby created.
Sec. 2-2.302. Membership.
The Cultural Heritage Commission shall consist of five (5) to seven (7)
members, two (2) of whom are not required to be a resident of the City. A quorum shall
consist of not less than three (3) members, and any action of the Commission shall
require an affirmative vote of not less than three (3) voting members.
Sec. 2-2.303. Duties.
The Cultural Heritage Commission shall undertake and have the
following duties, responsibilities, and functions, together with the powers incidental
thereto:
(a) Generally, to act in an advisory capacity to the City Council,
Planning Commission, City Manager, and any other group which the Council
might designate in all matters pertaining to the culture, heritage, and history
of the City;
(b) To promote an awareness of an appreciation for the City's cultural
and historical significance through the preservation and promotion of
traditional folkways associated with the community. The Commission shall
encourage the sponsorship of community events and activities to promote the
knowledge of history, culture and traditional folkways of the community and
shall assist community organizations and other City boards and commissions in
undertaking such tasks;
(c) To compile, keep, and maintain a list of all sites, structures,

persons, events, and landmarks which have cultural or historical significance or
importance. Such list shall be submitted to the Council for its review. The
Commission shall notify the owner of any item on the list of any special City
requirements applicable to his property;
(d) To implement and administer studies and plans relating to matters
of historical, cultural, paleontological, or archaeological significance and to
make recommendations on the designation and creation of historical,
paleontological, or archaeological districts;
(e) To recommend to the City Manager an annual budget including the
following:
(1) Finance of the activities of he Commission; and
(2) The capital projects designed to protect the cultural heritage
of the C �munity.
The C fission shall also investigate the availability of funding
programs thr. ,n State and Federal agencies; and
(f) To undertake such other duties as may be assigned by the Council."
Article 5 of Title 2 is hereby amended in its entirety to read as follows:
"Article 5. Equestrian and Recreational Trails Commission
Sec. 2-2.501 Created.
An Equestrian and Recreational Trails Commission of the City is hereby
created.
Sec. 2-2.502 Membership.
The Equestrian Commission shall consist of a total of five (5) members.
Sec. 2-2.503. Duties.
The Equestrian Commission shall undertake and have the following
duties, responsibilities, and functions, together with the powers incidental thereto:
(a) To review and make recommendations to the Planning Commission
concerning tentative maps with regard to their relationship to the equestrian
element as identified in the Parks and Recreation Element of the General Plan
of the City if:
There is a proposed exception to a standard design criteria
for recreation trails (including pedestrian and off-road bike
trails) design and construction; or
2. The project will implement a major Master Plan or General
Plan Equestrian facility.

(b) To review and recommend to the Council equestrian and
recreational trails plans which are developed in the implementation of the
Parks and Recreation Element of the General Plan;
(c) To review and recommend to the Council plans for the development
of equestrian facilities and activities in the City;
(d) To review and recommend to the Council standards for recreation
trails design and construction;
(e) To review and recommend to the City Manager priorities in budget
items relating to the recreational trails system, including recommendations for
revenue generation
(f) To review and make recommendations to the Council regarding
County and State Master Plans of Trails;
(g) To review and make recommendations to the Council standards of
maintenance and upkeep of equestrian stables within the City; and
(h) To undertake such other duties as may be assigned by the Council."
Article 6 of Title 2 is hereby amended in its entirety to read as follows:
"Article 6. Parks and Recreation Commission.
Sec. 2-2.601. Created.
A Parks and Recreation Commission for the City is hereby created.
Sec. 2-2.602. Membership.
The Parks and Recreation Commission shall consist of a total of five (5)

The Parks and Recreation Commission shalt undertake and have the
duties, responsibilities, and functions, together with the powers incidental
(a) To review and make recommendations to the Planning Commission
concerning tentative maps with regard to their relationship to the City's Parks
Program identified in the Parks and Recreation Element of the General Plan of
the City and the parks requirements of the City;
(b) To review and recommend to the Council park plans which are
developed in the implementation of the Parks and Recreation Element of said
General Plan;
(c) To review and recommend to the Council plans for the development
of the recreation in the City;

(d) To recommend to the Council amendments to the Parks and
Recreation Element and to otherwise implement that element of said General
Paan;
(e) To review and recommend to the City Manager priorities in budget
items relating to parks and recreation, including recommendations for revenue
generation; and
(f) To undertake such other duties as may be assigned by the Council."
Article 8 of Title 2 is hereby amended in its entirety to read as follows:
"Article 8. Traffic and Transportation Commission.
Sec. 8-2.801. Created.
A Traffic and Transportation Commission for the City is hereby created.
Sec. 8-2.802. Membership.
The Traffic and Transportation Commission shall consist of five (5)

(a) To review and make recommendations to the Planning Commission
regarding site plans and subdivisions of land with regard to their impact on
internal and external circulation and parking facilities for development
projects if:
The development of the project will have an impact of 5% or
greater to the existing traffic on the roads identified on the
Master Plan of Arterial Highways and as defined in the circu-
lation element of the General Plan; or
(b) To review and make recommendations to the Council regarding the
City and/or County Master Plans of Highways;
(c) To study and make recommendations to the Council on matters of
transportation;
(d) To study and make recommendations to the Council regarding
appeals of administrative decisions concerning matters of traffic regulations,
including traffic control devices, parking, vehicular and pedestrian safety and
circulation;
(e) To review and recommend prioritizations of Traffic and Transpor-
tation projects to be included in both the City and Community Redevelopment
Agency's Capital Improvement Program;
(f) To represent the interest of the City as directed by the Council on
Regional Traffic and Transportation issues; and
(g) To undertake such other duties as may be assigned by the City
Council."

SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its

The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption is required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City
Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen
(15) days after adoption, the City Clerk shall cause to be published, the aforementioned
summary and shall post a certified copy of this Ordinance, together with the vote for and
against the same, in the Office of the City Clerk.
