Ordinance Number 7764GS ORDINANCE NO. 775 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 6, "SANITATION AND HEALTH", CHAPTER 1, "ANIMAL CONTROL" OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE RELATING TO THE PROHIBITION OF THE USE OF CERTAIN DEVICES AND PROVIDING FOR HUMANE TREATMENT OF RODEO ANIMALS THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Chapter 1, "Animal Control" of Title 6, "Sanitation and Health" of the San Juan Capistrano Municipal Code is hereby amended by adding the following articles thereto to read as follows: "Section 6-1.05. Applicability to All Rodeos within San Juan Capistrano. "The provisions of this article will apply to all rodeos occurring within the boundaries of the City of San Juan Capistrano. "Section 6-1.06. Notification requirements. "No person, firm, corporation or association shall conduct or promote any rodeo without first having applied in writing to Orange County Animal Control at least 30 days in advance of the proposed activity, The application shall include a detailed diagram of the rodeo area showing the location of chutes, catch chutes, and pens; a list of all proposed events and acts; and a copy of the rules and regulations which will govern the conduct of the contestants and events. The application shall include the dates and times of the events and the identify of the person who shall have charge of the event. "Section 6-1.07. Inspection of Rodeo grounds by County Animal Control Officers/Inspectors. "Animal control Officers/Inspectors are to be in constant attendance at all animal related rodeo activities. Up to date lists of names and numbers of all contestants and the number the number of the animals drawn by them shall be furnished to the Officer/Inspector. Officers/Inspectors are to be provided access to the areas where animals have been present, will 126 be present, or are present. Specifically included are the holding pens, chutes and injury pens. Officers/ Inspectors will be accompanied by a representative of the rodeo or rodeo related activity. "Section 6-1.08. Presence of a Licensed Veterinarian Required. "The presence of an event furnished and licensed veterinarian specializing in ether equine or bovine veterinary medicine shall be required during the entirety of all rodeos and rodeo related activities, including sections of slack. The veterinarian shall be independent of the rodeo and selected by the local rodeo organizing committee. The veterinarian shall have access to the complete site where animals have been present, will be present, or are present. The veterinarian shall have complete and unilateral authority over the treatment and utilization of rodeo animals or livestock. In this event it is the decision of the veterinarian that an animal is unable to be utilized, that decision shall be communicated to the stock contractor for compliance. "Section 6-1.09. Removal of Injured Animal. "A conveyance must be available, supplied by the stock contractor, and shall be used where practicable, to remove animals from the arena in case of injury. The conveyance must be large enough to remove a horse or a bull. Injured calves shall be removed from the arena in a pick up truck, calf stretcher or by conveyance. Animals removed from the arena pursuant to this section shall be placed in a situation as isolated and comfortable as possible to reduce stress. "Any injured livestock shall be humanely removed from the arena before continuing the rodeo contest or performance. "An animal injured in a catch chute shall remain in the catch chute until it is examined by the Animal Control Officer/Inspector. "Section 6-1.10. Rowels and Spurs. "No locked rowels, or rowels that will lock on spurs, may be used by rodeo participants. Spurs used by rodeo participants must be dulled. "Section 6-1.11. No Sharp Objects in Cinch, Saddle, Girth or Flank Straps. "No sharp or cutting objects in cinch, saddle girth, or flank straps shall be permitted on animals used for rodeo performance. "Section 6-1.12. Flank Straps. "Unlined flank straps are prohibited. Only sheepskin -lined flank straps shall be used on bucking stock and shall be of the quick release type. Sheepskin -lined flank straps shall be placed on the animal so the sheepskin -covered portion is over both flanks of the animal. -2- prohibited. "Section 6-1.13 4L/ Caustic ointments. "The use of caustic ointments to enhance performance of rodeo animals is "Section 6-1.14. Use of Prods "In riding events, use of prods and similar devices is prohibited. In roping events, the use of prods to move calves and steers from the chute into the arena is prohibited. "Section 6-1.15. Exception for Use of Prod for Chute Stalling Animal. "A battery powered electric prod, no greater than 12 inches in length, may be used on an animal known as a chute stalling animal, only with the animal owner's and contestant's permission. This exception shall only apply in the saddle bronc riding and bareback riding events. The animal may be touched by the prod only on the hip or shoulder area. "Section 6-1.16. Construction of Chutes. "Chutes must be constructed to prevent injury to an animal. Maintenance personnel and equipment shall be available at chutes to assist in the removal of any animal should it become necessary. "Section 6.4.17. Advance Run through Chute by Stock for Timed Events "All timed -event stock shall be run through event chutes and through the arena area prior to the start of contests. The horns of steers that are not able to pass through the timed event chute shall be trimmed. "Section 6-1.18. Condition of Arenas. All arenas shall be as free as possible of rock, holes and unnecessary obstacles. "Section 6-1.19. Roping Regulations. "In calf roping, neck ropes must be tied with string. No metal snaps, elastics or hardware shall be used on neck ropes in the timed events. Adjustable slide shall be used on all neck ropes for cattle used in the timed events. "Section 6-1.20. Additional Regulations for Calf Roping. "Roping calves shall be strong and healthy. Timed event cattle will meet the following weight restrictions: roping calves shall weigh a minimum of 215 pounds and a -3- ;28 maximum of 285 pounds. Fresh calves, never before roped in competition, shall weigh no more than 275 pounds. "In calf roping, a neck rope must be used. Contestant must adjust rope and reins in such a manner that will prevent horse from dragging calf. The rope is to be removed from the calf's body as soon as possible after the "tie" is approved. "Time limits. There will be a 25 second elapsed time limit in calf roping. A whistle indicating `'no time" shall be blown by the time at the end of the 25 second span. Roping a calf after the 25 second whistle has sounded shall be considered mistreatment of the animal. "No "jerk down"s will be permitted in calf roping. Jerk down is defined as flipping the calf over backwards, with the calf landing on its back or head with all four feet in the air, and shall be determined by the officials judging the rodeo. Intentional jerk down of a calf by a contestant shall result in disqualification from the round in which the jerk down took place, and shall result in a violation of this ordinance. "Unintentional jerk down of a calf by a contestant shall result in disqualification from the round in which the jerk down took place. "Section 6-1.21 Team Roping Regulations. "There will be a 30 second elapsed time limit in team roping. A whistle indicating "no time" shall be blown by the timer at the end of the 30 second -span. "All team roping cattle shall be protected by horn wraps. "There will be a 60 second elapsed time limit in steer wrestling. A whistle indicating "no time" shall be blown by the timer at the end of the 60 second -span. "Section 6-1.22. No stimulants or hypnotic drugs. "No stimulants or hypnotic drugs may be given to any animal used for rodeo contest purposes. "Section 6-1.23. Bareback Pads. "Required bareback pads are to completely cover the underside of the rigging, and are to extend a full 2 inches behind the rigging. C! 4ZV "Section 6-1.24. Bull Riding "In bull riding events, no bull tails will be allowed under flank straps. The use of sharp spurs, or the placing of spurs or chaps under the rope when the rope is being tightened on the bull is prohibited. "The use of electric prods in bull riding is prohibited without exception. "Section 6-1.25. Abuse or Mistreatment of Animals. "A participant shall not abuse or mistreat any animal or livestock by any unnecessary non-competitive or competitive action. Any action by a participant deemed to be mistreatment or abuse by the Animal Control Officer/Inspector shall constitute a violation of this ordinance. "Section 6-1.26. Violations "Any person who violates any provision of this ordinance is guilty of an infraction. Officers/Inspectors are authorized to issue notices to appear in court for violations of any provision of this ordinance. Each time a violation exists or continues to exist after notification of a violation, shall constitute a separate offense. Infractions shall be punishable by the fine amounts set in Title 1, Chapter 2 of the San Juan Capistrano Municipal Code. "Section 6-1.27. Report of Animal Injuries to City "Upon the completion of any rodeo events, Orange County Animal Control will provide written notification to the City Manager of any animal injuries that occurred as a result of the activity and notice of the issuance of any citations for violations of this ordinance. "Section 6-1.28. Compliance of Non -sanctioned Professional Rodeo Cowboys Association with Rodeos other rules. "Rodeo organizers, judges and participants not associated with the Professional Rodeo Cowboys Association are encouraged to comply with all rodeo rules established by the Professional Rodeo Cowboys Association for the safety of animal and human rodeo participants." This Ordinance shall take effect and be in force thirty (30) days after its passage. �C�71Y(t3ait�iliiZ�I[�fi!�� - � � The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen -5- 430 (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
