Ordinance Number 764273 ORDINANCE NO. 764 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING VARIOUS SECTIONS IN TITLE 4 (PUBLIC SAFETY), CHAPTER 4, (PARKING METERS) OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE TO ESTABLISH PARKING METER ZONES AND FEES WHEREAS, the 1995 Downtown Parking Study Update has identified that train commuters have a significant impact on parking conditions in the Downtown area; and, WHEREAS, the City and Community Redevelopment Agency incur considerable expense in providing, maintaining and managing public parking in the Downtown area; and, WHEREAS, the City Council of the City of San Juan Capistrano has determined it is in the interest of the City to control, regulate and inspect the parking of vehicles on City -owned or leased land with the aid of timing devices. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: A. Section 4-4.02, "Parking Meter Zones: Establishment: Authority" is hereby amended in its entirety to read as follows: "Section 4-4.02. Parking Meter Zones: Establishment: Authority. Parking meter zones may be established and determined by ordinance of the City Council. The streets, portions of streets, and off-street lots owned, leased, or controlled by the City, which are hereinafter described, are defined and established as parking meter zones within which the parking of vehicles shall be controlled, regulated and inspected with the aid of parking meters, unless designated as a "No Parking," "Limited Parking," or Handicap Parking," or "Loading" zone. 1. Franciscan Plaza Parking Structure bottom 131 spaces (26701 Verdugo Street)." B. Section 4-4.05, "Parking Meters: Fees: Establishment: Authority" is hereby amended in its entirety to read as follows: Be 274 "Section 4-4.05. Parking Meters: Fees: Establishment: Authority. The parking meter fees for the parking meter zones shall be as established by resolution of the City Council." follows: C. New Section 4-4.15 is hereby added to Title 4, Chapter 4, to read. as "Section 4-4.15. Use of Money Deposited in Parking Meters. All monies collected from parking meters in the City shall be placed in an enterprise fund, which shall be devoted exclusively to the following purposes: (a) To be placed as security for the payment of principal and interest on off- street parking revenue bonds issued by this City, or any parking district organized within this City; and, (b) For the purchasing, leasing, acquiring, improving, operating, enforcement and maintaining of off-street parking facilities in this City; and, (c) For the purchasing, leasing, installing, repairing, maintaining, operating, removing, regulating and policing of parking meters in the City, and for the payment of any and all expenses relating or incidental thereto; and, (d) For the installation and maintenance of traffic control devices and signals; and, (e) For the painting and marking of streets and curbs required for the direction of traffic and parking of motor vehicles; and, (f) For the proper regulation, control and inspection of parking and traffic upon the public streets; and, (g) For the purchasing, maintenance, installation of street furniture, receptacles, water fountains, landscaping and beautification." follows: D. New Section 4-4.16 is hereby added to Title 4, Chapter 4, to read as "Section 4-4.16. Parking Permits. Any person holding a valid California Drivers License may apply to the City for a Commuter Rail Permit by submitting to the City Manager, or his designee, the prescribed fee as established by resolution of the City Council and a completed Permit Application form. Upon -2- verifying the information contained within the application and receiving the prescribed fee, the City shall issue a Commuter Rail Parking Permit to the applicant. The applicant shall affix the Commuter Rail Parking Permit to the lower right-hand side of the vehicle's rear window or rear bumper. Any person displaying a Commuter Rail Parking Permit shall be entitled to park, free of charge, in a City -owned or leased designated long-term parking space regulated by a parking meter or device." This Ordinance shall take effect and be in force thirty (30) days after its passage. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
