AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
EXTENDING INTERIM ORDINANCE NO. 748, ESTABLISHING A
MORATORIUM ON CERTAIN DEVELOPMENT APPLICATIONS WITHIN THE
GENERAL COMMERCIAL DISTRICT (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. Extension.
Pursuant to Government Code Section 65858(a), the City Council hereby finds and determines
that it is necessary to extend Interim Ordinance No. 748, providing for a moratorium on certain development
applications within the General Commercial District.
SECTION 2. Findines.
A. The City Council, pursuant to Government Code Section 65858(c), finds that there
is a current and immediate threat to the public health, safety and welfare of the community if commercial
industrial uses are established during the period of study of General Plan and zoning consistency.
B. The City Council, pursuant to Government Code Section 65858(d) has initiated an
amendment to Title 9 of the Municipal Code - General Commercial District, with Resolution No. 94-4-6-7.
SECTION 3. Period of Extension.
Interim Ordinance No. 748 is hereby extended for a period of 10 months and 15 days.
SECTION 4. Ci1y Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the same to be
published once as required by law and posted at the duly designated posting places within the City of San Juan
Capistrano within fifteen (15) days after its passage.
