ORDINANCE NO. 743
AMENDING TITLE 5. OF THE MUNICIPAL CODE - SMOKING IN PUBLIC PLACES.
TO DESIGNATE EATING ESTABLISIMMM AS 100 PERCENT NO SMOKING AREAS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
AMENDING TITLE 5, CHAPTER 20, OF THE SAN JUAN CAPISTRANO
MUNICIPAL CODE ENTITLED "SMOKING IN PUBLIC PLACES"
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION L Findings and Purpose.
The City Council finds that the smoking of tobacco, or any other weed, plant or substance is
a positive danger to health and a material annoyance, inconvenience, discomfort and a health hazard to those
who are present in confined spaces, and in order to serve public health, safety and welfare, the declared purpose
of this Chapter is to prohibit the smoking of tobacco or any other weed, plant or substance in public places and
places of employment as stated and required in this Chapter.
SECTION 2 Code Amendments.
1. Section 5-20.10, of Title 5, Chapter 20, of the San Juan Capistrano Municipal Code,
is hereby amended to read as follows:
"Section 5-20.10. Smoking Prohibited - Eating Establishments.
Smoking is prohibited in restaurants and other eating establishments, including reception areas,
but excluding outdoor seating areas. Every restaurant shall have posted at its entrance area a sign clearly stating
that smoking is not permitted."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its passage.
SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the same to be
published once as required by law and posted at the duly designated posting places within the City of San Juan
Capistrano within fifteen (15) days after its passage.
