Ordinance Number 866ORDINANCE NO. 866 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING COMPREHENSIVE DEVELOPMENT PLAN (CDP) TO CDP 78-01, ORTEGA PLANNED COMMUNITY THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. a. The proposed project is of the San Juan Capistrano General because the project would further the states that the City will enhance c centers, and Policy 6.1 which states the oversupply of commercial land t producing land uses; and, consistent with the policies and objectives Plan, specifically, the Land Use Element achievement of Land Use Goal 6: which r redevelop underperforming commercial that the City will allow for the transition of ise to other economically viable revenue b. The proposed project would be consistent with the purpose and intent of Planning Sector A-2 which provides that "The purpose of these regulations is to create a high quality planned development that provides for the integration of a broad range of retail and commercial services, and public and semi-public institutional uses in accordance with the General Plan, Comprehensive Development Plan, and PC District Regulations'; and, C. The proposed project complies with all applicable provisions of Title 9, Land Use Code, specifically, Section 9-3.602, Off-street parking and loading. SECTION 2. Amendment. a. The text of Comprehensive Development Plan (CDP) 78-01, Ortega P.C. is hereby amended as provided in Exhibit 'W', attached hereto and incorporated herein; and, b. The planning subsection zone map of Planning Sector 1 of Comprehensive Development Plan (CDP) 78-01, Ortega P.C. is hereby amended as provided in Exhibit "B", attached hereto and incorporated herein. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. 07-02-02 Ordinance SECTION 4. Citv Clerk's Certification The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance anis a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk. Purpose and Intent: The purpose of these regulations is to create a high quality planned development that provides for the integration of a broad range of retail and services commercial, and public and semi-public institutional uses in accordance with the General Plan, Comprehensive Development Plan, and PC District Regulations. B. Uses Provisions 1a. Subsection 1, Principle Uses Permitted : a. General retail uses including furniture, home appliances, paint, floor and wall coverings, auto parts and supplies, bicycles, sporting goods, hobby supplies, apparel, fabrics, jewelry, cosmetics and pharmaceutical, stationery, flowers, candy, baked goods, liquor, newspapers, magazines, and similar uses. b. Commercial service uses include home appliance repair, bicycle repair, cleaning and dyeing agencies, barber and beauty shops, tailor shops, art and photography studios, printing blueprinting and reproduction services (excluding newspaper or other publishing), travel agencies, and similar service uses. C. Restaurants (drive-in or drive-through restaurants are prohibited), bakeries, ice cream parlors, delicatessens, small-scale grocery/meat/liquor markets (less than 10,000 square feet). d. General office uses include professional businesses, real estate, travel agencies, non-profit and civic organizations, and similar uses. e. Financial service uses include banks, saving and loan associations, and credit unions. f. Medical and dental offices (medical centers/complexes are prohibited). g. Specialized service uses including linen and diaper supply, office supplies, catering services, appliance repair, automobile parts and supply, computer and data processing centers, and industrial products showrooms. h. Wholesale establishment uses including the sale of products to retailers or other businesses (general public use prohibited). i. Product sales including electrical supplies, plumbing supplies, hospital supplies. j. Weight loss clinics. k. Personal trainers/fitness consultants. Exhibit A Ordinance 1b.
