AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ESTABLISHING OVERSIZED VEHICLES PARKING
REGULATIONS BY ADDING SECTION 4-6.325 TO TITLE 4, CHAPTER 6,
ARTICLE 3 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE
WHEREAS, The San Juan Capistrano Municipal Code currently prohibits vehicle
parking on any street for more than 72 consecutive hours; and,
WHEREAS, the City Council of the City of San Juan Capistrano wishes to further
define parking restrictions for vehicles of certain length and width to improve safety and
quality of life for San Juan Capistrano residents.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano, does hereby ordain as follows:
SECTION 1. Establishment of Oversized Vehicle Parking Regulations.
Section 4-6.325 entitled "Oversized Vehicle Parking Restrictions" is hereby added
to Title 4, Chapter 6, Article 3 of the San Juan Capistrano Municipal Code is read as
follows:
"Section 4-6.325. Oversized Vehicle Parking Restrictions.
(a) No person shall park and leave standing upon any public street or highway
within the City of San Juan Capistrano any motor vehicle in excess of 25 feet in
length, or a weight in excess of 10,000 pounds;
(b) No person shall park and leave standing upon any public street or highway any
vehicle used or maintained for the transportation of property, including buses, motor
trucks, trailers, semi -trailers, trailer coaches or truck tractors as defined in the
California Vehicle Code and similar vehicles of a width in excess of 90 inches as
measured at the widest portion of the body, not including mirrors or other
extensions; or any item of farm machinery or special purpose machine.
(c) Prohibited vehicles may be parked on public streets or highway while loading or
unloading persons and/or property; or when such vehicle is parked in connection
with, or in aid of the performance of a service to or on a property in the block in
which such vehicle is parked; or to perform repairs of an emergency nature on the
motor vehicle itself, for a maximum of 72 hours. Loading or unloading as used in
this section shall mean active loading or unloading, including the performance of
those activities required too prepare the vehicle for eithertravel or storage, and shall
also included a period of time not to exceed 12 hours during which the vehicle
cannot reasonably be taken on the road or moved to a place of otherwise lawful
storage. The term 'one location" shall include any movement or relocation of such
vehicle at least two tenths (0.2) of a -mile of any prior parking location used within
the preceding 72 -hour period.
SECTION 2. Effective Date.
The Ordinance shall take effect and be in force thirty (30) days after adoption.
SECTION 3. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the same
to be posted at the duly designated posting places within the City and published once
within fifteen (15) days after passage and adoption as required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five
(5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after
adoption, the City Clerk shall cause to be published, the aforementioned summary and
shall post a certified copy of this Ordinance, together with the vote for and against the
same, in the Office of the City Clerk.
