AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA APPROVING REZONE 01-07, AN AMENDMENT TO
COMPREHENSIVE DEVELOPMENT PLAN 81-02, PERMITTING A FOUR
(4) LOT TENTATIVE PARCEL MAP (TPM) FOR A 30,300 SQUARE FOOT
PARCEL LOCATED SOUTH OF SAN JUAN CREEK ROAD,
APPROXIMATELY 445 FEET WEST OF LA NOVIA. (VISTA VERDE ESTATES)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings
The proposed rezone has been processed pursuant to the requirements of
Land Use Code Sections 9-2.301 and 9-2.302; and,
2. In the determination of staff, the area to be covered by this amendment of
the City's Official Zoning Map will allow an effective integration of Single
Family Residential uses; and,
3. The Environmental Administrator has reviewed the project and an initial
study has been prepared pursuantto Section 15063 of the CEQA Guidelines
and, pursuant to Section 15070 of the CEQA Guidelines, has issued a
negative declaration and caused a Notice of Negative Declaration to be
posted pursuant to Section 15072 of the CEQA Guidelines, and has
otherwise complied with all applicable provisions of the California
Environmental Quality Act (CEQA); and,
4. The proposed rezone is consistent with the goals, policies, and objectives of
the San Juan Capistrano General Plan in that the principal, accessory, and
conditional uses provided for within the PC (Planned Community) District,
subject to Comprehensive Development Plan (CDP) 81-02, are consistent
with surrounding uses in the immediate area and will provide for a
development consistent with the intent of the Land Use Element; and,
5. The Planning Commission conducted a duly noticed public hearing on July
10, 2001, and recommended that the City Council adopt the Ordinance; and,
6. The City Council conducted a duly noticed public hearing on August 7, 2001
pursuant to Section 9-2.313 of the Municipal Code to consider testimony,
either in favor of or in opposition to the proposed rezone.

SECTION 2. Amended Area
The property located on the south side of San Juan Creek Road, approximately 445
feet west of La Novia, and referred to as Assessors Parcel Number APN 666-321-
002 is hereby designated a PC (Planned Community) District on the City's Official
Zoning Map, subject to Comprehensive Development Plan (CDP) 81-02, and
referred to as Parcel G.
SECTION 3. Effective Date
This Ordinance shall take effect and be in force thirty (30) days after its passage.
SECTION 4. City Clerk's Certification
The City Clerk shall certify to the adoption of this Ordinance and cause the same
to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption as required by law; or, in
the alternative, the City Clerk may cause to be published a summary of this
Ordinance and a certified copy of the text of this Ordinance shall be posted in the
Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance;
and, within fifteen (15) days after adoption, the City Clerk shall cause to be
published the aforementioned summary and shall post a certified copy of this
Ordinance, together with the vote for and against the same, in the Office of the City
Clerk.
