Ordinance Number 855187 ORDINANCE NO. 855 AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE OF THE CITY OF SAN JUAN CAPISTRANO REGULATING ARCHITECTURAL BANNERS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 9, ADDING SUBSECTION 9-3.603(E)(15) ENTITLED "ARCHITECTURAL BANNERS" AND APPROVING A NEGATIVE DECLARATION THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings WHEREAS, there are currently no provisions allowing for limited use of architectural banners for commercial centers, except in the provisions governing special event permits under Section 9-3.603 of the Municipal Code; and, WHEREAS, property owners of large scale commercial centers have approached the City with requests to place architectural banners for purposes of invigorating their centers and generating architectural accentto the associated parking lots; and, WHEREAS, the City acknowledges that these banners can be attractive and can improve a shopping center's appearance as a destination for shopping; and, WHEREAS, the City of San Juan Capistrano is committed to assisting its business community through business retention efforts while at the same time preserving the community's aesthetic quality; and, WHEREAS, the City Council, on October 3, 2000 the City Council initiated a code amendment, CA 00-08 to initiate the development of regulations to govern architectural banners; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15070 of the California Environmental Quality Act (CEQA) and issued a negative declaration, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA); and, WHEREAS, on February 27, 2001 the Planning Commission conducted a duly noticed public hearing to consider testimony on the proposed code amendment adding subsection 9-3-603(E)(15) to Title 9 of the Municipal Code and adopted Planning Commission Resolution No. 01-01-27-2 recommending City Council approval of the negative declaration and adoption of the proposed code amendment; and, -1- Unj WHEREAS, the City Council conducted a duly noticed public hearing on March 20, 2001 pursuant to Section 9-2.313 of the Municipal Code. SECTION 2. Amendment Text Based upon the findings set forth in Section 1 preceding, the following amendments to the Municipal Code are hereby enacted: Section 9-3-603(E)(15) is added to the Municipal Code as follows: (15) Architectural Banners (i) Purpose and Intent: To allow limited use of pole mounted banners in commercial center parking lots centers in a tasteful manner to invigorate the setting in a non - advertising manner without detracting from the broader community's aesthetics. Applicability and Standards (A) Singly owned properties with a minimum of three or more commercial uses or services having a common parking area with existing light poles in place, and/or, separate properties considered or marketed as one single shopping center that share access and have more than three tenants combined. (B) Banners shall be affixed by brackets to the light poles and shall meet all safety requirements of manufacturer. (C) Banners shall be made of vinyl or nylon and no larger than 3' wide by 3' high, deviations to this size must be requested and based upon scale of light pole and banner considered together. (D) Banners may have graphics; however, text shall be limited to expressions such as "Celebrate, fun, Merry Christmas or Happy Holidays". Names of individual tenants shall not be used on banners; however, generic listing of available services may. (E) A color palette shall be provided for consideration by the Planning Commission. (F) Up to half of existing light poles may have banners attached; and may be placed throughout the parking lot as desired, near entrances, or in groupings. (G) Banners must be maintained in good shape, any signs of wear and tear necessitate their immediate removal. (H) Banners shall be placed with public safety in mind. The bottom of each banner shall be placed a minimum of 7' from finished grade and shall not obstruct the walkway, drive aisle or passage of automobiles, delivery vehicles or their designated parking spaces, and people. -2- 189 (iii) Review of Pole Mounted Banner Applications: The Planning Department shall receive all applications for installing pole mounted parking lot banners. Upon receipt of a complete application, the request shall be forwarded to the Planning Commission for consideration. Notification to center merchants shall be required. (iv) Submittal Requirements: A completed development application for the use of pole mounted banners signed by the property owner of record. 2 Applications shall also include a site plan showing the location and must be submitted by property owners meeting the above qualifications. SECTION 3. Effective Date This Ordinance shall take effect and be in force thirty (30) days after its passage. SECTION 4. City Clerk's Certification The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk, PASSED, APPROVED AND ADOPTED this Mrd day of Apr; l 12001.
