Ordinance Number 847071 ORDINANCE NO. 847 AMENDMENT TO TITLE 4 OF THE MUNICIPAL CODE, TRAFFIC REGULATIONS - ESTABLISHING SPEED LIMITS AT VARIOUS LOCATIONS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PRIMA FACIE SPEED LIMITS AT VARIOUS LOCATIONS BY AMENDING TITLE 4, CHAPTER 6, ARTICLE 5, SECTION 4-6.501 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE WHEREAS, California Vehicle Code Section 627 defines an Engineering and Traffic Survey to include a consideration of all of the following: Prevailing speeds as determined by traffic engineering measurements; 2. Accident records; 3. Highway, traffic and roadside conditions not readily apparent to the driver; and, WHEREAS, the City of San Juan Capistrano has completed an Engineering and Traffic Survey pursuant to California Vehicle Code Section 22357, 22358 and 22358.3. WHEREAS, the City Council of the City of San Juan Capistrano expresses great displeasure at the loss of local control of speed limits within San Juan Capistrano; and, WHEREAS, the City Council of the City of San Juan Capistrano will continue to take steps toward establishing and maintaining safe and reasonable speed limits for pedestrians and bicyclists as well as motorized vehicles and which maintains the highest standards of quality of life of the surrounding neighborhood. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, does hereby ordain as follows: SECTION 1. Establishment of Prima Facie Speed Limits. Title 4, Chapter 6, Article 5 of the San Juan Capistrano Municipal Code is hereby amended in its entirety to read as follows: "Article 5. Speed Limits "Section 4-6.501. Established. Pursuant to the provisions of Sections 22357, 22358 and 22358.3 of the California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are hereby determined and declared as follows: -1- 072 "(a) Fifteen miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifteen (15) miles per hour: "(1) Los Rios Street from Del Obispo Street to Verdugo Street; "(2) Los Rios Street from Verdugo Street to Mission Street. "(b) Twenty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty-five (25) miles per hour: "(1) Aguacate Road from Del Obispo Street to its northerly end; "(2) Alipaz Street from Del Obispo Street to its northerly end; "(3) Avenida de la Vista from Oso Road to La Zanja Street; "(4) Avenida de la Vista from La Zanja to its southerly end; "(5) Calle Arroyo from La Novia Avenue to Calle del Campo; "(6) Calle Arroyo from Calle del Campo to Avenida Siega; "(7) Camino Capistrano from Del Obispo Street to Ortega Highway; "(8) EI Camino Real from Forster Street to La Zanja Street; "(9) La Zanja Street from Avenida de la Vista to Camino Capistrano; "(10) Mission Hills Drive from Rancho Viejo Road to its easterly end; "(11) Ortega Highway from the 1-5 Freeway Ramps to Camino Capistrano; "(12) Paseo Adelanto from Del Obispo to its southerly end; "(13) Via de Agua from Camino Las Ramblas to the 1-5; "(14) Village Road from Rancho Viejo Road to Trabuco Creek Road. "(c) Thirty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty (30) miles per hour: "(1) Alipaz Street from its southerly end to Camino Del Avion; -2- 073 "(2) Avenida Aeropuerto from Camino Capistrano to its westerly end; "(3) Calle Arroyo from its westerly end to Rancho Viejo Road; "(4) Camino Capistrano from Ortega Highway to La Zanja Street; "(5) Camino la Ronda from La Novia Avenue to its easterly end; "(6) Rancho Viejo Road from Calle Arroyo to Ortega Highway; "(7) Via Entrada from La Novia to the private gate. "(d) Thirty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty-five (35) miles per hour: "(1) Calle Aspero from Del Obispo Street to Peppertree Bend; "(2) Camino Capistrano from San Juan Creek Road to Del Obispo Street; "(3) Camino Del Avion from Del Obispo Street to the Sports Park Entrance; "(4) Del Obispo Street from Calle Aspero to Alipaz Street; "(5) Del Obispo Street from Alipaz Street to Camino Capistrano; "(6) Del Obispo Streetfrom Camino Capistranoto Ortega Highway; "(7) Doheny Park Road from the southerly City Limits to Camino Capistrano; "(8) La Novia Avenue from Ortega Highway to San Juan Creek Road; "(9) La Novia Avenue from Via Sequoia to Via Capri (West); "(10) Ortega Highway from 1-5 to Rancho Viejo Road; "(11) San Juan Creek Road from La Novia Avenue to Avenida La Mancha; "(12) Valle Road from its southerly end to the 1-5; "(13) Valle Road from 1-5 to San Juan Creek Road. -3- 074 "(e) Forty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty (40) miles per hour: "(1) Alipaz Street from Camino del Avion to Calle Rolando; "(2) Alipaz Street from Calle Rolando to Del Obispo Street; "(3) Calle Arroyo from Rancho Viejo Road to La Novia Avenue; "(4) Camino Capistrano from Doheny Park Road to Stonehill Drive; "(5) Camino Capistrano from Oso Road to Junipero Serra Road; "(6) Camino del Avion from Shipside Drive to Del Obispo Street; "(7) Camino del Avion from Avenida Descanso to Alipaz Street; "(8) Camino Las Ramblas from 1-5 to Via de Agua; "(9) Del Obispo Street from Camino Del Avion to Calle Aspero; "(10) Highland Drive from Rancho Viejo Road to Hillside Terrace; "(11) Junipero Serra Road from Rancho Viejo Road to Camino Capistrano; "(12) La Novia Avenue from San Juan Creek Road to Via Sequoia; "(13) La Novia Avenue from Via Capri (West) to Valle Road; "(14) Ortega Highway from Rancho Viejo Road to La Novia Avenue; "(15) Ortega Highway from La Novia Avenue to Via Cordova; "(16) Rancho Viejo Road from Junipero Serra Road to Village Road; "(17) San Jan Creek Road from Avenida La Mancha to its easterly end; "(18) Trabuco Creek Road from Rancho Viejo Road to its easterly end. "(f) Forty-five miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty-five (45) miles per hour: El 075 11(1) Camino Capistrano from Stonehill Drive to Avenida Aeropuerto; "(2) Camino Capistrano from Avenida Aeropuerto to San Juan Creek Road; "(3) Camino Capistrano from La Zanja Street to Oso Road; "(4) Camino Capistrano from Junipero Serra Road to its northerly City Limits; "(5) Camino Las Ramblas from Via de Agua to its easterly end; "(6) Del Obispo Street from the southerly City Limits to Camino Del Avion; "(7) Ortega Highway from Via Cordova to the easterly City Limits; "(8) Rancho Viejo Road from Ortega Highway to Golf Club Drive; "(9) Rancho Viejo Road from Golf Club Drive to Junipero Serra Road; "(10) Rancho Viejo Road from Village Road to the northerly City Limits; "(11) San Juan Creek Road from Camino Capistrano to Calle Caballero (East); "(12) San Juan Creek Road from Calle Caballero (East) to La Novia Avenue. "(g) Fifty miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifty (50) miles per hour: "(1) Stonehill Drive from the westerly City Limits to Camino Capistrano. SECTION 2. Legislative Findings in Support of Prima Facie Speed Limits. The Legislative findings in support of prima facie speed limits previously set forth by the City Council in Ordnance No. 520, adopted on October 16, 1984, Ordinance No. 588, adopted on December 16, 1987, Ordinance No. 621, adopted on January 19, 1988, Ordinance No. 659, adopted on February 20, 1990, Ordinance No. 661, adopted on April 3, 1990, Ordinance No. 680, adopted on December 11, 1990, Ordinance No. 727, adopted on March 16, 1993, Ordinance No. 757, adopted on December 6, 1994, and -5- 076 Ordinance No. 830, adopted on January 5, 1999, shall continue to remain in effect unless amended herein. passage. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
