A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, INITIATING A CODE AMENDMENT TO
SECTION 9-5.103 OF THE MUNICIPAL CODE REDUCING HOUSING
IN -LIEU FEES, BY 10%.
WHEREAS, the City's Housing In -Lieu fee, originally adopted in 1995, was
amended by the City on April 7, 2009, as partof Ordinance 955 adopting a comprehensive
update to the Housing In -Lieu Fee and requires developers of new residential dwelling
units to pay a fee when not including 10% of units within the total development as
affordable housing units; and,
WHEREAS, the City Council directed the City's Housing Advisory Committee
to provide a recommendation to the City Council of whether to initiate a Code Amendment
to reduce or eliminate the City's Affordable Housing In -Lieu fee; and,
WHEREAS, the Housing Advisory Committee recommended to reduce all
development -related fees, including but not exclusive to the housing in -lieu fee, by 10%;
and,
WHEREAS, at the May 1, 2012, meeting, the City Council voted to reduce
the current Housing In -Lieu -Fee by 10%; and bring back to the City Council alternatives
used by Orange County cities to meet their affordable housing requirements, including any
-- potential consequences of rezoning for affordable housing rather than requiring
inclusionary housing or Housing In -Lieu -Fees for their consideration; and,
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano hereby initiates consideration of a Code Amendment to Section 9-
5.103 of the Municipal Code, to reduce the Housing In -Lieu Fee by 10%.
