APPROVAL OF THE OPERATIONAL AREA AGREEMENT
OF THE COUNTY OF ORANGE AND POLITICAL SUBDIVISIONS
A RESOLUTION OF THE
BOARD OF DIRECTORS OF THE
CAPISTRANO VALLEY WATER DISTRICT APPROVING
THE OPERATIONAL AREA AGREEMENT OF THE
COUNTY OF ORANGE AND POLITICAL SUBDIVISIONS TO
ESTABLISH THE STATE -MANDATED
OPERATIONAL AREA FOR EMERGENCY MANAGEMENT
WHEREAS, the Capistrano Valley Water District is a political
subdivision that lies within the County of Orange; and,
WHEREAS, Senate Bill 1841 (Petris) mandated the standardized
emergency management system which requires the designation of an operational
area by December 1995; and,
WHEREAS, many approaches have been used across the State to
meet this requirement, the agreement for designation of the operational area is an
inclusive approach which actively seeks the participation of all subdivisions in the
County geographic area as equals to ensure all needs are considered.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of
the Capistrano Valley Water District as follows:
SECTION 1.
That the Capistrano Valley Water District approves the Operational
Area Agreement of the County of Orange and Political Subdivisions.
SECTION 2.
That the Chairman is hereby authorized to execute the Agreement on
behalf of the District.
PASSED, APPROVED AND ADOPTED this fifth day of December,
1995.

SUBJECT: Consideration of Agreement to Establish State Mandated Operational
Area for Emergency Management
The 1991 Oakland Firestorm prompted new law requiring significant changes to the
way local and state agencies respond to major emergencies. The Standardized
Emergency Management System (SEMS) regulations were developed to help ensure
that the people and agencies responding to disasters have an organized and standard
approach to the situation. SEMS requires the Board of Supervisors to establish an
Operational Area of all of the Cities, Public Agencies, and Special Districts
(Subdivisions) in the County by December 1, 1995.
Although multiple approaches for developing operational areas have been used across
the State, Orange County has chosen a more formal agreement. The Agreement
actively seeks the participation of all Subdivisions in the geographic area and treats
them as equals in order to ensure that thier emergency needs and resources are
considered. The Agreement (provided as Attachment "B") establishes a beginning
framework for the administrative and emergency organization of the Operational Area,
which will be further developed by the member Subdivisions. SEMS also states that,
"non -participation of any Subdivision does not affect the authority and responsibility
of the Operational Area." Hence the County is responsible for acting as the
Operational Area lead whether Subdivisions execute this agreement or not.
The intent is to build a strong Operational Area to allow all the Subdivisions in the
County to communicate, act and speak together with one voice to our State and
Federal counterparts, in both response and recovery from a major emergency
affecting several counties. It will allow Orange County to compete for emergency
resources with other counties and provide the structure to employ those resources
where they are most needed. At this time, staff is recommending approval of the
Operational Area Agreement by Resolution.
Similar action was approved by the City at their November 21 meeting.
