RESOLUTION NO. 84-8-21-3
A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CAPISTRANO VALLEY WATER
DISTRICT EXPRESSING OPPOSITION TO
PROPOSITON 36, THE INITIATIVE PETITION TO
AMEND ARTICLE XIII -A OF THE CALIFORNIA
CONSTITUTION
WHEREAS, an initiative proposed by Howard Jarvis and the "Save Proposition 13
Committee" to amend Article XIII -A of the California Constitution (Proposition 13 of
1978) will be on the November 1984 election ballot and will be designated "Proposition
36"; and
WHEREAS, Proposition 36 would prohibit property tax levies to raise revenues for
payment of all voter approved indebtedness other than bonds and would also limit the use
of fees to raise revenue for public purposes; and
WHEREAS, other provisions of Proposition 36 would unreasonably diminish local
control of rate making for water agencies and development of alternate revenue sources
for fire agencies, as well as other public agencies, substituting the requirement of either
approval by the State Legislature or by an agency -wide election, with a two-thirds vote
in either case, for authority to make routine and necessary periodic adjustments in rates,
fees, charges, and assessments; and
WHEREAS, the Capistrano Valley Water District uses a combination of water fees,
connection fees, and other miscellaneous fees to finance its ongoing operations and
maintenance expenses, as well as the necessary water system capital improvements; and
WHEREAS, the passage of Proposition 36 would severely limit the Capistrano
Valley Water District's ability to adjust fees to provide for increased costs, levels of
service, water quality, and water system enhancements for the water service area; and
WHEREAS, the Capistrano Valley Water District includes all of the City of
San Juan Capistrano, whose citizens have adopted a General Plan for the orderly growth
of that community; and

WHEREAS, the ability to provide and maintain an adequate water supply system is
a basic and integral part of the City's General Plan; and
WHEREAS, adoption of Proposition 36 would not only destroy the integrity of the
City's General Plan but would also result in a seriously depleted ability to provide
adequate water supplies to present residents of the City and District.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the
Capistrano Valley Water District hereby finds that Proposition 36 represents a real and
substantial threat to the fiscal integrity of the Capistrano Valley Water District, which
will reduce the levels of fire protection and future water supply, and dangerously erode
the District's ability to carry out its responsibilities under the General Plan of the City
of San Juan Capistrano for the benefit of all the community.
BE IT FURTHER RESOLVED that the Board of Directors of the Capistrano Valley
Water District does hereby oppose adoption of this proposed constitutional amendment.
PASSED, APPROVED and ADOPTED this 21st day of August, 1984, by the
following vote, to -wit:
