Resolution Number OCWD NO. 4 72-3-13-4RESOLUTION NO. 72-3-13-4 RESOLUTION OF THE BOARD OF DIRECTORS OF ORANGE COUNTY WATERWORKS DISTRICT NO. 4 ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID DISTRICT ON JUNE 6, 1972, FOR THE PURPOSE OF SUBMITTING TO THE,QUALIFIED VOTERS OF SAID DISTRICT A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID DISTRICT FOR A CERTAIN DISTRICT IMPROVEMENT AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE DIRECT PRIMARY TO BE HELD ON SAID DATE The Board of Directors of Orange County Waterworks District No. 4 DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. That this Board deems it necessary that said District incur a bonded indebtedness in addition to that issued at the time of the formation of the District in the principal amount of $700,000 for the purpose of the acquisition and construction of additions to the waterworks system of the District, including a reservoir, with appurte- nances and appurtenant works, pipelines, equipment and other property useful and necessary to supply the inhabitants of the District with water and including all costs incidental to or connected with the acquisition, construction, improving and financing of the improvements and all engineering, inspection, legal and fiscal agent's fees, costs of the bond election and of the issuance of the bonds. SECTION 2. That the estimated cost of the improve- ments hereinabove stated is $800,000. 1 SECTION 3. That the amount of bonded indebtedness proposed to be incurred for said purpose is $700,000; that the maximum term the bonds to be issued shall run before maturity shall be the maximum term permitted by law, to -wit: forty (40) years from the date thereof, but said bonds may be made to mature within a lesser number of years; that the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to -wit: eight percent (8%) per annum, payable semiannually except that interest for the first year may be payable at the end of said year, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. SECTION 4. That a special election be held, and the same is hereby called to be held, in said District on the 6th day of June, 1972, for the purpose of submitting to the qualified voters of said District the proposition of incurring the said indebtedness and issuing bonds of said District therefor, in the amount and for the purpose hereinabove stated. That if the proposition for the incurring of said indebtedness so submitted receives the requisite number of votes, to -wit: a majority of the votes of the qualified voters voting on said proposition, bonds of said District in not exceeding the principal amount hereinabove stated shall be issued and sold for the purpose hereinabove set forth. -2- SECTION 5. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STANP; NEVER WITH PEN OR . (ABSENTEE BALLOTS MAYBE MARKED WITH PEN AND INK OR PENCIL.) SPECIAL ELECTION ORANGE COUNTY WATERWORKS DISTRICT NO. 4 COUNTY OF ORANGE ' TUESDAY, JUNE 6, 1972 INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES' or after the word "NO". All marks except the cross (+) are forbidden. All distin- guishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. SECTION 7. That the polls for said election shall be opened at 7:00 o'clock a.m. of the day of said election and shall remain open continuously from said time until 8:00 o'clock p.m. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. SECTION 8. That in all particulars not recited in this resolution said election shall be held and conducted in the same manner as provided by law in respect to general water district elections so far as applicable, except as provided in Chapter 2, Part 6, Division 12 of the Water Code of the State of California. SECTION 9. That the special election hereby called shall be and is hereby ordered consolidated with the state- wide direct primary to be held in said District on said date and such elections shall be held in all respects as if there were only one election and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for the special election shall be the same as those provided for said statewide direct primary. -4- SECTION 10. That notice of said election shall be given by the Clerk of the Board of Directors,in the form and manner provided by law, by publication of a copy of this Resolution once a week for two (2) successive weeks, the first publication to be at least fourteen (14) days prior to the close of registration for said election, in the COASTLINE DISPATCH, a newspaper of general cirulcation 'printed and published in the County of Orange and by posting a'copy of this Resolution in three (3) public places in the District at least ten (10) days prior to the election. No other notice of said election need be given.
