Resolution Number 11-06-30-03RESOLUTION NO. 11-06-30-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADOPTING ITS ARTICLE XIIIB APPROPRIATION LIMITATION (GANN LIMIT) FOR THE 2011/2012 FISCAL YEAR WHEREAS, the voters of California on November 6, 1979, added Article XIIIB to the State Constitution placing various limitations on the appropriation of the State and local governments; and, WHEREAS, Article XIIIB provides that the appropriation limit for the fiscal year 2011112 is calculated by adjusting the base year appropriations of fiscal year 197811979, if desired, with changes in California per capita personal income or non- residential assessed valuation and changes in City or County populations, and the recalculations of appropriation limits from the 1986/1987 fiscal year stipulated by Proposition 111; and, WHEREAS, the City reserves the right to adjust its 2011112 limit as information regarding the change in non-residential assessed valuation due to new construction is made available by the County; and, WHEREAS, the information necessary for making these adjustments is attached as Exhibit A; and, WHEREAS, the City of San Juan Capistrano has complied with all the provisions of Article XIIIB and amendments thereto per Proposition 111 in determining the appropriation limits for fiscal year 201012011. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby 1. Establish that the appropriation limit for 2011112 shall be $57,339,020; and, 2. Determine the City of San Juan Capistrano Budget Appropriation subject to the limit for fiscal year 2011112 shall be $10,955,789; and, 3. Declare the City of San Juan Capistrano Budget Appropriations in the fiscal year 2011112 do not exceed the limitations 1 6/30/2011 PASSED, APPROVED, AND ADOPTED this 30th day of June, 2011.
