Resolution Number 11-06-21-04RESOLUTION NO. 11-06-21-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA INITIATING CONSIDERATION OF A GENERAL PLAN AMENDMENT FOR A 10 -ACRE PARCEL (4 NET ACRES) IN THE WHISPERING HILLS ESTATES PLANNED COMMUNITY LOCATED ON THE NORTH SIDE OF VISTA MONTANA ABOUT 400 FEET EAST OF LA PATA AVENUE (VILLA MONTANA)(ASSESSOR PARCEL NUMBER 664-25-011) WHEREAS, Rancho San Juan Development, LLC has filed a pre -application submission for the potential development of a 100 dwelling unit, affordable housing project on an existing 10 -acre (4.0 net acres) parcel located in the Whispering Hills Estates -Rancho San Juan Planned Community; and, WHEREAS, on July 20, 2004, the City Council approved Vesting Tentative Tract Map 16634 for Whispering Hills Estates and requested that the developer prepare and submit an affordable housing project for the "4 acre remainder parcel" designated in the Comprehensive Development Plan and subsequently, on August 3, 2004 adopted Ordinance 896 approving Comprehensive Development Plan 04-01, Whispering Hills Estates to regulate land uses and establish development standards within the Planned Community; and, WHEREAS, on September 16, 2008, the City Council denied General Plan Amendment (GPA) 06-01 and Rezone (RZ) 06-01 for a proposed 163 dwelling unit, multi -family residential project with an affordable housing component on the subject 4 - acre remainder parcel based on findings that the project was inconsistent with the policies of the General Plan Land Use Element, Housing Element and Community Design Element; and, WHEREAS, Comprehensive Development Plan 04-01, Whispering Hills Estates establishes a 314 -acre residential planned community not including the 52 -acre San Juan Hills High School site and the General Plan Land Use Element's Table LU -3 establishes a "100% Very Low Density Residential Designation" for Whispering Hills Estates which allows consideration of the development of a maximum of 314 single- family detached (SFD) dwelling units; and, WHEREAS, the General Plan Land Use Element's Table LU -3 establishes a "100% Very Low Density Residential Designation" for Whispering Hills Estates which allows consideration of the development of single-family detached (SFD) dwelling units but does not expressly allow the development of multi -family dwelling units which may be permitted in the "2.4 -Medium High Density Residential (5.1-8.0 du/acre)", "2.5 -Nigh Density Residential (8.1-18.0 du/acre)", and "2.6 -Affordable Family -Senior Housing (18.1-25.0 du/acre)" General Plan land use residential designations, and, 1 6/21/2011 WHEREAS, Section 9-2.307 of the Title 9, Land Use Code of the Municipal Code provides the City Council with sole discretion to initiate consideration of all General Plan Amendments; and, WHEREAS, the proposed project has potential merit with respect to meeting the General Plan Housing Element's affordable housing production objectives established by the Southern California Association of Governments (SCAG) adopted Regional Housing Needs Assessment (RHNA) and warrants further study. NOW THEREFORE BE IT RESOLVED, that the City Council of the City of San Juan Capistrano hereby initiates consideration of a General Pian Amendment and directs to City staff to proceed with securing a General Pian Amendment (GPA) application and the required developer deposit from the applicant, and proceed with processing the General Plan Amendment (GPA) and the associated Rezone (RZ) application amending Comprehensive Development Pian 04-01, Whispering Hills Estates to include land use and development standards for the °4 -acre remainder parcel."
