A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN
AMENDMENT (GPA) STUDY PROCESS TO CHANGE THE LAND
DESIGNATION OF A PORTION OF APN 121-050-21 FROM OFFICE
RESEARCH PARK TO AFFORDABLE FAMILY / SENIOR HOUSING (APN
121-050-21)
WHEREAS, the State's Regional Housing Needs Assessment (RHNA) has
stipulated that San Juan Capistrano accommodate 410 units for low and very -low income
households by 2014; and,
WHEREAS, the City of San Juan Capistrano (the "City") with the assistance
of the San Juan Capistrano Community Redevelopment Agency, endeavors to meet the
RHNA goals; and,
WHEREAS, the 2008 Housing Element identified the vacant City owned site
at the northwest corner of Camino Capistrano and Junipero Serra Road, an approximate 2
acre portion of APN 121-050-21, as suitable for workforce housing; and,
WHEREAS, the Agency's goals and objectives under the Redevelopment
Plan is to provide decent, safe and sanitary housing for persons of very -low and lower
income means, pursuant to the Redevelopment Plan and the California Community
Redevelopment Law (California Health and Safety Code Section 33000 et seq.); and
WHEREAS, the Agency has retained professional consultant services for
land planning and a site suitability analysis for residential use, which revealed that the site
can accommodate a minimum of 25 residential units.
WHEREAS, Section 9-2.307 entitled "Amendment of the General Plan" of
Title 9, Land Use Code grants the City Council sole authority to initiate consideration of
General Plan Amendments; and,
WHEREAS, the Housing Advisory Committee has reviewed the proposed
land planning and has adopted Resolution No. 09-05-27-01 supporting the proposed
project and encouraging the land use change; and,
WHEREAS, the Agency has requested that the City Council initiate an
amendment to the General Plan Land Use Element by amending the designation of the
Site from "General Commercial" to "Affordable Family / Senior Housing"; and,
WHEREAS, the amended land use designation would allow for the provision
of workforce housing for very low and lower income persons on the Site; and
WHEREAS, the amended land use designation will assist the City in meeting
the RHNA goals by providing for the development and operation of a Workforce Housing

Development; and
WHEREAS, the voters of the City have approved a ballot measure which
provides that up to five percent of the housing units constructed in the City may be low rent
housing projects as defined under Article XXXIV of the State Constitution; and
WHEREAS, in the event that the Housing Development is constructed and
restricted to very low and lower income tenants, less than five percent of the housing units
constructed in the City will be low rent housing projects as defined under Article XXXIV of
the State Constitution; and
WHEREAS, the initiation of a General Plan Amendment (GPA) constitutes a
planning study and is exempt from review under the provisions of California Environmental
Quality Act Guidelines (Section 15061 (b)(3)) due a GPA having no significant effect on the
environment; and,
WHEREAS, the proposed project provides the City with the opportunity to
address the General Plan's Land Use and Housing Elements goals and objectives related
to land use and housing issues.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby initiate consideration of a General Plan Amendment
study process for a two acre portion of APN 121-050-21 to change land use designation
from Office Research Park to Affordable Family f Senior Housing.
