Resolution Number 08-08-19-01RESOLUTION NO. 08-08-19-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DENYING AN APPEAL AND AFFIRMING THE CONDITIONAL APPROVAL BY THE CULTURAL HERITAGE COMMISSION OF SITE PLAN REVIEW 07-001 FOR LANDSCAPE AND HARDSCAPE IMPROVEMENTS AT 26801 ORTEGA HIGHWAY (MISSION RECTORY GARDEN)(APN 124-180-06) WHEREAS, on July 19, 2007, the City of San Juan Capistrano issued a Stop Work Notice at Mission San Juan Capistrano located at 26801 Ortega Highway for un -permitted construction of structural, electrical, plumbing and piping work in the project area; and WHEREAS, on July 19, 2007, the City of San Juan Capistrano transmitted a letter to Mission San Juan Capistrano detailing the remedies required to address the Stop Work Order, including the requirement for submittal of a site plan review application in accordance with Section 9-2.327 of the City Land Use Code; and WHEREAS, on August 27, 2007, a site plan review application was filed by Mission San Juan Capistrano, 26801 Ortega Highway, San Juan Capistrano, CA 92675; and WHEREAS, pursuant to Section 15063 and 15064 of the California Environmental Quality Act (CEQA) Guidelines, the Planning Department prepared an initial study; has issued a mitigated negative declaration pursuant to Section 15070 of those Guidelines; has caused a Notice of Mitigated Negative Declaration to be posted pursuant to Section 15072 of those Guidelines; has otherwise complied with all applicable provisions of CEQA; and all mitigation measures have been included with the conditions for the project; and WHEREAS, the Cultural Heritage Commission considered the environmental determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA), and considered all project environmental documentation and technical studies; and, WHEREAS, the Cultural Heritage Commission conducted a noticed public meeting on October 9 and November 27, 2007, and January 22, March 25 and May 29, 2008, pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Administrative Policy 409, and Planning Department Policy 510 to consider public input on the proposed project; approved the Mitigated Negative Declaration; and conditionally approved Site Plan Review 07-001; and WHEREAS, on June 13, 2008, Miles -Chen Law Group representing the "Juaneho Band of Mission Indians, Acjachemen Nation (The Belardes Group)" filed an appeal of the Cultural Heritage Commission's approval of SPR 07-001; and ' WHEREAS, on July 28, 2008, the City issued a building permitto the Mission forthe proposed demolition of two structures at the Mission: the fireplace and the kitchen counter Page 1 of 7 08-19-2008 1 592703.1 constructed in approximately July 2007. The demolition work was completed, and a final inspection was conducted and approved by City personnel on August 6, 2008; and WHEREAS, the City Council conducted a duly -noticed public hearing on August 19, 2008 pursuant to the provisions of Section 9-2.335 of Title 9, Land Use Code, Administrative Policy 409, and Planning Department Policy 510 to consider the project de novo and hear public testimony. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find as follows regarding the appeal of SPR 07-001: The City Council upholds the Cultural Heritage Commission approval of the Mitigated Negative Declaration and approves the Mitigated Negative Declaration. The City Council finds on the basis of the whole record before it (including the initial study, any comments received, and other information), that there is no substantial evidence that the project will have a significant impact on the environment and that the Mitigated Negative Declaration reflects the City's independent judgment and analysis. In addition, the City Council adopts the Mitigation, Monitoring and Reporting Program, attached as Exhibit A hereto and incorporated herein by this reference. 2. The project approved by the Cultural Heritage Commission is consistent with the General Plan Cultural Resources, Conservation and Open Space, and Land Use Elements because: (a) The project is consistent with the General Plan Land Use Element Public & Institutional land use designation because it is consistent with the existing use of the site. (b) The project, as conditioned to be modified in accordance with mitigation measures, will be compatible with the historic character and contemplative nature of the historic cemetery and will ensure its future preservation and protection. 3. The project approved by the Cultural Heritage Commission complies with all applicable provisions of Title 9 of the San Juan Capistrano Municipal Code because the project meets all development standards of the Public & Institutional zoning district except the side yard setback standards for two of the structural elements: the fireplace and the kitchen counter. These two elements are required to be removed by the mitigation measures. Through a separate demolition permit request by the Mission that was approved by the City, these two elements have been removed and a final inspection of said removal has been approved by the City. Thus, the project complies with all setback standards. Page 2 of 7 08-19-2008 592703.1 4. The project approved by the Cultural Heritage Commission is consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties because: (a) The project, as conditioned to be modified in accordance with mitigation measures and as modified through the recent removal of the fireplace and kitchen counter features to the top of their foundations, is consistent with Standards 1, 2, 3 and 9 of the Rehabilitation standards and Standards 4, 5, 6 and 7 do not apply. (b) The project is not consistent with Standards 8 and 10 of the Rehabilitation standards, but appropriate mitigation measures are included to reduce impacts to a less than significant level with respect to archaeological resources. The purpose of the MMRP is to ensure that the proposed project complies with all applicable environmental mitigation and permit requirements. Mitigation measures for the project have been adopted by the City's approving body in conjunction with the adoption of a Mitigated Negative Declaration (MND). Those adopted mitigation measures are integrated into this MMRP. Within this document, approved mitigation measures are organized and referenced by subject category (e.g. Aesthetics, Air Quality, Noise, Hydrology & Water Quality, etc.) and include those for al! topical areas evaluated in the MND for the project. Each mitigation measure is provided with a numerical reference. The mitigation measures also include information on the method and timing of verification and the responsible party that will ensure that each measure is implemented. Public Resources Code Section 21081.6 requires the Lead Agency, for each project that is subject to the California Environmental Quality Act (CEQA), to monitor performance of the mitigation measures included in any environmental document to ensure that implementation does, in fact, take place. The City is the designated lead agency for the MMRP and is responsible for review of any monitoring reports, enforcement actions, and document disposition.
