Resolution Number 08-07-15-071 RESOLUTION NO. 08-07-15-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 4, 2008, FOR THE SUBMISSION TO THE VOTERS A QUESTION RELATING TO A BOND MEASURE FOR THE PURPOSE OF PRESERVING OPEN SPACE WHEREAS, a consolidated general November 4, 2008, has been called by September 18, 2007 (the "Election"); and municipal election to be held on Tuesday, Resolution No. 07-09-18-02, adopted on WHEREAS, the City Council adopted Resolution No. 07-09-18-03, on September 18, 2007, requesting the Board of Supervisors of the County of Orange to render specified services to the City related to the conduct of the general municipal election; and WHEREAS, the City Council desires to submit to the voters a measure seeking approval to incur bonded debt for the purpose of preserving open space, natural areas, creeks, historic lands, hillsides, trails, wildlife, and air and water quality. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the laws of the State of California relating to General Law Cities, there is called and ordered to be held in the City of San Juan Capistrano, California, on Tuesday, November 4, 2008 a General Municipal Election for the purpose of submitting to the voters at the election a measure seeking approval to incur bonded debt for the purpose of preserving open space, natural areas, creeks, historic lands, hillsides, trails, wildlife, and air and water quality. SECTION 2. That the City Council, pursuant to its right and authority, does order submitted to the voters at the General Municipal Election the following question: Page 1 of 3 07-15-2008 Open Space, Natural Areas, and Clean Water Protection and Preservation Measure Many residents came to San Juan Capistrano for Y its unique open space, natural beauty and history. Yes on this measure will help preserve and E S enhance our natural areas, creeks, historic lands, hillsides, trails, recreation, wildlife, and air and water quality; and reduce traffic congestion. For these purposes, shall the City of San Juan Capistrano issue 30 million dollars in bonds with guaranteed annual independent financial audits, N public review of expenditures, and no funds used O for city administrators' salaries? SECTION 3. That the ballots to be used at the electron shall be in form and content as required by law. SECTION 4. That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 5. That the polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in § 14401 of the Elections Code of the State of California. SECTION 6. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 7. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
