' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, AMENDING RESOLUTION 06-02-07-05
APPROVING THE SCHEDULE OF FEES AND CHARGES FOR CITY
SERVICES
WHEREAS, the City provides various programs and services for the benefit of
certain individuals and/or entities that do not benefit the general public; and,
WHEREAS, the City incurs costs to provide these specific programs and services to
these individuals and/or entities; and,
WHEREAS, the City has developed certain fees and charges to be charged directly
to the parties requesting these specific services, participating in these programs or
incurring these costs; and
WHEREAS, the City updated these fees and charges July 17, 2007 in an effort to
assure proper cost recovery, comparability with the surrounding communities and meet
the needs of our community; and,
WHEREAS, fees and charges for City services were combined into one
comprehensive fee schedule with annual increases each July 1, based on the Consumer
Price Index (CPI) — All Urban Consumers for the Los Angeles -Riverside -Orange County,
CA area from October to October of each year tied to a cost index to assure that fees
continue at appropriate levels; and,
WHEREAS, the City desires to add certain fees and charges in order to generate
the necessary revenue to operate City programs and services.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby adopt the Schedule of Fees and Charges as set forth in
Exhibits A through J, attached and incorporated herein by reference.
1. Establish the Schedule of Fees and Charges. Approve the updated fees
and charges as outlined in Exhibits A through J.
2. Establish a Cost Index for the Annual Update of Fees and Charaes.
Approve and adopt the use of the Consumer Price Index (CPI) —All Urban Consumers for
the Los Angeles -Riverside -Orange County, CA area from October to October of each year,
as the cost index for these fees and charges, except for Developer Fees and those items
that are governed by a separate agreement or otherwise noted in Exhibits A through J.
' Developer fees are escalated from October to October of each year using the Engineering
News Record (ENR) index for the Los Angeles area. The City Manager is authorized to

administratively adjust the fees and charges each July 15`, up to an amount equal to the
above referenced cost indices without further city Council review.
3. Effective Date. Determine that the updated fees and charges shall take
effect sixty (60) days after the adoption of this resolution.

Developer Deposit Applications and Other Special Deposits
1. Schedule of Hourly Rates (City Staff). All staff assigned to Developer Deposit Applications as primary or
supporting technical staff shall charge actual hours expended on a project which has been assigned a developer
deposit or other special deposit account. Hourly rates of City staff positions shall be determined from the
current salary schedule adopted by City Council. Overhead costs shall be added to the stairs hourly rate.
Overhead shall be calculated and published annually by the Administrative Services Department in accordance
with the Office of Management and Budget Circular A-87 (Cost Principles for State and Local Governments).
2. Schedule of Hourly Rates (Outside Consultants). Consultants' actual cost shall be charged against the
developer deposit account. Consultant contracts are determined by the Planning Director and agreement
executed by the City Manager. For those applications where an outside consultant is assigned to manage a
project in -lieu of city staff or when a deposit is taken for special purposes pursuant to an agreement with the
City, an administration fee equivalent to ten percent (10%) of the outside consultant changes shall be charged
to the applicable developer deposit or other special deposit account.
3. Developer Deposit Application (initial Deposit). The following application are subject to processing under the
provisions of the Developer Deposit System. The Initial Deposit for each application is set forth below. The
Planning Director may adjust the initial deposit for a given project applicant upon a determination that the
initial deposit will be substantially about or below the amount estimated to complete the project review.
4. Incidental Costs. All incidental costs associated with the project including, but not limited to, postage,
printing, mailing, and publication of notices shall be charged against the developer deposit or other special
deposit account.
The fees and/or deposits listed below are required to be paid to any processing of a development application.
The initial deposits are intended to provide funding for processing of an application. If the deposited funds are
depleted during the processing of the application, additional funds will be required by the City. If the requested
fund are not received, processing of the development application may be delayed or interrupted pending receipt
of the funds. Any unused funds at project completion will reimbursed to the applicant.

1 Per the Uniform Administrative Code, Section 304, the determination of
value or valuation under any of the provisions stipulated in the codes shall
be made by the Building Official. The value to be used in computing the
building permit and plan review fees shall be the total value of all
construction made for which the permit is issued as well as all finish work,
painting, roofing, electrical, plumbing, heating, air-conditioning, elevators,
fire extinguishing systems, and any other permanent equipment.
Note: Section 105 Definition of Valuations or Value, as applied to a
building and its building services equipment, shall be the estimated cost to
replace the building and its building service equipment in kind, based on
current replacement costs.
The unit costs/values for general improvements defined in the "Building
Valuation Data Schedule" (Table 3-A.1) are for projects employing
conventional construction with average to good quality.

' The purpose and intent of the San Juan Capistrano Land Use Management
Code is to: a) "provide precise land use regulation as a means of
implementing the General Plan," and b) "provide for the utilization of
innovative land planning and building design to achieve high quality,
variety, flexibility and efficiency in the design of residential, commercial,
industrial and other development projects." The City employs numerous
committees, boards, and commissions to serve as a mechanism to facilitate
this endeavor.
This renders unique, creative, sophisticated and complex propositions.
Due to the nature, type, shape and size of the sites available in San 3uan
Capistrano located in seismic zone 4, and the existence of moderate to
highly expansive soils, special architectural and/or structural features are
often employed to mitigate hazardous, unstable and unusual conditions.
The Administrative Authority often requires additional plans,
specifications, details and engineered computations to substantiate the
validity and integrity of these proposals. The Building and Safety Division
defines this type of construction as complex construction with good to
excellent quality. A regional modifier of 110% is used to adjust the unit
' cost to reflect a reasonable and accurate assessment of local cost.
An additional 5 percent shall be imposed when special inspections as
defined in Section 306 of the Uniform Administrative Code are required.
The surcharge is designed to recover cost associated with screening
special/deputy inspectors, verification of credentials, reviewing field report
and daily memos, communicating with testing agencies and inspection
monitoring.
U.B.C. Section 2313 Earthquake Regulations requires each structure to be
designated as being structurally regular or irregular. Regular structures
have no significant physical discontinuities in plan or vertical configuration
or in their lateral force -resisting systems such as irregular structures.
Structures having one or more of the features listed in Table No. 23-M of
the Uniform Building Code shall be designated as having a vertical
irregularity. Structures having one or more of the features listed in Table
No. 23-N shall be designated as having a plan irregularity.

A structure designated as having a vertical irregularity and/or a plan —
irregularity shall be defined as an irregular structure. An additional
surcharge is imposed to recover the cost associated with expending extra
time/resources on complex, intricate structures defined as irregular to
verify conformance with approved plans to ensure adherence with the
codes and regulations of the City of San Juan Capistrano.
