A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, CONFIRMING THE LEVY OF
THE FISCAL YEAR 2007/2008 ASSESSMENTS FOR THE
LANDSCAPE AND OPEN SPACE MAINTENANCE DISTRICTS IN
THE CITY OF SAN JUAN CAPISTRANO
WHEREAS, the CITY COUNCIL of the CITY OF SAN JUAN CAPISTRANO did,
on the 15th day of May, 2007, adopt Resolution No. 07-05-15-02 declaring its intention
to levy assessments for fiscal year 2007/2008 and approving the Combined Engineer's
Reports for the San Juan Capistrano Open Space and Landscape Maintenance
Districts; and,
WHEREAS, following notice duly given in accordance with law, the CITY
COUNCIL of the CITY of SAN JUAN CAPISTRANO has held a full and fair public
hearing regarding the levy and collection of the proposed assessments within the Open
Space Districts and Landscape Maintenance Districts for fiscal year 2007/2008 to pay
for the costs and expenses of the improvements described in the Combined Engineer's
Reports for the San Juan Capistrano Open Space and Landscape Maintenance
Districts; and,
' NOW, THEREFORE, BE IT RESOLVED that the CITY COUNCIL of the CITY of
SAN JUAN CAPISTRANO confirms the assessments set forth in Exhibit "A" for the San
Juan Capistrano Open Space and Landscape Maintenance Districts as filed, and
authorizes the assessments to be sent to the County of Orange Auditor -Controller for
collection at the same time and in the same manner as the County taxes are collected.

DEFINITION & GENERAL INFORMATION
Assessment District
An Assessment District is a financing mechanism under The California Streets and
Highways Code, Division 10 and 12 which enables cities, counties, and special districts
organized for the purpose of aiding in the development or improvement to, or within the
district, to designate specific areas as Assessment Districts, with the approval of a majority
of the landowners based on financial obligations, and allows these Districts to collect funds
to finance maintenance effort or construct improvements. Assessment Districts help each
property owner pay a fair share of the costs of such improvements or maintenance
obligation over a period of years at reasonable rates and insures that the cost will be
spread to all properties that receive direct and special benefit by the improvements
constructed or maintained.
"Assessment" means any levy or charge by an agency upon real property that is based
upon the special benefit conferred upon the real property by a public improvement or
service that is imposed to pay the capital cost of the public improvement, the maintenance
and operation expenses of the public improvement, or the cost of the service being
provided. "Assessment" includes, but is not limited to, "Special Assessment," "Benefit
Assessment," and "Maintenance Assessment."
District Formation
' A petition is signed by landowners within a specified area. The petition is given to the
Agency that would be forming the district. If the petition is accepted, a Resolution of
Intention is adopted stating that the agency intends to form an assessment district. The
resolution states name of district, type of facilities to be financed or maintained, set the
time and place for the public hearing, and orders the preparation of an engineer's report.
Proposition 218 ballots are mailed to each property owner within the district. If the majority
vote in favor for formation, and public hearing is concluded, the district is formed.

and in accordance with the Resolution of Initiation adopted by the Council of the City of San
Juan Capistrano, County of Orange, State of California, in connection with the proceedings for:

The facilities to be maintained and serviced include landscaping for the specific Landscape
Maintenance Districts described herein. The facilities include, but are not limited to:
landscaping, planting, shrubbery, trees, turf, irrigation systems, hardscapes, fixtures and
appurtenant facilities in public rights-of-way, parkways, slopes and dedicated easements within
the boundaries of said Landscape Maintenance Districts.
' The facilities are specifically described as follows:
Capistrano Rale Landscape Maintenance District (Tract 11094)
• West side of Rancho Viejo Road
• South side of Highland Drive
• Center median to Royale Drive
• South side perimeter of Tract
Capistrano Royale Landscape Maintenance District (Tract 11095)
• Northeast of Imperial Drive, Lot 29
Belford Terrace Landscape Maintenance District (Tract 9382)
• Ortega Highway right-of-way, exclusive of the street section to the northerly curb, along the
southerly boundary of Tract 9382; the slope area along the northerly right-of-way of Ortega
Highway, lying southerly of the block wall, being a portion of Lots 1 through 8, inclusive.
• The slope area along the easterly right-of-way of Belford Terrace, including the portion of
the right-of-way easterly of the 5 foot wide sidewalk, bounded on the south by Ortega
Highway and on the north by Rosedale Drive, being a portion of Lot 1.
• The southerly 10 feet of the 56 foot right-of-way of Rosedale Drive, bounded on the west by
' Belford Terrace and on the east by a line parallel with and distant 65 feet from the centerline
of Belford Terrace.

• The remanufactured slopes lying within Lots 62, 63 and 64, excepting therefrom the portion
of the remanufactured slope wlthin Lot 62 lying southwesterly of the southwesterly line of the
150 foot wide easement to San Diego Gas and Electric Company, as shown on the map of
Tract 9382.
Maintenance means the furnishing of services and materials for the ordinary and usual
maintenance, operation and servicing of the landscaping and appurtenant facilities, including
repair, removal or replacement of all or part of any of the landscaping or appurtenant facilities;
providing for the life, growth, health and beauty of the landscaping, including cultivation,
irrigation, trimming, spraying, fertilizing and treating for disease or injury; the removal of
trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting and painting of
walls and other improvements to remove or cover graffiti.
Servicing means the furnishing of water for the irrigation of the landscaping and the
maintenance of any of the public lighting facilities or appurtenant facilities and the furnishing of
electric current or energy, gas or other illuminating agent for the public lighting facilities, or for
the lighting or operation of landscaping or appurtenant facilities.
The plans and specifications for the improvements, showing and describing the general nature,
location and the extent of the improvements, are on file in the office of the Director of Public
Works and are incorporated herein by reference.

' PART B
ESTIMATE OF COST
REPORT
The 1972 Act provides that the total cost of installation, construction, operation, maintenance
and servicing of the improvements described in Part A can be recovered by the Districts.
Maintenance can include the repair and replacement of existing facilities. Servicing can include
electrical and associated costs from a public utility. Incidental expenses, including
administration of the Districts, engineering fees, legal fees, printing, posting and mailing of
notices, and all other costs associated with the annual assessment process can also be
included.
The estimated costs of the operation, servicing and maintenance of the improvements for Fiscal
Year 2007-08, as described in Part A, are summarized herein and described below.
The 1972 Act requires that a special fund be set up for the revenues and expenditures of the
Districts. Funds raised by assessment shall be used only for the purpose as stated herein. A
contribution to the District by the City may be made to reduce assessments, as the City Council
deems appropriate. Any balance or deficit remaining on July 1 must be carried over to the next
fiscal year.

METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of
1972, permits the establishment of assessment districts by Public Agencies for the purpose of
providing certain public improvements which include operation, maintenance and servicing of
street lights, traffic signals, and landscaping.
Section 22573 of the Landscape and Lighting Act of 1972 requires that maintenance
assessments be levied according to benefit rather than according to assessed value. This
Section States:
"The net amount to be assessed upon lands within an assessment district may
be apportioned by any formula or method which fairly distributes the net amount
among all assessable lots or parcels in proportion to the estimated benefit to be
received by each such lot or parcel from the improvements.
The determination of whether or not a lot or parcel will benefit from the
improvements shall be made pursuant to the Improvement Act of 1911 (Division
7 (commencing with Section 5000)) (of the Streets and Highways Code, State of
California]."
The Act permits the designation of benefit zones within any Individual assessment district if "by
reasons or variations in the nature, location, and extent of the improvements, the various areas
will receive different degrees of benefit from the improvement' (Sec. 22547). Thus, the 1972
Act requires the levy of a true "benefit assessment' rather than a "special tax." Excepted from
the assessment would be the areas of all publicly owned property in use in the performance of a
public function. Utility rights-of-way are also exempt from assessment.
SPECIAL BENEFIT DETERMINATION
Street Landscaping, Slopes and Greenbelts. Trees, landscaping, hardscaping and
appurtenant facilities, if well maintained, provide beautification, shade and enhancement of the
desirability of the surroundings, and therefore increase property value. In Parkways and Land
Values, written by John Nolan and Henry V. Hubbard in 1937, it is stated:
"... there is no lack of opinion, based on general principals and experience and
common sense, that parkways do in fact add value to property, even though the
amount cannot be determined exactly.... Indeed, in most cases where public
money has been spent for parkways the assumption has been definitely made
that the proposed parkway will show a provable financial profit to the City. It has
been believed that the establishment of parkways causes a rise in real estate
values throughout the City, or in parts of the City,..."
It should be noted that the definition of "parkways" above may Include the roadway as well as
the landscaping alongside the roadway.

The ongoing maintenance and operation of the street landscaping, slopes and greenbelts within
the individual Landscape Maintenance Districts provides beautification and enhancement to the
areas that result in a special benefit to the parcels within the tracts adjacent to the
improvements. If these landscaped areas were not properly maintained, the tracts would be
blighted.
Capistrano Royale. The Capistrano Royale Landscape Maintenance District was formed in
1985 and Included all parcels within Tracts 10103, 11093, 11094, and 11095. Subsequent to
District formation, a large portion of this area was included in a Homeowner's Association (HOA)
that took over most of the landscaping responsibilities for the facilities included in this District.
The improvements currently being maintained by the District are shown in Part A of this report.
The parcels within the HOA are no longer included in the District. Eleven parcels, lots 1-10 of
Tract 11094 and lot 29 of tract 11095, which are not a part of the HOA, remain in the District
and are assessed for the maintenance of the District landscaping.
The parcels of land remaining in the District are single family residential (SFR) lots, with each of
these lots benefiting equally from the improvements being maintained. Therefore, the costs
associated with the landscaping within and directly adjacent to the tract, as shown In Part B of
this report will be apportioned equally to the residential lots. The table below summarizes the
assessment apportionment for the District.

' Belford Terrace. The Belford Terrace Landscape Maintenance District was formed in 2002 to
fund construction (a 3 -year program) and ongoing operation and maintenance of the street
landscaping, slopes and greenbelts, as Identified in Part A of this report, which provide
beautification to the areas that result in a special benefit to the parcels within the tract adjacent
to the improvements.
The parcels of land in the District are single family residential (SFR) lots, with each of these lots
benefiting equally from the improvements being maintained. Therefore, the costs associated
with the landscaping within and directly adjacent to the tract, as shown in Part B of this report,
will be apportioned equally to the residential lots. The table below summarizes the assessment
apportionment for the District.

" The maximum annual maintenance assessment per lot will be increased each year by the
annual change in the Consumer Price Index (CPI), All Urban Consumers, for the Los
Angeles, Riverside and Orange County Areas. The actual assessments levied in any fiscal
' year will be as approved by the City Council and may not exceed the maximum assessment
rate without receiving property owner approval for the increase. The change in CPI between
February 2006 and February 2007 is 3.5%.

Capistrano Landscape Maintenance Districts is shown on the last equalized Property Tax Roll
of the Assessor of the County of Orange, which by reference is hereby made a part of this
report. This list is keyed to the Assessor's Parcel Numbers as shown on the Assessment Roll
on file in the Office of the City Clerk of the City of San Juan Capistrano.

' Assessment District
An Assessment District is a financing mechanism under The California Streets and Highways
Code, Division 10 and 12 which enables cities, counties, and special districts organized for
the purpose of aiding in the development or improvement to, or within the district, to
designate specific areas as Assessment Districts, with the approval of a majority of the
landowners based on financial obligations, and allows these Districts to collect funds to
finance maintenance effort or construct improvements. Assessment Districts help each
property owner pay a fair share of the costs of such improvements or maintenance obligation
over a period of years at reasonable rates and insures that the cost will be spread to all
properties that receive direct and special benefit by the improvements constructed or
maintained.
"Assessment" means any levy or charge by an agency upon real property that is based upon
the special benefit conferred upon the real property by a public improvement or service that is
imposed to pay the capital cost of the public improvement, the maintenance and operation
expenses of the public improvement, or the cost of the service being provided. "Assessment'
includes, but is not limited to, "Special Assessment," 'Benefit Assessment," and
"Maintenance Assessment."
District Formation
A petition is signed by landowners within a specified area. The petition is given to the Agency
that would be forming the district. If the petition is accepted, a Resolution of Intention is
adopted stating that the agency intends to form an assessment district. The resolution states
' name of district, type of facilities to be financed or maintained, set the time and place for the
public hearing, and orders the preparation of an engineer's report. Proposition 218 ballots are
mailed to each property owner within the district. If the majority vote in favor for formation,
and public hearing is concluded, the district is formed.

Pursuant to Chapter 2.5 of Division 1 of Title 5 of the Government Code of the State of
California, and in accordance with the Ordinances adopted by the Council of the City of San
Juan Capistrano, County of Orange, State of California, in connection with the proceedings for:

Herein after referred to as the "Assessment Districts" or "Districts', I, Nasser Abbaszadeh, P.E.,
the duly appointed ENGINEER OF WORK, submit herewith the "Report" consisting of six (6)
parts as follows:
PART A
' Plans and specifications for the improvements showing and describing the general nature,
location and extent of the improvements are on file in the Office of the City Clerk of the City of
San Juan Capistrano, and are incorporated herein by reference.
PART B
An estimate of the cost of the proposed improvements, including incidental costs and expenses
in connection therewith.
PART C
An assessment of the estimated cost of the improvements on each benefited lot or parcel of
land within the Assessment Districts. The Assessment Roll is filed in the office of the City Clerk
of the City of San Juan Capistrano.
PART D
The method of apportionment of assessments, indicating the proposed assessment of the total
amount of the costs and expenses of the improvements upon the several lots and parcels of
land within the Assessment Districts, in proportion to the estimated benefits to be received by
such lots and parcels.

The facilities, which have been constructed within the boundaries of the City of San Juan
Capistrano Open Space Maintenance Districts, and those which may be subsequently
constructed, will be operated, maintained and serviced as generally described as follows:

The facilities to be maintained and services include landscaping for the specific Open Space
Maintenance Districts described herein. The facilities include, but are not limited to:
landscaping, planting, shrubbery, trees, turf, irrigation systems, hardscapes, fixtures and
appurtenant facilities in public rights-of-way, parkways, slopes and dedicated easements within
the boundaries of said Open Space Maintenance Districts.
' The facilities are specifically described as follows:
Los Corraies Open Space Maintenance District (Tracts 9373 and 7654)
33,000 square feet of maintenance including:
• Lot A of Tract 7654
• Southeast corner of Camino la Ronda and La Novia Avenue
Mission Sprinas Open Space Maintenance District (Tract 8485)
0.802 acres of maintenance including:
• Ortega Highway right-of-way, exclusive of the street section to the southerly curb, along the
northerly boundary of Tract 8485; and the area lying northerly of the curved walls at the
intersection of Ortega Highway and Via Errecarte, including that area extending from the
intersection of Via Anzar and Via Errecarte to the block wall entrance, being a portion of Lot
I and Lot 74.
• The slope area along the northerly right-of-way of Calle Arroyo, including the portion of the
right-of-way of the 5 foot wide sidewalk, including the northeast side of Via Estenaga
extending from the intersection of Via Estenaga and Calle Arroyo to the intersection of Via
Estenaga and Via Ordaz, being a portion of Lots 12 through 24, Inclusive.
• The slope areas along the westerly right-of-way of Avenida Siege, including the portion of
' the right-of-way lying westerly of the 5 foot wide sidewalk, being a portion of Lots 10 through
12, inclusive.

Mission Woods Open Space Maintenance District (Tract 7673)
0.828 acres of maintenance including:
• Ortega Highway right-of-way, exclusive of the street section to the southerly curb, along the
northerly boundary of Tract 7673; and the area lying northerly of the curved walls at the
intersection of Ortega Highway and Via Cuartel, being a portion of Lot I and Lot 79.
• Lot C
• The westerly two feet, lying northerly of Lot B, being a portion of Lots 71 and 72.
• The slope area along the westerly boundary, lying southerly of Lot B and westerly of the
block wall, being a portion of Lots 44 through 52, inclusive.
• The slope area along the northerly right-of-way of Calle Arroyo, exclusive of street
intersections, lying southerly of the block wall, being a portion of Lots 32, 43, 44 and 61.
Seaview Open Space Maintenance District (Tract 9284)
2.350 acres of maintenance including:
• The remanufactured slopes within Lots 1, 6, 7, 8, 9 and 22.
• The remanufactured slope along the easterly right-of-way for Paseo Peregrino lying easterly
of the angle point in the centerline of Paseo Peregrino, being a portion of Lot 16.
Maintenance means the furnishing of services and materials for the ordinary and usual
maintenance, operation and servicing of the landscaping and appurtenant facilities, including
repair, removal or replacement of all or part of any of the landscaping or appurtenant facilities;
providing for the life, growth, health and beauty of the landscaping, including cultivation,
irrigation, trimming, spraying, fertilizing and treating for disease or injury; the removal of
trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting and painting of
walls and other improvements to remove or cover graffiti.
Servicing means the furnishing of water for the irrigation of the landscaping and the
maintenance of any of the public lighting facilities or appurtenant facilities and the furnishing of
electric current or energy, gas or other illuminating agent for the public lighting facilities, or for
the lighting or operation of landscaping or appurtenant facilities.
The plans and specifications for the improvements, showing and describing the general nature,
location and the extent of the improvements, are on file in the office of the Director of Public
Works and are incorporated herein by reference.

ESTIMATE OF COST
The estimated costs of the operation, servicing and maintenance of the improvements for Fiscal
Year 2007-08, as described in Part A, are summarized herein and described below.
Funds raised by assessment shall be used only for the purpose as stated herein. A contribution
to the District by the City may be made to reduce assessments, as the City Council deems
appropriate. Any balance or deficit remaining on July 1 must be carried over to the next fiscal
year.

METHOD OF APPORTIONMENT OF ASSESSMENT
BENEFIT ANALYSIS
Street Landscaping, Slopes and Greenbelts. Trees, landscaping, hardscaping and
appurtenant facilities, if well maintained, provide beautification, shade and enhancement of the
desirability of the surroundings, and therefore increase property value. In Parkways and Land
Values, written by John Nolan and Henry V. Hubbard in 1937, it is stated:
-. there is no lack of opinion, based on general principals and experience and
common sense, that parkways do in fact add value to property, even though the
amount cannot be determined exactly.... Indeed, in most cases where public
money has been spent for parkways the assumption has been definitely made
that the proposed parkway will show a provable financial profit to the City. It has
been believed that the establishment of parkways causes a rise in real estate
values throughout the City, or in parts of the City,..."
It should be noted that the definition of "parkways" above may include the roadway as well as
the landscaping alongside the roadway.
The ongoing maintenance and operation of the street landscaping, slopes and greenbelts within
the individual Open Space Maintenance Districts provides beautification and enhancement to
' the areas that result in a special benefit to the parcels within the tracts adjacent to the
improvements. If these landscaped areas were not properly maintained, the tracts would be
blighted.
The included tracts of land have been subdivided into Single Family Residential (SFR) lots, with
each of these lots benefiting equally from the improvements being maintained. Therefore, the
costs associated with the landscaping within and directly adjacent to each tract, as shown in
Part B of this report, will be apportioned equally to the residential lots within each tract. The
table below summarizes the assessment apportionment by District.

A list of names and addresses of the owners of all parcels within the City of San Juan
Capistrano Open Space Maintenance Districts is shown on the last equalized Property Tax Roll
of the Assessor of the County of Orange, which by reference is hereby made a part of this
report. This list is keyed to the Assessor's Parcel Numbers as shown on the Assessment Roll
on file in the Office of the City Clerk of the City of San Juan Capistrano.
