A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, RESCINDING RESOLUTION NO. 06-09-19-
06 AND ACCEPTING THE REVISED IRREVOCABLE OFFER TO CONVEY
EASEMENT FOR CALLE ROLANDO STREET AND HIGHWAY PURPOSES
WHEREAS, an "Irrevocable Offer to Convey Easement" for street and highway
purposes was recorded with the County Recorder's Office on September 24, 1976 by
property owners of Assessor's Parcel Nos. 668-421-01, 668-421-02, 668-421-03,668-421 -
04,
68-421-03,668-421-
04, 668-421-05, 668-421-06, and 668-421-07 in favor of the City of San Juan Capistrano;
and,
WHEREAS, on September 19, 2006, the City Council of the City of San Juan
Capistrano adopted Resolution No. 06-09-19-06 accepting an "Irrevocable Offerto Convey
Easement" for Calle Rolando and directed the City Clerk to record the resolution with the
Orange County Recorder's Office; and
WHEREAS, the City of San Juan Capistrano's acceptance of the "Irrevocable Offer
to Convey Easement" was recorded with the Orange County Recorder's Office on October
11, 2006; and
WHEREAS, in preparing the final street improvement plans for Calle Rolando, it was
discovered that the legal description contained an error in the location of the Calle Rolando
right-of-way; and,

WHEREAS, the City desires to rescind Resolution No. 06-09-19-06 and accept a
revised "Irrevocable Offer to Convey Easement" correcting the legal description and
location of the right-of-way before proceeding with the construction of the Calle Rolando
street improvements; and,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby rescind Resolution No. 06-09-19-06 and does hereby accept
the "Irrevocable Offer to Convey Easement" attached as Exhibit A, and incorporated herein
by reference, for Calle Rolando for street and highway purposes.
The City Clerk is hereby directed to file and record this resolution with the County of
Orange Recorder's Office.

It is mutually understood and agreed that upon such acceptance by said City, the City shall
mail or deliver a copy of its resolution of acceptance to the then owners at the address
shown on the latest secured assessment roll in the County where said property is located.

CAPISTRANO, CALIFORNIA, ACCEPTING AN IRREVOCABLE OFFER OF
DEDICATION FOR STREET AND HIGHWAY PURPOSES (CALLE
ROLANDO)
WHEREAS, an "Irrevocable Offer to Convey Easement" for street and
highway purposes was executed and recorded with the County Recorders Office on
September 24,1976 by property owners of Assessor's Parcel Nos. 668-421-01, 668-421-
02, 668-421-03,668-421-04,668-421-05,668-421-06, and 668-421-07 in favor of the City
of San Juan Capistrano; and,
WHEREAS, the City Council of the City of San Juan Capistrano does hereby
wish to accept said "Irrevocable Offer to Convey Easement'.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
San Juan Capistrano does hereby accept that "Irrevocable Offer to Convey Easement
attached as Exhibit A, and Incorporated herein by reference, for street and highway
' purposes.
The City Clerk is hereby directed to file and record this resolution of
acceptance with the County of Orange Recorder's Office.
PASSED, APPROVED, AND ADOPTED this 191° day of September, 2006.
