Resolution Number 01-6-19-1039 RESOLUTION NO. 01-6-19-1 REZONE 01-04 RANCHO SAN JUAN PLANNED COMMUNITY CERTIFICATION OF MITIGATED NEGATIVE DECLARATION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA CERTIFYING ISSUANCE OF A MITIGATED NEGATIVE DECLARATION FORAN AMENDMENTTO THE RANCHO SAN JUAN PLANNED COMMUNITY GENERAL OPEN SPACE DISTRICT TO PERMIT A MAXIMUM SIX ACRE EQUESTRIAN STABLE SUBJECT OF A CONDITIONAL USE PERMIT (CITY OF SAN JUAN CAPISTRANO) Whereas, the City has initiated an amendment to the General Open Space District of the Rancho San Juan Planned Community to permit consideration of an equestrian stable on six acres of land owned by the City of San Juan Capistrano; and, Whereas, the proposed amendment has been processed pursuantto Section 9-2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project and, pursuant to Section 15070 of the CEQA Guidelines, has issued a mitigated negative declaration and caused a Notice of Negative Declaration to be posted pursuant to Section 15072 of the CEQA Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA); and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, Whereas, the Planning Commission has conducted a duly noticed public hearing to receive testimony in favor of or in opposition to the proposed mitigated negative declaration and amendment on May 22, 2001; and, Whereas, the City Council has conducted a duly noticed public hearing to receive testimony in favor of or in opposition to the proposed mitigated negative declaration and amendment on June 19, 2001. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Land Use Element which identifies the property as General Open Space which specifically provides for open space and recreation uses, and the Parks and Recreation Element 040 which also discusses and encourages the City to preserve and provide land for new equestrian facilities; and, 2. The proposed amendment will allow for the consideration of the establishment of an equestrian stable subject to approval of a conditional use permit which will have to address the mitigation measures contained in the Mitigated Negative Declaration. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano does hereby certify of issuance of a mitigated negative as attached hereto, and that any subsequent application submitted in accordance with the proposed amendment to the General Open Space District of the Rancho San Juan Planned Community that request consideration of a conditional use permit to establish an equestrian stable shall comply with all mitigation measures as set forth in this Mitigated Negative Declaration.
