RESOLUTION NO. 06-10-17-03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING AN AMENDMENT TO THE CITY'S
INVENTORY OF HISTORIC AND CULTURAL LANDMARKS BY ADDING
CERTAIN STRUCTURES WITHIN THE MISSION HILI. MISSION FLATS
NEIGHBORHOOD AND RESCINDING RESOLUTION NO. 97-11-18-1
Whereas, the Planning Department surveyed the properties within the Mission Hill -
Mission Flats neighborhoods for historic significance in conjunction with the process to
create the MRD -4000 zoning district, identifying 29 buildings for potential inclusion on the
City's Inventory of Historic and Cultural Landmarks (INCL); and,
Whereas, owners of the following properties have submitted written requests to the
City to add their buildings to the IHCL:
Ross Ranch House, 31491 La Calera Street, Assessor Parcel No. 124-212-
16; owned by David and Diane Armitage, 31491 La Calera Street, San Juan
Capistrano, CA 92675
2. Walter Congdon House (rear structure) and C.C. McCary House (front
structure), 31501 La Matanza Street, Assessor Parcel No. 124-203-23;
owned by David & Reagan Ewing, 31501 La Matanza Street, San Juan
Capistrano, CA 92675
' 3. Durnford/Marco Forster House, 31319 Andres Pico Road, Assessor Parcel
No. 124-201-24; owned by Matthew Jacob, 31319 Andres Pico Road, San
Juan Capistrano, CA 92675; and,

Whereas, the proposed request has been processed pursuant to Section 2-2.303,
Cultural Heritage Commission Duties, and City Council Policy 601; and,
Whereas, the Planning Department has reviewed the project pursuant to Section
15061 of the California Environmental Quality Act (CEQA) and will issue a Class 31
categorical exemption pursuant to Section 15331 of the CEQA Guidelines because the
project involves an action to preserve a historical resource, and has otherwise complied
with all applicable provisions of CEQA; and,
Whereas, the Cultural Heritage Commission (CHC) conducted a duly noticed public
meeting on April 25, 2006, pursuant to Section 9-2.339 of the Municipal Code and
recommended that the properties be added to the IHCL, including the new information
presented to the CHC on October 26, 2006; and,
Whereas, the City Council conducted a duly noticed public meeting on October 17,
2006, pursuant to Section 9-2.339 of the Municipal Code to consider public testimony on
the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby make the following findings:
1. The proposed amendment to the IHCL is consistent with the policies and
o6Ne-,+i-as -�fthe San Juan Ca.pnistranc General Plan specifically. the Cultural
Resources Element because the project will designate, preserve and protect
buildings of historical importance.
2. The proposed amendment to add the Durnford/Marco Forster House at
31319 Andres Pico Road to the IHCL complies with the City Council Policy
601 definition of a historic resource because the house and site:
a. Embodies the distinctive characteristics of the Spanish Colonial Revival
style.
b. Is associated with the lives of persons significant to San Juan
Capistrano's history.
3. The proposed amendment to add the Ross Ranch House at 31491 La
Calera Street to the IHCL complies with the City Council Policy 601 definition
of a historic resource because the house and site:
a. Embodies the distinctive characteristics of the Craftsman Bungalow style.
b. Is the only remaining building that, in its original location, was associated
with the historic Ross Ranch, and, thus, with events that have made a
significant contribution to the patterns of San Juan Capistrano's history.

' 4. The proposed amendment to add the Walter Congdon House (rear structure)
at 31501 La Matanza Street to the IHCL complies with the City Council
Policy 601 definition of a historic resource because the house and site:
a. Embodies the distinctive characteristics of the Minimal Traditional style.
5. The proposed amendment to add the C.G. McCary House (front structure) at
31501 La Matanza Street to the IHCL complies with the City Council Policy
601 definition of a historic resource because the house and site:
a. Embodies the distinctive characteristics and massing associated with a
building type, including the Minimal Traditional style with Modern
influences that were enhanced by the 1966 alterations which do not
detract from the original design and massing.
BE IT FURTHER RESOLVED, that, based upon the preceding findings, the City
Council of the City of San Juan Capistrano hereby adopts the Inventory of Historic and
Cultural Landmarks as outlined in Exhibit A, attached hereto and incorporated herewith.
BE IT FURTHER RESOLVED, that, pursuant to Government Code Section 5029(b),
the City Clerk is directed to forward this resolution within 90 days to the Orange County
Recorder for recordation.
BE IT FURTHER RESOLVED, that Resolution No. 97-11-18-1 is hereby rescinded.

INVENTORY OF HISTORIC AND CULTURAL
LANDMARKS (IHCL)

The Inventory of Historic and Cultural Landmarks (INCL) consists of a list of structures and sites
within the City that have been deemed historically and/or culturally significant, at a local level, due to
their architectural style and condition; association with historic persons; and/or association with
historic event(s). Structures and sites listed on the IHCL require City discretionary review and
approval of rehabilitation and/or site development plans prior to issuance of any grading or building
permit. Private structures listed on the IHCL are potentially eligible for "Mills Act" contracts with the
City, which can provide a marginal reduction in property tax liability in exchange for commitments to
maintain such structures in their original condition and/or rehabilitate them in a historically
appropriate manner.
