CVWD 00-8-1-1 ACCEPTANCE OF PUBLIC WATER FACILITIES AND RELEASE OF BONDS - TRACT 13866 (TAYLOR WOODROW HOMES, INCJSAN JUAN HILLS ESTATE A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CAPISTRANO VALLEY WATER DISTRICT, ACCEPTING PUBLIC WATER FACILITIES AND EASEMENTS AND AUTHORIZING THE RELEASE OF CORRESPONDING WATER BONDS - TRACT 13866 (TAYLOR WOODROW HOMES, INCJSAN JUAN HILLS ESTATES) WHEREAS, on July 3, 1990, the Capistrano Valley Water District entered into an Agreement for Construction of Water Facilities with the Lusk Company, which provided for the construction of certain public water improvements within Tract 13866; and, WHEREAS, at their meeting of October 3, 1995, the Board of Directors approved the transfer of Assignment Agreement and Bond Substitution from the Lusk Company to Glendale Federal Bank; and, WHEREAS, at their meeting of March 5, 1996, the Board of Directors approved the transfer of Assignment Agreement and Bond Substitution from Glendale Federal Bank to Taylor Woodrow Homes, Inc.; and, WHEREAS, the public water improvements were constructed in compliance with District standards and specifications and are ready for District acceptance; and, WHEREAS, in conjunction with the acceptance of the public water improvements, an easement is to be dedicated to Capistrano Valley Water District; and, WHEREAS, the owners of said real property have, upon request by the Capistrano Valley Water District, granted the necessary easement at no cost to the District; and, WHEREAS, Taylor Woodrow Homes, Inc., has requested that the Capistrano Valley Water District determine that the public water improvements within Tract 13866 are completed and the corresponding surety provided by The American Insurance Company, Bond Number 11133221728, in the amount of $679,000 be released accordingly. NOW, THEREFORE, BE IT RESOLVED, by the Capistrano Valley Water District Board of Directors, as follows: -1- 205 F SECTION 1. The public water improvements required to be performed by said developer have been completed. Resolution. SECTION 2. The completed work is hereby accepted from Taylor Woodrow Homes, Inc. SECTION 3. The required easement is hereby accepted from San Juan Hills Estates, HOA SECTION 4. The Chairman and Clerk of the Board are hereby authorized to execute this SECTION 5. The Clerk of the Board is hereby authorized to forward the Easement document to the Orange County Recorder's Office for recordation. SECTION 6. The Clerk of the Board is directed to forthwith forward a "Notice of Completion" to the Orange County Recorder's Office for recordation. SECTION 7. The Clerk of the Board is hereby authorized to release the surety provided by The American Insurance Company, Bond Number 11133221728, in the amount of $679,000 thirty-five (35) days after recording of a "Notice of Completion."
