CERTIFICATE OF COMPLIANCE (OWEN)
A RESOLUTION OF THE SAN JUAN CAPISTRANO
COMMUNITY REDEVELOPMENT AGENCY DETERMINING
THAT CERTAIN REAL PROPERTY LOCATED IN THE
SAN JUAN CAPISTRANO CENTRAL REDEVELOPMENT
PROJECT CONFORMS TO THE REDEVELOPMENT PLAN,
AND AUTHORIZING THE EXECUTION AND
ACKNOWLEDGMENT OF A CERTIFICATE OF
COMPLIANCE (OWEN)
WHEREAS, by Ordinance No. 488, the City Council of the
City of San Juan Capistrano (the "City") adopted and approved a
final redevelopment plan for the San Juan Capistrano Central
Redevelopment Project (the "Redevelopment Project"); and,
WHEREAS, the San Juan Capistrano Community
Redevelopment Agency (the "Agency") has by resolution approved
rules governing participation by owners, operators of businesses
and tenants in the redevelopment project area (the "Owner
Participation Rules"); and,
WHEREAS, pursuant to Section 509 of the Redevelopment
Plan for the Project Area and pursuant to Section III A of the
Owner Participation Rules, the Agency is authorized to make
determinations of those properties which conform to the
Redevelopment Plan and, upon the making of such determination,
the Agency may issue a Certificate of Conformance to qualifying
properties and such qualifying properties will no longer be
subject to acquisition by eminent domain by the Redevelopment
Plan so long as the property conforms to the Redevelopment Plan;
and,
WHEREAS, Gus Owen, (the "Owner") is the owner of
certain real property and improvements located within the
Redevelopment Project area more particularly described on Exhibit
"A" attached hereto and incorporated herein by reference (the
"Qualifying Property"), and the Owner has requested that the
Agency make the determination with respect to the conformance of
the Qualifying Property with the Redevelopment Plan and issue a
Certificate of Conformance with respect to the Qualifying
Property substantially in the form attached hereto as Exhibit "B"
and incorporated herein by reference (the "Certificate of
Compliance").
NOW, THEREFORE, the San Juan Capistrano Community
Redevelopment Agency does hereby resolve as follows:

SECTION 1.
The Agency hereby determines that the Qualifying
Property conforms to the Redevelopment Plan for the Project Area
and is generally compatible with the existing and proposed
developments and uses in the project area; and, so long as the
Qualifying Property continues to conform to the Redevelopment
Plan as the Redevelopment Plan may be amended in accordance with
its terms and to such further terms and conditions as the Agency
may be required as necessary or appropriate to carry out the
Redevelopment Plan, the Qualifying Property will not be subject
to acquisition by eminent domain under the Redevelopment Plan.
SECTION 2.
The Agency hereby approves the Certificate of
Compliance substantially in the form attached hereto as Exhibit
"B" and incorporated herein by reference and hereby authorizes
the Executive Director and Secretary of the Agency to execute,
acknowledge and deliver the Certificate of Compliance to the
Owner in a form suitable for recordation with the Office of the
County Recorder of the County of Orange.
SECTION 3.
The Agency agrees to consider the exclusion of the
Qualifying Property from the Boundaries of the Project Area in
the event that the Agency proposes to amend the Redevelopment
Plan for the Project Area by changing the boundaries thereof.
SECTION 4
This Resolution shall take effect immediately upon its
adoption.
