ADOPTING CONFLICT OF INTEREST CODE
A RESOLUTION OF THE SAN JUAN CAPISTRANO
COMMUNITY REDEVELOPMENT AGENCY ADOPTING
THE CONFLICT OF INTEREST CODE FOR
DESIGNATED EMPLOYEES
WHEREAS, the Political Reform Act, Government Code
Sections 81000, et seg., requires every local government agency
to adopt and promulgate a Conflict of Interest Code; and,
WHEREAS, this body has determined that the Code
accurately sets forth those positions which should be designated
and the categories of financial interests which should be made
reportable.
NOW, THEREFORE, BE IT RESOLVED that the Conflict of
Interest Code attached hereto as Exhibit "I" be adopted as the
Conflict of Interest Code for all agencies and employees of the
San Juan Capistrano Community Redevelopment Agency.
PASSED, APPROVED AND ADOPTED this 21st day of

CONFLICT OF INTEREST CODE FOR THE
CITY OF SAN JUAN CAPISTRANO
COMMUNITY REDEVELOPMENT AGENCY
The Political Reform Act, Government Code Sections
81000, et seq., requires state and local government agencies to
adopt and promulgate Conflict of Interest Codes. The Fair
Political Practices Commission has adopted a regulation, 2 Cal
Adm. Code Section 18730, which contains the terms of a standard
Conflict of Interest Code, which can be incoporated by reference,
and which may be amended by the Fair Political Practices
Commission to conform to amendments in the Political Reform Act
after public notice and hearings. Therefore, the terms of 2 Cal.
Adm. Code Section 18370 and any amendments to it duly adopted by
the Fair Political Practices Commission are hereby incorporated
by reference and, along with the attached Appendix "A" in which
officials and employees are designated and disclosure categories
are set forth, constitute the Conflict of Interest Code of the
San Juan Capistrano Community Redevelopment Agency.
Pursuant to Section 4(A) of the standard Code,
designated employees shall file statements of economic interests.
with the Agency. Upon receipt of the statements by the Filing
Officer, the Agency shall make and retain a copy and forward the
original of these statements to the San Juan Capistrano City
Council, which is the Code Reviewing Body.

*With respect to Consultants, the Exective Director may determine
in writing that a particular Consultant is hired to perform a
range of duties that are limited in scope and thus is not
required to comply with the disclosure requirements described in
these categories. Such determination shall include a description
of the Consultant's duties and, based upon that description, a
statement of the extent of disclosure requirements. The
determination shall be retained by the Filing Officer. Nothing
herein excuses any Consultant from any other provision of this
Code.
DISCLOSURE CATEGORIES
Designated Employees in Disclosure Category 1 Must Report:
All interests in real property, as defined in
Government Code Section 82033, within the jurisdiction. Real
property shall be deemed to be within the jurisdiction if the
property or any part of it is located within or not more than two
miles outside the boundaries of the San Juan Capistrano Community
Redevelopment Agency or within two miles of any land owned or
used by the San Juan Capistrano Community Redevelopment Agency.
No disclosure need be made concerning the principal residence of
the designated employee.
Designated Employees in Disclosure Category 2 Must Report:
All investments, as defined in Government Code Section
82034.
Financial interests are reportable only if located
within or subject to the jurisdiction of the San Juan Capistrano
Community Redevelopment Agency, or if the business entity is
doing business or planning to do business with the San Juan
Capistrano Community Redevelopment Agency, or has done business
within the San Juan Capistrano Community Redevelopment Agency at
any time during the two years prior to the filing of the
statement.
Designated Employees in Disclosure Category 3 Must Report:
All income, as defined in Government Code Section
82030, from any source located or doing business within the
jurisdiction.
Income received from a public agency need not be
disclosed.
Designated Employees in Disclosure Category 4 Must Report:
Investments in, or income from, any business entity if
such business entity manufactures or sells supplies, machinery or
equipment of the type utilized by the San Juan Capistrano
Community Redevelopment Agency, or if such business entity is a
contractor or subcontractor engaged in the performance of work or
services of the type utilized by the San Juan Capistrano
Conununity Redevelopment Agency,
