Resolution Number CRA 90-4-3-1333. RESOLUTION NO. CRA 90-4-3-1 FINDINGS RE: MEETING LOW- AND MODERATE -INCOME HOUSING NEEDS A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY, MAKING CERTAIN FINDINGS WITH RESPECT TO THE EFFORTS OF THE CITY OF SAN JUAN CAPISTRANO AND THE AGENCY TO MEET THE LOW- AND MODERATE -INCOME HOUSING NEEDS IN THE COMMUNITY AND DIRECTING CERTAIN TRANSMITTALS WHEREAS, a Redevelopment Plan for the City of San Juan Capistrano Redevelopment Area (Redevelopment Area) was approved and adopted by the City Council of the City of San Juan Capistrano (City) on July 12, 1983, by Ordinance No. 488, as amended by Ordinances Nos. 590, 547, and 582; and, WHEREAS, the Redevelopment Agency, City of San Juan Capistrano, California (the Agency) is engaged in activities necessary and appropriate to carry out such Redevelopment Plan; and, WHEREAS, pursuant to Section 33334.2 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) the Agency is required to establish a Low- and Moderate -Income Housing Fund for such Redevelopment Project, and to deposit therein not less than twenty percent (20%) of the tax increment funds allocated to the Agency for the Project in the applicable Fiscal Year, except as necessary to pay for existing projects, programs, or activities pertaining to the Project; and, WHEREAS, the Agency, pursuant to subdivision (f) of Section 33334.2 of the Community Redevelopment Law, has prepared a proposed Statement of Findings for the San Juan Capistrano Redevelopment Area and submitted such Statement to the City Council of the City of San Juan Capistrano and the Department of Housing and Community Development in a timely manner, as presented in Exhibit A, attached hereto. NOW, THEREFORE, BE IT RESOLVED, by the San Juan Capistrano Community Redevelopment Agency, City of San Juan Capistrano, California, as follows: SECTION I. The Community Redevelopment Agency hereby finds and determines that a substantial effort to meet the low- and moderate -income housing needs in the community is being made by the City and the Agency, that this effort, including the obligation of funds currently available for the benefit of the community from state, local, and federal sources for low- and moderate -income housing along or in combination with the taxes allocated pursuant to Health and Safety Section 33334.2 is equivalent in impact to the funds otherwise required to be set aside pursuant to said section of the Health and Safety Code. -1- o 4 SECTION 2. The Agency Secretary, in cooperation with the Executive Director of the Agency, is hereby authorized and directed to transmit a copy of this resolution to the State of California, Department of Housing and Community Development, along with any and all factual information supporting this resolution as required by Health and Safety Code Section 33334.2(b) within ten (10) days of the adoption of this resolution.
