CRA 89-6-6-1 ADOPTING HOUSING REPLACEMENT PLAN A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY, ADOPTING A HOUSING REPLACEMENT PLAN FOR ANY LOW- OR MODERATE -INCOME DWELLING UNIT REMOVED AS A PART OF A PROJECT WITHIN THE REDEVELOPMENT PROJECT AREA WHEREAS, the Community Redevelopment Agency of the City of San Juan Capistrano has prepare a draft "Replacement Housing Plan" for public review and, WHEREAS, a timely and properly -noticed public meeting on said proposed Replacement Housing Plan was held by the San Juan Capistrano Community Redevelopment Agency ; and, WHEREAS, at said meeting evidence, oral and documentary, was submitted regarding said Replacement Housing Plan; and, WHEREAS, the San Juan Capistrano Community Redevelopment Agency considered all evidence in its deliberation in reference to subject Replacement Housing Plan. Section 33413 requires the replacement of any low or moderate income dwelling unit removed or destroyed as part of a redevelopment project. Section 33413.5 requires the Agency to adopt, by resolution, a plan for the replacement of such housing. This Replacement Housing Plan not only provides for the replacement of three housing units already removed from the Redevelopment Project Area, but also provides a surplus, of replacement housing to be drawn upon should further housing units be removed due to activity of the Agency in acquiring property within the Project Area. NUMBER AND GENERAL LOCATION OF REPLACEMENT HOUSING UNITS The Replacement Housing Map (attached hereto as Attachment No. 1 and incorporated herein by this reference) indicates one of the general locations for replacement low and moderate income dwelling units proposed to be constructed within the Project Area by the San Juan Capistrano Community Housing Corporation. A minimum of ten rental units will be constructed on City property in the "Little Hollywood" area of the Los Rios District and will be rented to qualifying low and moderate income persons at below market rents. In addition, 265 rental units were constructed in the project area with Agency assistance in 1986. The complex, Capistrano Pointe Apartments, 26451 Camino De Vista, is required to rent a minimum of twenty percent (53) of the units to low and moderate income persons. FINANCING OF REPLACEMENT HOUSING UNITS The "Little Hollywood" development site was acquired by the City in 1980 through the use of Community Development Block Grant Funds. In 1986, the Agency provided $40,000 in funding to the Community Housing Corporation for the design of the rental units referenced above. Obtaining financing to assist the Community Housing Corporation in the development and construction of these replacement units will be a critical component of this Plan. At this point, the Agency has not determined how development and construction costs will be financed. However, the Agency can affirmatively state that funding assistance for financing the replacement units will come from one or more of four (4) possible sources: 1. Federal and State grants, loans, and loan guarantees; 2. Sale of tax-exempt mortgage revenue bonds; 3. Loans to the Community Housing Corporation from private lending institutions; and/or Use of that portion of tax increment revenue set aside by the Agency to fund development and construction of low and moderate income housing projects. If feasible, the Agency will utilize Federal or State grants or loans, including, but not limited to: HUD Urban Development Action Grants, HUD Community Development Block Grant Funds, or various mortgage subsidy or guarantee programs that may become _ available. The latter includes Section 8 New California Housing Financing Agency. The Agency may also commit increment funds to subsidize replacement housing to the extent provided by Section 33334.2 of the California Health and Safety Code. As the flow of tax increment increases, a portion could thus be set aside to fund housing. FINDING REGARDING VOTER APPROVAL The rental units to be constructed pursuant to this Plan have been designed to allow for mixed income occupancy and are comparable to market rate development projects provided by the private sector in terms of architecture, design, and locational standards. For this reason, and because the proposed replacement housing development meets the criteria of Health and Safety Code Section 37001, Article XXXIV of the State Constitution does not apply and voter approval is not required. TIMETABLE FOR DEVELOPMENT AND CONSTRUCTION OF REPLACEMENT HOUSING UNITS The "Little Hollywood Housing" Development Schedule (attached hereto as Attachment No. 2 and incorporated herein by this reference) indicates the approximate timetable for development and construction of the replacement dwelling units proposed under this Plan. In accordance with Health and Safety Code Section 33413(a), replacement units for the structures removed in 1988 are provided in the Capistrano Pointe Apartments constructed in 1986. Completion of the new rental units in "Little Hollywood" is anticipated by 1992. SUMMARY In summary, the Agency has exceeded requirements for providing replacement housing in the project area for the three units removed on El Camino Real in August 1988. Fifty- three rental units are provided in the Capistrano Pointe Apartments, and an additional 10 rental units will be constructed within four years at the "Little Hollywood" site. In addition to replacing the three units removed from El Camino Real in August 1988, this Plan will provide an excess of replacement dwelling units at affordable rents and with better living accommodations than those already removed, or which may later be removed.
