RESOLUTION NO. CRA 87-11-17-1
A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY
REDEVELOPMENT AGENCY, MAKING CERTAIN FINDINGS WITH
RESPECT TO THE ENVIRONMENTAL IMPACTS OF THE HISTORIC
TOWN CENTER DISPOSITION AND DEVELOPMENT AGREEMENT
AND CERTIFYING THE DRAFT ENVIRONMENTAL IMPACT
REPORT
WHEREAS, a Draft Environmental Impact Report for the proposed Historic
Town Center Disposition and Development Agreement (the "Project") has heretofore
been prepared and circulated for comment pursuant to the California Environmental
Quality Act of 1970 ("CEQA"), and state and local regulations and guidelines adopted
pursuant thereto; and,
WHEREAS, a duly noticed public hearing was held on said Draft Environmental
Impact Report on November 17, 1987, at which time all persons were given an
opportunity to be heard; and,
WHEREAS, a Draft Environmental Impact Report for the Project has been
prepared pursuant to said statutes, regulations, and guidelines; and,
WHEREAS, the Board of Directors has reviewed and considered the
information contained in said Environmental Impact Report.
NOW, THEREFORE, BE IT RESOLVED, by the San Juan Capistrano
Community Redevelopment Agency as follows:
SECTION 1.
The information contained in the Draft Environmental Impact Report for the
Historic Town Center Disposition and Development Agreement has been reviewed and
considered by the members of the Board of Directors, and the Draft Environmental
Impact Report is hereby approved and adopted as the Final Environmental Impact Report
for the Project ("Final Environmental Impact Report").
SECTION 2.
The Board of Directors hereby finds and determines as follows with respect to
the adverse environmental impacts detailed in the Final Environmental Impact Report:
A. That the adverse environmental impacts of the Project set forth in the
Final Environmental Impact Report, including those raised in comments
to the Draft Environmental Impact Report, have been considered and
recognized by the Board of Directors;
B. That based on information set forth in the Final Environmental Impact
Report, the Board of Directors finds and determines that measures have
been required in or incorporated into the Project which mitigate or avoid
each of the adverse environmental impacts identified in the Final
Environmental Impact Report; and,

222 C. That all significant environmental effects identified in the Final
Environmental Impact Report have been reduced to an acceptable level
in that: (1) all significant environmental effects that can feasibly be
avoided have been eliminated or substantially lessened; and, (2) the
Project will not result in any significant environmental impacts that are
incapable of being mitigated to an insignificant level.
SECTION 3.
The Board of Directors of the San Juan Capistrano Community Redevelopment
Agency finds and determines that the Project will not have a significant effect or result
in a substantial or potentially substantial adverse change in the environment.
SECTION 4.
The Board of Directors further finds and determines that as to those
environmental impacts which cannot be entirely mitigated, the public health, safety, and
general welfare would best be served by the adoption of the Project because of the
overriding economic and social values of the Project set forth in the Final Environmental
Impact Report.
SECTION 5.
The City Clerk is hereby directed to cause the filing of a Notice of
Determination with respect to the Final Environmental Impact Report pertaining to
approval of the Historic Town Center Disposition and Development Agreement with the
Orange County Clerk's Office.
SECTION 6.
The Board of Directors hereby certifies that the Final Environmental Impact
Report for the Historic Town Center Disposition and Development Agreement has been
prepared and completed in compliance with the California Environmental Quality Act of
1970 (CEQA) and state and local regulations and guidelines adopted pursuant thereto.
SECTION 7.
The San Juan Capistrano Community Redevelopment Agency hereby further
certifies that the information contained in the Final Environmental Impact Report for
the Project has been reviewed and considered by the members of the Board of Directors.
