CRA 91-3-6-1 APPROVING AGREEMENT FOR SALE OF REAL PROPERTY (KINOSHITA) A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY, APPROVING THE EXECUTION OF AN AGREEMENT FOR THE SALE OF REAL PROPERTY BETWEEN THE SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY AND THE CITY OF SAN JUAN CAPISTRANO (KINOSHITA) WHEREAS, the Community Redevelopment Agency of the City of San Juan Capistrano (the "Agency") and the City of San Juan Capistrano (the "City") desire to enter into an Agreement for the Sale of Real Property (the "Agreement"), which Agreement provides for the Agency to sell, and the City to purchase the Property (as such term is defined in the Agreement); and, WHEREAS, the Agency has duly considered all terms and conditions of the Agreement and finds that the Agreement is in the best interests of the Agency and the health, safety and welfare of the residents of the City of San Juan Capistrano, and in accordance with the public purposes and provisions of applicable State and local law requirements. NOW, THEREFORE, the Agency does hereby find, determine, order and resolve as follows: SECTION 1. The Agency hereby approves the Agreement and authorizes and directs the Executive Director and the Chairman to execute the Agreement and all documents referenced in the Agreement necessary to effectuate the provisions of the Agreement. SECTION 2. The Agency has received and considered the report of Agency staff on the sale of real property to be carried out pursuant to said Agreement and, as a result of said consideration and evidence presented at the hearing on the same matter, the Agency has determined that the adoption of this resolution and the decision to dispose of an interest in the Property to ensure preservation of agriculture within the community is categorically exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to the provisions of California Code of Regulations, Title 14, Section 15317. Accordingly, the Agency staff will prepare and file a Notice of Exemption with the County Clerk of the County of Orange. PASSED, APPROVED, AND ADOPTED this 6th day of March , 1991. G.c�iicut.
