APPROVING COMMITMENT OF LOW- AND MODERATE -INCOME
HOUSING SET ASIDE FUNDS AND LEVERAGE FUNDS FOR HOME
INVESTMENT PARTNERSHIP PROGRAM FUNDING APPLICATION
A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY
REDEVELOPMENT AGENCY, COMMITTING LOW- AND MODERATE -
INCOME HOUSING SET ASIDE FUNDS EQUAL TO 25% OF THE CITY OF
SAN JUAN CAPISTRANO' S REQUIRED HOME INVESTMENT PARTNERSHIP
PROGRAM MATCH ($119,345) AND AN ADDITIONAL MINIMUM OF
$240,000 IN LOW- AND MODERATE -INCOME HOUSING SET ASIDE FUNDS
AS LEVERAGE FUNDS FOR THE CITY OF SAN JUAN CAPISTRANO
APPLICATION TO THE STATE OF CALIFORNIA DEPARTMENT OF
HOUSING AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE
HOME INVESTMENT PARTNERSHIP PROGRAM
WHEREAS, the San Juan Capistrano Community Redevelopment Agency, 32400
Paseo Adelanto, San Juan Capistrano, California 92675, is authorized under California
Redevelopment Law Section 33334.2(e)(1) to expend Low- and Moderate -Income Housing Set
Aside for the provision of low- and moderate -income housing; and,
WHEREAS, the City of San Juan Capistrano, 32400 Paseo Adelanto, San Juan
Capistrano, California 92675, a political subdivision of the State of California, wishes to apply for
and receive an allocation of funds through the HOME Investment Partnership Program (hereinafter
referred to as "HOME"); and,
WHEREAS, the California Department of Housing and Community Development
(hereinafter referred to as the "Department") has issued a Notice of Funding Availability for the
HOME Program and is authorized to approve funding allocations which will be made available
directly through the U.S. Department of Housing and Urban Development (HUD) to be used for the
purposes set forth in Title II of the Cranston -Gonzalez National Affordable Housing Act of 1990,
the implementing regulations set forth in Title 24 of the Code of Federal Regulations, Part 92, and
Title 25 of the California Code of Regulations commencing with Section 8200; and,
WHEREAS, the City of San Juan Capistrano wishes to submit an application to
obtain from the Department an allocation of HOME funds; and,
WHEREAS, the City of San Juan Capistrano is required to match 25% of its HOME
activity funds with a source of funds other than Federal funds; and,
WHEREAS, the City of San Juan Capistrano has requested the San Juan Capistrano
Community Redevelopment Agency commit Low- and Moderate -Income Housing Set Aside Funds
as the required 25% HOME Program Match funds; and,

WHEREAS, the City of San Juan Capistrano has requested the San Juan Capistrano
Community Redevelopment Agency commit an additional minimum amount of $240,000 in Low -
and Moderate -Income Housing Set Aside Funds as leverage funds for the HOME Program Owner -
Occupied Housing Rehabilitation Program identified in the 1998-1999 City of San Juan Capistrano
application to the State of California Department of Housing and Community Development for
funding under the Home Investment Partnership Program; and,
WHEREAS, the housing activity (Owner -Occupied Housing Rehabilitation Program)
identified in the City of San Juan Capistrano application to the State of California Department of
Housing and Community Development for funling under the HOME Investment Partnership
Program is consistent with the policies and objectives of the San Juan Capistrano General Plan; and,
WHEREAS, the housing activity (Owner -Occupied Housing Rehabilitation Program)
identified in the City of San Juan Capistrano application to the State of California Department of
Housing and Community Development for funding under the Home Investment Partnership Program
is consistent with the policies and objective of the San Juan Capistrano Housing Element; and,
WHEREAS, the housing activity (Owner -Occupied Housing Rehabilitation Program)
identified in the City of San Juan Capistrano application to the State of California Department of
Housing and Community Development for funding under the Home Investment Partnership Program
is consistent with California Community Redevelopment Law.
NOW, THEREFORE, BE IT RESOLVED, that as a part of the City of San Juan
Capistrano application to the State of California Department of Housing and Community
Development pursuant to the August 28, 1998, Notice of Funding Availability, the San Juan
Capistrano Community Redevelopment Agency commits Low- and Moderate -Income Housing Set
Aside Funds equal to 25% of the City of San Juan Capistrano's required Home Investment
Partnership Program Match of at least $119,345 and an additional minimum of $240,000 in Low -
and Moderate -Income Housing Funds as leverage funds to fund approximately 33.46 loans in
conjunction with the HOME funds for the Owner -Occupied Housing Rehabilitation Program.
