APPROVAL OF THE COMMITMENT OF LOW- AND MODERATE -
INCOME HOUSING SET ASIDE FUNDS FOR APPLICATION FOR
FUNDING UNDER HOME INVESTMENT PARTNERSHH' PROGRAM AND
THE COMMITMENT OF PROPERTY FOR THE CONSTRUCTION
OF LOW- AND MODERATE -INCOME RENTAL HOUSING
A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY
REDEVELOPMENT AGENCY, COMMITTING LOW- AND MODERATE -
INCOME HOUSING SET ASIDE FUNDS EQUAL TO 25% OF THE CITY OF
SAN JUAN CAPISTRANO REQUIRED HOME INVESTMENT PARTNERSHIP
PROGRAM MATCH ($238,750) AND AN ADDITIONAL MINIMUM OF
$203,962 IN LOW- AND MODERATE -INCOME HOUSING SET ASIDE FUNDS
AS LEVERAGE FUNDS FOR THE LITTLE HOLLYWOOD NEW
CONSTRUCTION PROJECT SUBMITTED AS A PART OF THE CITY'S
APPLICATION TO THE STATE DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE HOME
INVESTMENT PARTNERSHIPS PROGRAM
WHEREAS, the San Juan Capistrano Community Redevelopment Agency, 32400
Paseo Adelanto, San Juan Capistrano, California 92675, is authorized under California
Redevelopment Law Section 33334.2(e)(1) to expend Low- and Moderate -Income Housing Set
Aside for the provision of low- and moderate -income housing, and,
WHEREAS, the City of San Juan Capistrano, 32400 Paseo Adelanto, San Juan
Capistrano, California 92675, a political subdivision of the State of California, wishes to apply for
and receive an allocation of funds through the HOME Investment Partnerships Program (hereinafter
referred to as "HOME"); and,
WHEREAS, the California Department of Housing and Community Development
("hereinafter referred to as the "Department") has issued a Notice of Funding Availability for the
HOME program and is authorized to approve funding allocations which will be made available
directly through the United States Department of Housing and Urban Development (HUD) to be used
for the purposes set forth in Title II of the Cranston -Gonzalez National Affordable Housing Act of
1990, the implementing regulations set forth in Title 24 of the Code of Federal Regulations, Part 92,
and Title 25 of the California Code of Regulations commencing with Section 8200; and,
WHEREAS, the City of San Juan Capistrano wishes to submit an application to
obtain from the Department an allocation of HOME funds; and,
WHEREAS, the City of San Juan Capistrano is required to match 25% of its HOME
activity funds with a source of funds other than Federal funds, and,
WHEREAS, the City of San Juan Capistrano has requested the San Juan Capistrano
Community Redevelopment Agency to commit Low- and Moderate -Income Housing Set Aside
Funds as the required 25% HOME Program Match Funds; and,

WHEREAS, the City of San Juan Capistrano has requested the San Juan Capistrano
Community Redevelopment Agency to commit an additional minimum amount of $203,962 in Low -
and Moderate -Income Housing Set Aside Funds as leverage funds for the HOME Program Little
Hollywood New Construction Project identified in the City of San Juan Capistrano application to the
State of California Department of Housing and Community Development for funding under the
HOME Investment Partnership Program; and,
WHEREAS, on March 20, 1984, the City of San Juan Capistrano transferred
ownership of parcels 121-142-01, 121-142-07 and 649-281-05 ("Little Hollywood") including
existing rental housing units to the San Juan Capistrano Community Redevelopment Agency for the
purpose of implementing the rehabilitation and new construction of the Little Hollywood affordable
low- and moderate income rental housing units; and,
WHEREAS, the San Juan Capistrano Community Redevelopment Agency, as owner
of the Little Hollywood rental housing units identified as 26513 Mission Street, 26519 Mission Street,
26511 Mission Street, 26510 Mission Street, 26581 Mission Street, 26599 Mission Street, 26595
Mission Street, 26590 Mission Street and 26580 Ramos Street, commits these rental housing units
and associated land with an assessed value of a minimum of $209,678 as low- and moderate -income
rental housing units pursuant to the State HCD HOME Program regulations for a minimum of 20
years; and,
WHEREAS, the housing activities (Little Hollywood New Construction Project and
Owner -Occupied Housing Rehabilitation Program) identified in the City of San Juan Capistrano
application to the State of California Department of Housing and Community Development for
funding under the HOME Investment Partnership Program are consistent with the policies and
objectives of the San Juan Capistrano General Plan; and,
WHEREAS, the housing activities (Little Hollywood New Construction Project and
Owner -Occupied Housing Rehabilitation Program) identified in the City of San Juan Capistrano
application to the State of California Department of Housing and Community Development for
funding under the HOME Investment Partnership Program are consistent with the policies and
objectives of the San Juan Capistrano Housing Element, and,
WHEREAS, the housing activities (Little Hollywood New Construction Project and
Owner -Occupied Housing Rehabilitation Program) identified in the City of San Juan Capistrano
application to the State of California Department of Housing and Community Development for
funding under the HOME Investment Partnership Program are consistent with California Community
Redevelopment Law.
NOW, THEREFORE, BE IT RESOLVED, that as a part of the City of San Juan
Capistrano application to the State of California Department of Housing and Community
Development pursuant to the August 13, 1997, Notice of Funding Availability, the San Juan
Capistrano Community Redevelopment Agency Board of Directors do hereby commit Low- and
Moderate -Income Housing Set Aside Funds equal to 25% of the City of San Juan Capistrano's
required HOME Investment Partnership Program Match of at least $238,750, and an additional
minimum of $203,962 in Low- and Moderate -Income Housing Funds as leverage funds for the Little
Hollywood New Construction Project. In addition, the San Juan Capistrano Community
Redevelopment Agency commits 26513 Mission Street, 26519 Mission Street, 26511 Mission Street,

Mission Street and 26580 Ramos Street as low- and moderate -income rental housing units for a
period of not less than 20 years subject to the State HCD HOME Program regulations.
