A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY
REDEVELOPMENT AGENCY, GRANTING EASEMENTS FOR
UNDERGROUND ELECTRIC FACILITIES TO SAN DIEGO GAS AND
ELECTRIC COMPANY WITHIN LOTS 19, 25 AND 27 OF TRACT 103
(HISTORIC TOWN CENTER)
WHEREAS, the Community Redevelopment Agency of the City of San Juan
Capistrano is the fee title owner of Lots 19, 25 and 27 of Tract 103; and,
WHEREAS, the codes of the City of San Juan Capistrano require all utility services
located within certain redeveloped properties to be installed underground; and,
WHEREAS, the San Diego Gas and Electric Company is processing the Community
Redevelopment Agency's request to convert its overhead electric facilities to underground electric
facilities.
NOW, THEREFORE, BE IT RESOLVED, by the San Juan Capistrano Community
Redevelopment Agency Board of Directors, City of San Juan Capistrano, California, as follows:
I . The Community Redevelopment Agency hereby grants the attached easements
for the underground electric facilities.
2. The Chairman of the Community Redevelopment Agency and the Agency
Secretary are hereby authorized to execute said easements.
3. The Agency Secretary is directed to forward said easements to the San Diego
Gas and Electric Company; said utility company will forward the easements to the Orange County
Recorder's Office.

Municipal Agency hereinafter called "Grantor", grants to SAN DIEGO GAS & ELECTRIC COMPANY,
a corporation, hereinafter called "Grantee", an easement and right of way to erect, construct, change the
size of, improve, reconstruct, relocate, repair, maintain and use facilities consisting of: (1) Underground
electric facilities, and appurtenances for the transmission and distribution of electricity, (2) Underground
communication facilities, and appurtenances, together with the right of ingress thereto and egress
therefrom over said easement and over other practical routes across Grantor's land situated in the County
of Orange, State of California.
Lots 25 and 27 of Tract 103 according to Map thereof recorded in Book 11, Pages 29
through 33 inclusive of Miscellaneous Maps, records of Orange County.
"A"and `B":
The easement in the aforesaid lands shall be more particularly described as follows in Parcels
PARCEL "A":
The Easterly 10.00 feet of said Lot 25.
PARCEL "B":
The Northerly 12.00 feet of said Lot 27.
Grantor will exercise only such reserved rights in said land as will not interfere with or
prohibit the free and complete use and enjoyment by Grantee, its successor or assigns, of the rights
hereby granted. Grantee shall have the right to assign any or all rights granted in this easement in whole
or in part to other companies providing utility or communication services. Grantee shall have the right to
top, cut, remove, or trim interfering plants and trees, and to keep said easement free from and to prevent
any person, including Grantor and successors and assigns, from erecting, placing, or storing on said
easement any flammable or other hazards and any structures, objects, or earth fills/cuts or other
obstructions, except walls and fences.

be the centerline of the facilities as installed on Grantor's property, the approximate location being shown and
delineated on the Exhibit "A" attached hereto and made a part hereof.
Grantor will exercise only such reserved rights in said land as will not interfere with or
prohibit the free and complete use and enjoyment by Grantee, its successor or assigns, of the rights
hereby granted. Grantee shall have the right to assign any or all rights granted in this easement in whole
or in part to other companies providing utility or communication services. Grantee shall have the right to
